AN ORDINANCE TO REPEAL ORDINANCE NO. 20,112 (JUNE 2, 2009)
TITLED BLUE WAVE EXPRESS CARWASH SHORT -FORM PD-C AND
REVOKING A PLANNED ZONING DISTRICT; AND FOR OTHER
PURPOSES.
WHEREAS, Ordinance No. 20,112 was passed on June 2, 2009, establishing a planned zoning
district titled Blue Wave Express Carwash Short -Form PD-C (Z-8446-A), located at 801 East 6`' Street;
and
WHEREAS, the Carwash approved for Blue Wave Express Carwash Short -Form
PD-C (Z-8446-A), located at 801 East 6" Street, is no longer a viable project and the owner of the
subject property has requested the repeal of the PZD, Planned Zoning Development, ordinance and
restoration of the zoning classification as previously existed.
WHEREAS, the Little Rock Planning Commission reviewed the request for revocation for
Blue Wave Express Carwash Short -Form PD-C (Z-8446-A) at their May 15, 2014, public hearing and
voted 9 ayes, 0 nays and 2 absent to forward the revocation request to the Little Rock Board of Directors
for final action.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS.
SECTION 1. That Ordinance No. 20,112 is hereby repealed, removing from the Official
Zoning Map the classification PD-C, Planned Development - Commercial.
SECTION 2. That the underlying UU, Urban Use, zoning classification is restored to the
property described as: Recorded Legal Description:
Part of Lots 1, 2 and all of 3 in the Fractional Block 17 of Rectortown
Addition, to the City of Little Rock, in Pulaski County, Arkansas, and being
shown in Deed Record Book 13, Page 539, records of Pulaski County,
Arkansas, more particularly described as follows: Commencing at the
northwest corner of said Fractional Block 17, said point being at the southeast
intersection of Rector Street and East Sixth Street; thence south 88 degrees
35 minutes east along the north line of said Fractional Block 17 for a distance
of 45.30 feet to a point on the easterly right-of-way line of the proposed Little
Rock Expressway, which is the point f -

line of the proposed Little Rock Expressway, which is the point of beginning;
thence continue south 88 degrees 46 minutes east 72.71 feet to the east line of
Lot 4; thence north along the east line of said Lot 4 for 75.26 feet to the
northeast corner of said Lot 4; thence north 88 degrees 35 minutes west along
the north line of Fractional Block 4 for 89.92 feet to the east right-of-way line
of the proposed Little Rock Expressway; thence south 12 degrees 34 minutes
east along said right-of-way line 77.80 feet to the point of beginning.
SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of
Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the
respects necessary to affect and designate the change provided for in Sections I and 2 hereof.
SECTION 4. Severability. In the event any title, section, paragraph, item, sentence, clause,
phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain
in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not
originally a part of the ordinance.
SECTION 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
inconsistency.

The request is a revocation of the existing PD-C zoning and
the restoration of the previously held UU, Urban Use
Zoning District designation.

Staff recommends approval of the requested PD-C
Revocation. The Planning Commission voted to
recommend approval of the PD-C Revocation zoning by a
vote of 9 ayes, 0 noes and 2 absent.
The Planning Commission reviewed the proposed PD-C
Revocation request at its May 15, 2014, meeting. There
were no registered objectors present. All property owners
located within 200-feet of the site along with the Hanger
Hill Neighborhood Association were notified of the Public
Hearing.
BACKGROUND
Ordinance No. 20,112 adopted by the Little Rock Board of
Directors on June 2, 2009, rezoned the site from UU, Urban
Use District to PD-C. The applicant proposed the rezoning
to allow Blue Wave Express Carwash to locate on the
property. Blue Wave Express Carwash was proposed as a
drive -through carwash facility and detail shop. The UU,
Urban Use District does not allow outdoor activities to
occur on the site thus necessitating the rezoning request to a
PD-C. This development did not occur.
Per Section 36-454(d) The owner of an approved PD or
PUD may, for cause, request repeal of the ordinance
establishing the development when it has been determined
that the development will not occur. A written request may
be filed with the City staff at any time up to three (3) years
after the date of adoption of the ordinance creating the PUD
or PD. The request shall set forth the cause of the repeal.
According to the ordinance, the Planning Commission
recommendation on the repeal request shall be forwarded to
the Board of Directors for their consideration. The board of
directors may grant or deny the request or return the request
to the planning commission for further study. If the request
is approved, an ordinance shall be adopted repealing the
PUD or PD.
The owner has stated the development will not occur as
planned. The owner is requesting the PD-C zoning be
revoked and the UU, Urban Use Zoning District zoning be
restored.
