BY GERARD MATTHEWS ■ On the surface, the dispute over a rooftop bar in Hillcrest i; about noise. It's about parkin, issues. It's about the future use of the building itself. Beneath that, though, the locals are debat- ing something much larger: the future of their neighborhood. Joe St. Ana, owner of Crush Wine Bar in the River Market, plans to open a new wine, martini and tapas bar at 2611 Kavamugh Blvd., in the space for"Waly occupied by Lemon creperie. That's an idea that most Hillcrest residents seem to be comfortable with. However, plans for the res- taurant, called Diversion, include a rooftop dining area, and that has some neighbors concerned. Robin Borne is an architect whose office is on the second floor of the building adjacent to Diversion's location, which also includes Femeau restaurant. He served as a board member of the Hill - crest Residents Association for seven years and says it's always been important to him that the neighborhood maintain a balance between residential and com- mercial interests. "Nobody's saying, 'You can't have a restaurant -'All they are saying is don't put the deck on the roof," Home says. "And I don't wish. the owners any ill will at till. I don't like seeing empty buildings on Kavanaugh. It makes the neighborhood more viable to have a strong commercial presence. All I'm looking for is balance:' The reaction from the local residents is something St. Ana says he and co-owner Jay Patel have considered. "We don't try to ruffle anybody's Feathers:' St. Ana says. "People are very happy With theirpropetty and you have to listen to them, The rooftop idea is a con. cept that we'd like to do. Nothing is set in stone because we want to make every- body happy." Debra Keddie and her husband, Michael, live 53 feet away from the roof- top St. Ana wants to convert into a din- ing area. An alleyway behind their house leads from their back fence directly to the rooftop. Kcddie has started a petition drive against Diversion's rezoning request. The Uttle Rock Planning Commission will take up the request Oct. I5. T'hGplanning staff is recommending against the rezon- ing, but the cntnmission does not always fallow the sta@''s rerntmrtendations. If the commission approves the rezoning, it will go to the city Board of Directors for final approval. If it denies it, St. Ana can appeal directly to the city board. Not everyone opposes the idea. A lively discussion is taking place online, in the Hillcrest Neighborhood Association's Yahoo group. HNA board member Scott Smith said in a recent post that he was in the "support column." "Regarding the noise;' he wrote, "there are businesses on either side, Sev- eral businesses stay open as late as the one that is proposed, and some evert have out- door dining. There will be no live bands, amplified music, nor anything else (other than people) that create noise. The applicant's proposal does not meet with the intent outlined in the Little Rock's Code of ordinances for commercial districts, would aggravate an overburdened parking condition and create a nuisance late into the evening six nights a week (10:00 pm on Sundays). In addition, I do not believe that this applicant has given his own proposal serious consideration and has only given lip service to the issues that it raises, with no concrete or contractual solution. The following is a point by point list of objections to the application: The applicant is requesting rezoning the property to PCD (Commercial Mixed Use), but proposes no residential component. What is the point of having the property re -zoned? The applicant wishes to provide seating for 49 patrons on the roof (limited presumably by fire code, I have little faith that number will be observed after the doors are opened). Little Rock's code of ordinances limits outdoor seating capacity to 50% of the indoor capacity (Sec. 36-298.8.b). The proprietor to be has said the number to be seated inside would be less than 50, which would limit "outdoor dining" capacity to less than 25. Additionally, the ordinances restrict outdoor dining from being in the public right of way (the alley) or in close proximity to residences, both of which are proposed by this application. The nearest residential structure is about 25 feet from the south west corner of the building in question. The applicant proposes handicap access to the rooftop via a ramp and locked exit door from the alley, accessed from Woodlawn (a block behind the front entry). This proposal doesn't meet the ADA's intent for equal access (a handicapped patron who wanted to visit the rooftop would have to leave the establishment, travel down Kavanaugh for half a block, turn left on Ash street and continue down Ash for one block, turn left on Ash and travel for half a block, turn into a narrow alley, and travel almost a block back to the rear half of the building). Nor does this proposal take into account the grade change outside of the property. The existing parapet wall is approximately 18" above the adjacent grade level. Is the applicant proposing to build a ramp in the easement or lower the wall to grade? Either scenario presents a problem. Access in this location will open the door for increased public presence in an alley behind private residences. The applicant offers that a wood fence at the back of the property will assist as a sound barrier. This is both an acknowledgement that there will be a sound problem and a flawed attempt a mitigating the problem. Since when did a fence ever prevent noise from escaping? Can you hear the neighborhood kids on the other side of the fence? Now imagine there are fifty of them... and they've been drinking. At the recent Hillcrest Residents Association meeting, an acoustician testified to how ineffectual a fence would be at containing the noise created by 49 individuals conversing on the roof. The applicant has alluded to other sound absorbing materials in their application, but has not described anything definite. Each speaker location shall be designed to provide for a solid wall at Ieast six (6) feet in height and twenty (20) feet in len;th along the opposite lane line. This wall shall be constructed of masonry or wood with a textured finish to diminish sound deflection. (2) Dumpsters and trash containment areas shall not be located within the front yard setback area or street side or exterior side yard setback area. I have been a resident of Little Rock for about five years after residing in Dallas, TX for fifteen years. There were several rooftop establishments in Dallas. It was nice on a pretty evening to enjoy the outdoors and the scenery while having dinner or drinks with friends. I've often remarked that it would be wonderful to have something in Little Rock that would provide the rooftop experience. There are other establishments in the Hillcrest area that have outdoor areas so I'm not quite sure why there's opposition to Diversion. I would think that the city of Little Rock would welcome a new establishment with a novel idea to add to the city's many wonderful entertainment and dining establishments. Anyone living near the other Hillcrest outdoor dining venues will tell you they are a noisy nuisance. Instead of adding to the chorus, we should enforce code on the current offenders. The applicant talks about nature sounds, water features, and exotic flowers. I can only assume this is intended to pull the wool. The atmosphere of a drinking establishment is inherently noisy no matter how you sugarcoat it. A few weeks ago I had to interrupt one of our other upscale bar's patrons from urinating on my lawn. It was 11.-00 pm. Furthermore, with the success rate of bars and restaurants, I am not only concerned about the nature of this establishment, but that of the one that succeeds it, and the one that follows after. At any rate, the atmosphere of the bar is not something that can be regulated. If the quiet rooftop doesn't make money, maybe a Mardi-gras theme will do better. The applicant proposes off site garbage collection, but presents no contractual relationship with the owner of the proposed trash container. Applicant states that is an on site dumpster is required, it is requested that the dumpster be placed in the alley. While the city ordinances do require trash containers, it restricts them being placed within setbacks, let alone off the property. The applicant intends to provide food service and drinks for nearly 100 patrons. Garbage storage and collection will be considerable. Incidentally, the public garbage can on the street was often overflowing while the previous establishment was in business. Applicant states that the outdoor seating creates a parking requirement that is greater than the property can meet. I would argue that the property is currently not meeting their parking requirement, even without a tenant in one half of the building. Parking this area is already problematic which, contrary to what you will hear from the applicant, is a reason for more restraint and adherence to the rules that are already in place. The applicant has supposedly struck a deal with the adjacent property owner to use the adjacent lot for valet parking. This parking is currently being used by his tenants (one being a dry cleaners that is open from 7am to 7pm). Are his tenants aware? Is there a binding contractual agreement? What happens with a transition of ownership or a soured relationship between the two parties? If it is to be assumed this parking will only be utilized outside of the cleaner's hours of operation, it means that the applicant would only meet their parking requirement 25% of the time. I have also recently been made aware that the applicant is counting street frontage in front of adjacent business and on a street where parking is prohibited to try and reach his requirement. The hillcrest design overlay allows 1 parking spot for every 10 feet of street frontage, but I didn't read anything about being able to trade. Something else not specifically mentioned by the application but discussed in meetings with the applicant, is that the applicant assumes that if the alley is abandoned, ownership of the land will be split between the adjacent property owners. This seems highly peculiar to me. If this is the way it works, then I'd like to propose abandoning the section of Ash Street in front of my house.. but I'll do that under a separate cover. In addition, I'd like to make it know that the HRA (Hillcrest Residents Association) in submitting a position of "not opposed" has done a disservice to its members. They have not represented the interests of the residents in this matter. With the HRA's reputation for meddling, I was surprised that they would allow such an enterprise. We looked in several neighborhoods throughout Little Rock before finding one that had everything we were looking for. We decided to buy in Hillcrest because- of the character and charm that is on every street, as well as all of the sources of wonderful food and entertainment within walking distance from our home. It has come to our attention that there is some opposition to the development of a new bar, Diversion, on Kavanaugh. This opposition has inspired me to write a letter in support of the development of Diversion, along with support for the roof top deck currently in the plans. I have personally seen the plans for the roof top deck, and I believe that the developers have gone above and beyond to ensure that any noise that might occur on the deck would be controlled and not a hindrance to surrounding neighbors. For instance, the hours the deck would be open seems to have taken into consideration the needs of the residents around this commercial strip, closing considerably earlier than many other bars around the same area. Also, the sound barrier walls that are planned for the deck would definitely aid in keeping down any noise that might occur -during the tunes the deck would be open. In addition it seems important to note that there are other bars just a few doors down from this location that have decks, as well as live music many nights of the week. From what I understand, Diversion does not plan on having live music; especially not live music on the roof top deck. I believe the opposition to the development of Diversion's roof deck has been told some information that is not true, and it would only be fair for the residents around this commercial area to have the chance to hear the truth before opposing this addition to our neighborhood. I have no doubt that when the correct information is shared, there will be little to no opposition to this new business. Diversion is proposing to bring something different to the area, which in turn will bring more business and revenue to our neighborhood. It would also add to our property value and further enhance at least one of the things that we have all grown to love about Hillcrest, the opportunity to socialize with neighbors in an upscale setting without having to drive for miles. While we are not against business, we are advocating the preservation of our property values and our residential living environment. We have enclosed three photographs of the areas in question. As you can see, the proposed rooftop bar would be in very close proximity to our properties. We have major concerns regarding noise, increased pedestrian and vehicular traffic in our alley (by embibing patrons), odor and rats from a possible dumpster and a proposed Port-O-Potty (a real touch of class), litter, large wafts of cigarette smoke, and additional parking problems. Furthermore, we are opposed to the right-of-way abandon- ment of the public alley for Mr. Corder's use in this endeavor. The proposed handicapped parking place at the end of the alley would pose some safety issues as well. In order to vacate the premises, the handicapped driver would have to back down the alley, possibly after dark, and after embibing, and avoid hitting the following obstacles: cars, utility poles, carport supports, rock walls, trash cans, fences, and possible traffic approaching from a blind corner at the Ice House parking lot. Additionally, there exists the possibility of the handicapped driver driving through the barricade and plummeting over the edge and down fifteen feet to the lower part of the alley. After reviewing Mr. Corder's application file, we know that a few merchants have endorsed his pro- spective plans. These same merchants, as well as Mr. Corder, have the opportunity to go home at night without having to deal with an outdoor drinking establishment and all the problems that go along with that awaiting them adjacent to their own backyard. We, as residents, would like to be afforded that same opportunity. Parkins;: The application is for an additional 49(I) customers to be accommodated, in addition to the 46 that previous businesses have catered. Hillcrest can only absorb a finite amount of resident/commercial parking and the zoning variation request will assuredly tip this balance markedly out of kilter with almost 100 potential customers needing parking not to mention Diversion's probable staff of at least 5. Reportedly the applicant is being credited for 5 parking spaces based upon the property's frontage but this clearly bears no relationship to the average size of today's ubiquitous SUV as the embedded photograph clearly demonstrates. Further, he reports plans to have valet parking at a nearby dry cleaner's property, which is already being used by people going to local businesses and restaurants. Valet parking has existed for some time at Cafe So, sadly, and the spread of the concept to other parts of our Hillcrest neighborhood is to be deplored. Noise Pollution: The noise levels of outdoor customer areas at existing restaurants such as Ciao Baci and Furneau have already had a negative impact on the quality of Life enjoyed by residents in the immediate vicinity of these establishments and the addition of an open air rooftop drinking establishment replete with up to 49 patrons can only further this negative impact. The plans for noise abatement, discussed at the HRA meeting by the applicant, are ludicrous and bear no resemblance to the physics of sound transmission. In effect, Kavanaugh Blvd and the residences facing Diversions will be subjected to a compressed loudspeaker effect directed right at them, while the bass tones will rise above the planned walls and affect the area adjacent to Diversions. Customers vying to be heard as the several rooftop A/C units operate will tend to be loud. A colleague residing near Furneau's reports she has had to switch her bedroom and dining room because of being awakened repeatedly by noise from restaurant customers, a neighbor near Ciao Baci's reports similar sleep disruptions from noisy customers. Outdoor dining facilities and late night drinkers are simply not the best combination and perhaps there is merit in having curfews for such locations to prevent neighbors from warrantless disturbance? Charm: We can speak to this directly from experience. When we bought our Liss ofuaintness and east end of Allsopp Park, along home 16 years ago we enjoyed a lovely view from our deck About 2 years ago theId quaint single story Kavanaugh, which we enjoyed with the changing seasons. home that occupied the south west corner lot on Rose/Kavanaugh was demolished and an ugly 2 story McUuplex constructed which completely obliterates our former pleasant view as the embedded picture shows. Since its completion we have seen an endless procession of temporary dwellers, alternating with periods of emptiness, as the owner attempts to sell half a building to 2 owners atprices ricshat make Hillrest no sense given the location. A poorly thought out business plan by a speculator a couple homes forever diminished - one permanently and completely. Replicate this enough times and we'll end up with McHillcrest; and the signage announcing "Historic Hillcrest" will ironically be correct. Opening rooftops to commercial enterprises within Hillcrest will certainly go from this one drip to a flood if you open the option. Please - preserve Hillcrest. Diminishin uali of Life: The background noise of daily life generated by businesses such as bar/restaurants can be impervious to the passing stranger, but, we invite you to walk the vicinities of Furneau and Ciao Baci on a Sunday morning and observe the beer bottles, wine glasses, discarded food containers scattered here and there. Other residents have reported people urinating in their yards and on one occasion a number of wheeled trashcans along Woodlawn were turned over. In recent months we have noticed a marked increase in the amount of graffiti throughout Hillcrest which we see as evidence of the decline of the perception of Hillcrest as a vital family neighborhood into just another commercial district.
