Z-8529-A NAME- Valley View Court Revised Short -form PD-R LOCATION: located on the West side of Katillus Road at Forest Lane Planning Staff Comments: 1. Provide notification of the abutting property owners including the certified abstract list, notice form with affidavit executed and proof of mailing. The notice must be mailed no later than February 5, 2014. The Office of Planning and Development must receive the proof of notice no later than February 14, 2014. 2. All property owners with in the development must agree to the removal of the gates. If the gates are to be removed and the streets dedicated as public streets all property owners must agree to dedication of the right of way to the City. 3. All property owners within the subdivision must sign the dedication deed to make the streets public. Variance/Waivers: None requested. Public Works Conditions: 1. All property owners must agree to dedicate portions of their lot(s) to the City of Little Rock. Per Section 31-208(i), no street shall be offered nor reviewed for dedication where a structure abuts the right of way or where such action would circumvent the subdivision ordinance review for new streets or subdivisions. 2. The building setbacks are very minimum from the right of way. The homes are 7.5 feet off the back of curb and 18 feet off the back of curb. If the present easement width of 45 feet was dedicated as right of way, the homes will be 1.5 feet off the right of way line and 3 feet off the right of way line. Air conditioners, private utilities, fences, community mail boxes, parked vehicles in driveways, etc. will be located in the right of way. 3. Valleta Circle at S. Katillus Road is divided with an island. The width of Valleta Circle at S. Katillus Road is approximately 55 feet wide at its narrowest with a 15 feet wide island at its narrowest. The street design is for a gate system and does not comply with the City of Little Rock standards and details. The existing street and island widths create a safety concern due to vehicles have the tendency to enter the exit lane off S. Katillus Road. 4. The street construction was not inspected by City staff. Some bad spots in the pavement were identified during inspection. Seven (7) pavement boring at locations chosen by the City of Little Rock staff should be made to show the depth of asphalt and base course. 5. The drainage system in Tract B should remain private and the responsibility of the Item # 9. POA to maintain. 6. Since the street is proposed to be 24 feet in width, show on the plan the area of street where parking will be restricted to one side. Show on the plat the area where parking will be restricted. 7. The stormwater drainage system must be inspected by video to determine construction methods, current condition, materials, dimensions, and needed maintenance. 8. (Removal of gate and streets remain private) The pavement and island widths create unsafe driving conditions. Vehicles will have the tendency to enter the exit lane with the gate not installed. 9. In accordance with Section 32-8, no obstruction to visibility shall be located within a triangular area 50 feet back from the intersecting proposed right-of-way line at the intersection of all intersection of Valletta Circle. The obstructions are homes, fences, community mailboxes, etc. Revised plat/plan: Submit four (4) copies of a revised preliminary plat/plan (to include the additional information as noted above) to staff on Wednesday, February 5, 2014. NEW STREET: 0 LF PD-R 42 units attached single-family housing Revised PD-R PROPOSED USE: 42 units attached single-family housing — allow the removal of the proposed gates for the subdivision and allow the private streets to become public VARIANCES/WAIVERS REQUESTED: None requested. The applicant submitted a requested on February 5, 2014, requesting deferral of this item to the April 3, 2014, public hearing. Staff is supportive of the deferral request. PLANNING COMMISSION ACTION: (FEBRUARY 20, 2014) The applicant was present. There were no registered objectors present. Staff presented the item stating the applicant had submitted a request on February 5, 2014, requesting deferral of the item to the April 3, 2014, public hearing. Staff stated they were supportive of the deferral request. May 15, 2014 SUBDIVISION ITEM NO.: B Cont. FILE NO.: Z-8529-A There was no further discussion of the item. The Chair entertained a motion of approval of the item as presented by staff. The motion carried by a vote of 10 ayes 0 noes and 1 absent. STAFF UPDATE: The applicant failed to notify property owners are required by the Commission's By-laws. Staff recommends deferral of this item to the May 15, 2014, public hearing. PLANNING COMMISSION ACTION: (APRIL 3, 2014) The applicant was present. There were no registered objectors present. Staff presented the item stating the applicant had failed to notify property owners are required by the Commission's By-laws. Staff presented a recommendation of deferral of this item to the May 15, 2014, public hearing. There was no further discussion of the item. The Chair entertained a motion for approval of the item as presented by staff. The motion carried by a vote of 11 ayes, 0 noes and 0 absent. STAFF UPDATE: The applicant is requesting withdrawal of this item. The applicant has indicated the streets will be maintained as private streets and the gates will be installed as stated in the previous approval. The applicant is requesting to be allowed to delay the installation of the gates until after the foundations for the remaining lots have been poured. It appears there are four buildings which have not been permitted for construction. The applicant is requesting to be allowed to permit three (3) of the four (4) buildings prior to the installation of the gate. The applicant states at that time, there will no longer be large construction vehicles and machinery entering and exiting subdivision. Staff is supportive of the applicant's request.
