at their September 21, 2010, Public Hearing approving a revision to the Planned
Development for The Orchards at Mabelvale Phase II Short -form PD-R (Z-8519-
B), located at 9501 Mabelvale Pike. The Planning Commission made a
recommendation of approval at their August 12, 2010 Public Hearing of this
request.

6 SHORT -FORM PD-R (Z-8519-B), LOCATED AT 9501 MABELVALE
7 PIKE, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL
8 ZONING MAP OF THE CITY OF LITTLE ROCK, ARKANSAS; AND
9 FOR OTHER PURPOSES.

11 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF.
12 THE CITY OF LITTLE ROCK, ARKANSAS:
13 Section 1. That the zoning classification of the following described property be changed
14 from C-3 to PD-R:
15 Lands lying in the Southeast '/4 of the Northeast Quarter of Section 3 and in the
16 Northwest Quarter of Section 2 all in Township I South, Range 13 West, Pulaski
17 County, Arkansas more particularly described as follows: Commencing at a
18 found 1-inch pipe at the southeast corner of SW ''/4, NE '/4 of said Section 3;
19 thence N90°00'00"E, 324.31 feet; thence N00°00'00"E 351,72 feet to the point of
20 beginning; thence N00°14'10"E 444.69 feet; thence S89°45'51"E 274.32 feet;
21 thence S00°14'10"W 444.69 feet; thence N89°45'50"W 274.33 feet to the point
22 of beginning containing 2.801 acres more or less.
23 Section 2. That the approval of The Orchards at IVlabelvale Phase II Short -Form PD-R (Z-
24 8519-B), located at 9501 Mabelvaie Pike, is subject to compliance with the following additional
25 conditions:
26 That the preliminary site development plan/plat be approved as submitted,
27 including all staff comments and conditions as outlined in the Planning
28 Commission Agenda Staff Report in paragraphs D, E, F and including any
29 conditions indicated in the staff analysis in paragraph H and subject to
30 additional conditions imposed at the Planning Commission Public Hearing as
31 amended by the applicant.

Section 4. That the change in zoning classification contemplated for The Orchards at
Mabelvale Phase II Short -Form PD-R (Z-8519-B), located at 9501 Mabelvale Pike, is conditioned
upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section
36A54 (e) of the Code of Ordinances.
Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of
Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in
the respects necessary to affect and designate the change provided for in Section I hereof.
Section 6. That this Ordinance shall not take effect and be in full force until the final
approval of the plan.
Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause,
phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
declaration or adjudication shall not affect the remaining portions of the ordinance which shall
remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional
were not originally a part of the ordinance.
Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
inconsistency.

The request is a rezoning from C-3 to PD-R to allow the
development of 2.36 acres, with 48 units of elderly housing
age restricted to persons 55 years plus.

Staff recommends approval of the requested PD-R zoning.
The Planning Commission voted to recommend approval of
the requested zoning by a vote of 7 ayes, 0 noes, 3 absent
and 1 open position.
The Planning Commission reviewed the proposed PD-R
request at its August 12, 2010, meeting. There were no
registered objectors present. The Mavis Circle and the
Pinedale Neighborhood Associations, Southwest Little
Rock United for Progress, all residents who could be
identified located within 300 feet of the site and all property
owners located within 200-feet of the site were notified of
the Public Hearing.
BACKGROUND
On April 8, 2010, the Little Rock Planning Commission
approved a preliminary plat titled The Orchards at
Mabelvale Preliminary Plat (S-1649). The plat contained
20 acres and was approved to allow the creation of four (4)
lots. Ordinance No. 20,261 adopted by the Little Rock
Board of Directors on May 4, 2010, rezoned Lot 3 of the
Orchards at Mabelvale from C-3, General Commercial
District to PD-R. The site containing 2.705 acres and was
approved for 48 units of elderly housing age restricted to 55
years plus. The building was approved with three (3)
stories and a maximum height of 51 feet. A gated entrance
from Richsmith Lane was approved with the site plan.
The current rezoning request is to rezone Lot 4 of the
Orchards at Mabelvale from C-3, General Commercial
District to PD-R. The site contains 2.36 acres. As with the
previous approval the rezoning request is to allow the
development of this area with 48 units of elderly housing in
one building. The building is proposed with three (3)
stories with a maximum height of 51 feet. There are 16
residential units per floor. The development is proposed
with a shared gated entrance with Lot 3 from Richsmith
Lane. Richsmith Lane is a new public street located along
the southern boundary.

PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described
property be changed from C-3 to PD-R:
