8 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
9 THE CITY OF LITTLE ROCK, ARKANSAS:
10 Section 1. That the zone classification of the following property be and is hereby changed as
11 indicated:
12 Z-8493 — Described as Lot 1, Victory Addition to the City of Little Rock,
13 Pulaski. County, Arkansas: From "R-2"Single Family District and "I-2"
14 Light Industrial District to "C-3" General Commercial District (with
15 condition) (6510 Woodson Road).
16 Section 2. That the zoning of the above described property is subject to the following
17 condition which was proposed by the applicant for the property described in Section 1 of this
18 ordinance and which shall be covenants running with the land to bind subsequent grantees of the
19 property:

34 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
35 declaration or adjudication shall not affect the remaining portions of the ordinance which shall
36 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional
37 were not originally a part of the ordinance.

The owner of the 3.70 acre property located at 6510
Woodson Road is requesting that the zoning be reclassified
from R-2 and I-2 to C-3.
None
Approval of the Ordinance.
The Planning Commission reviewed this issue at its
September 17, 2009 meeting. There were no objectors
present.
All owners of property located within 200 feet of the site,
all residents within 300 feet who could be identified, and
the Wakefield and SWLR United for Progress
Neighborhood Associations were notified of the rezoning
request.
The Commission voted, as part of the Consent Agenda, to
recommend approval of the rezoning. The vote was
10 ayes, 0 nays and 1 absent.
BACKGROUND
BSILR, LLC, owner of the 3.70 acre property located at
6510 Woodson Road, is requesting to rezone the property
from "R-2" Single Family District and "I-2" Light
Industrial District to "C-3" General Commercial District
(with condition). The rezoning is proposed in order to
utilize the existing commercial structures for wire cable
and sling storage, with light assembly and shipping. A
conditional use permit to allow this use was approved by
the Planning Commission on September 17, 2009. The
applicant has offered a condition -for the proposed C-3
zoning to eliminate the following uses as permitted uses
for the property:
• bar, lounge or tavern
• establishment for the care of alcoholic, narcotic or
psychiatric patients
• pawn shop
• private club with dining or bar service
+ special event center
Currently there is a one-story brick commercial building
within the east half of the property, including a covered,
unenclosed area. There is also a small metal building on
the site. Access drives from Woodson Road serve the
property. There is an area of paved parking on the south
side of the buildings. The west portion of the property is
undeveloped.
There is a mixture of uses and zoning in this immediate
area. A school and animal clinic are located immediately
to the north. Mixed commercial/industrial uses are located
further north across West 651h Street. Single family and
two-family residences are located to the south. Mixed
commercial/industrial uses are located to the west and east
(across Woodson Road).
The City's Future Land Use Plan designates this property
as Commercial. The requested C-3 (with condition)
zoning does not require a change to the future plan.
Staff is supportive of the requested rezoning to C-3 (with
condition). Staff views the request as reasonable. The
property has a history of being utilized as a Southwestern
Bell Telephone maintenance facility, including outdoor

storage of materials. The rezoning of this property to C-3
(with condition) will be consistent with the other
commercial and light industrial zonings in this area along
the West 65t' Street corridor. Staff believes use of this
property as an enclosed commercial use will have no
adverse impact on the adjacent properties or the general
area.

1. Dedication of additional right-of-way is required for West 65th Street and Woodson Road. The
Master Street Plan Standard is 45 feet and 30 feet respectively from the centerline.
2. Please use the enclosed quitclaim deed to dedicate the necessary right-of-way. The completed and
signed deed needs to be returned to the Planning Office by noon on October 12, 2009. If the
dedication instrument is not received by the specified date, the item will be removed from the
Board's October 20, 2009 agenda.

INSTRUCTIONS FOR MAKING APPLICATION FOR REZONING
1. The applicant (owner or authorized agent) shall appear at the Department of Planning and Development,
723 West Markham, and complete the required application forms.
2. The applicant shall submit as part of the application six 6 copies of a recent survey certified by a
registered land surveyor.
3. A filing fee as prescribed by ordinance shall be paid to a City Collector's Office immediately after
receipt and acceptance of the application.
4, All applicants must submit a copy of the bill of assurance for the subdivision within which the subject
property is located. Copies of bills of assurance are available at the Pulaski County Circuit Clerk's
office located at 401 West Markham Street. If the property is not located in a subdivision with a bill of
assurance, the applicant must submit a statement to that effect in conjunction with submission of the
application.
5, Prior to acceptance of the petition, the owner is required to sign a statement dealing with the dedication
of required rights -of -way on abutting streets. The applicant will be provided a form for this purpose
which shall be completed by the owner indicating his position on dedication. The owner will be
required at his/her expense to provide the proper instrument for such dedication. The instrument, in
blank form for use as a guide, may be obtained from the Planning staff.
6. After properly filing the application and paying the fee, the applicant shall give notice as required below.
The cost of these notices shall be borne by the applicant. (Note: This notice is not a petition of
approval or disapproval.)
Before the Planning Commission shall consider a request for rezoning of any property, the petitioner for
such action shall first give not less than fifteen (15) days written notice of the time, place and the date
of public hearing thereon to all of the record owners of property situated within 200 feet thereof as
certified by a licensed abstractor. Said notice shall be sent by certified or registered mail to the last
known address of such record owner(s) and the petitioner shall execute and file with the Planning staff
an affidavit showing compliance herewith attaching as exhibits to said affidavit official evidence that
said notices have been so mailed.
7.. The required affidavit and supporting exhibits (mailing receipts, certified abstract list of property owners
of record and copy of notice) shall be filed with the Department of Planning and Development no later
than six (6) calendar days prior to the meeting date.
8. The applicant shall post the sign furnished at the time of filing at the front of the property so that it can
be seen from the street at least thirty (30) days prior to the meeting. If for any reason the sign should be

We are requesting a C-3 zoning from the existing I-2 and R-2 zoning. We are also
requesting a Conditional Use Permit allowing office/warehouse.
This property is proposed to be the new location of the Arkansas Sling Company
currently located on Byrd Street in downtown Little Rock. The applicant is proposing to
construct walls around the existing steel canopy located on the Woodson Road side of the
property. The property will be used primarily as an office/warehouse with light
