CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE. ROCK, ARKANSAS:
Section 1. That the zoning classification of the following described property be changed fi•om R-3,
Single -Family to POD:
Lot 12 Block 26 Cunningham Addition to the City of Little Rock, Pulaski County,
Arkansas.
Section 2. That the approval of Lot 12, Block 26, Cunningham Addition Short -Form POD (Z-8518),
located on the Southeast corner of 11`h Street and Van Buren Street is subject to compliance with the
following additional conditions:
That the preliminary site development plan/plat be approved as submitted,
including all staff comments and conditions as outlined in the Planning
Commission Agenda Staff Report in paragraphs D, E, F and including any
conditions indicated in the staff analysis in paragraph H and subject to
23 additional conditions imposed at the Planning Commission Public Hearing
24 as amended by the applicant.
25 Section 3. That the preliminary site development plan/plat be approved as recommended by the
26 Little Rock Planning Commission.
27 Section 4. That the change in zoning classification contemplated for Lot 12, Block 26, Cunningham
28 Addition Short -Form POD (Z-8518), located on the Southeast corner of 11"' Street and Van Buren Street
29 is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII,
30 Section 36-454 (e) of the Code of Ordinances,

Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the
plan.
Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
ordinance.
Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

The request is a rezoning from R-3, Single-family to POD
to allow a new parking lot to be constructed to serve an
adjacent medical office.
None.
Staff recommends approval of the requested POD zoning.
The Planning Commission voted to recommend approval of
the requested zoning by a vote of 9 ayes, 0 noes and
2 absent.
The Planning Commission reviewed the proposed POD
request at its February 25, 2010, meeting. There were no
registered objectors present. The War Memorial
Neighborhood Association, all residents who could be
identified located within 300 feet of the site and all property
owners located within 200-feet of the site were notified of
the Public Hearing.
BACKGROUND
The request is a rezoning from R-3, Single-family to POD
to allow a new parking lot to be constructed. The parking
lot will be constructed to tie into an existing adjoining
parking lot located to the east. The parking lot is proposed
to serve a medical office use located to the south fronting
on W. 12`h Street. The applicant has provided a letter of
agreement between the two property owners and upon
approval a formal agreement will be executed and filed
with the County Clerk. The filing instrument number will
be provided on the final development plan submitted to
staff for approval.
The lot is a 50-foot by 140-foot lot containing 0.16 acres.
Access to the lot is proposed off an existing alley and via a
20 foot access easement extending from W. 11 u' Street to
the alley on the lot located to the east which is currently
paved and being used as parking.
Although the site is indicated as Residential Low Density
on the Future Land Use Plan staff is supportive of the
request. While office uses are not ideal in areas shown as
Residential Low Density on the Future Land Use Plan, this
is a Planned Development and is intended to serve an
adjacent medical office use. To staff s knowledge there are
no outstanding technical issues in need of addressing
associated with the request.

recommendation.

currently zoned R2. We are requesting that this property be converted into a parking lot
to work in conjunction with adjoining parking lot. The site is only _ 16 acres and 50it.
wide by 140ft. long. Due to lot size, we request that no additional right-of-way be
required on either Van Buren Street or Eleventh Street.
