The request also includes the rezoning of an existing R-3, Single-family zoned parking lot located immediately west of the surgery center. None. Staff recommends approval of the requested PD-O zoning. The Planning Commission voted to recommend approval of the requested zoning by a vote of 9 ayes, 0 noes and 2 absent. The Planning Commission reviewed the proposed PD-O request at its April 30, 2009, meeting. There were no registered objectors present. The Hillcrest Residents Neighborhood Association, all residents who could be identified located within 300 feet of the site and all property owners located within 200-feet of the site were notified of the Public Hearing. BACKGROUND The property is located near the intersection of C Street and University Avenue. The property currently contains two occupied single-family residences. The developers are seeking a rezoning of the property to allow the removal of the homes and the construction of a new 8,780 square foot survey center. The center will contain four (4) operating rooms and ten (10) prep and recovery rooms. Two (2) doctors will operate from the facility. The hours of operation are from 7 am to 5 pm daily. The proposal includes an existing parking lot located immediately west of this property. The doctors currently own an interest in this parking lot and intend to utilize this parking area as a portion of the required parking for the surgery center. The parking lot contains 35 parking spaces. A parking lot located to the south of the site is proposed to provide parking for staff. The off -site parking provided is 40 spaces The property is located within the Mid -town Design Overlay District. The ordinance has various development standards related to building setbacks, heights, construction materials and building appearances. The fagade treatment for new construction requires a minimum of 60 percent of the ground floor level facing internal pedestrian public circulation areas or streets be glass -windows, entry features or displays. The applicant has indicated 40 percent of the front of the building will be glassed. The intent of the developer is to construct the surgery center with a residential flair. According to the developers to meet this goal it is difficult to provide 60 percent of the fagade with glass features. The primary fagade of the building will be oriented parallel to the street. The building is proposed as a single story building. No wall projections or recesses are proposed on the structure along the sides or rear wall. The front of the building will have a projection extending to a covered canopy to be used for patient drop- off and pick-up. The sides of the building are proposed to have 108 linear feet. The building is not proposed with breaks in the building to visually break the mass since the structure is so close to the 100-foot standard established by the ordinance. The roof is proposed with a pitched roof and architectural shingles, once again to provide a residential character to the structures. 2 BACKGROUND CONTINUED The developer has indicated a commitment to reduce the water run-off on the properties located to the north by developing the site in such a manner that all drainage from the proposed building and circular driveway are directed to C Street. The developers have also agreed the flume at the north end of the existing parking lot will be re -directed to the east and into a vegetated swale running east -west along the north side of the proposed building. At the time of development the developer will supply a new culvert to replace the existing damaged culvert located along C Street. The City will install the culvert with City work forces and equipment. When construction is ready to begin, the developer will request the City clean the existing ditches along C Street and Pierce Street. " Mrs. Wahlgreen, my neighbor who has lived in the same house for over 55 years, says she has never seen the water problems as terrible as they have been since the parking lot has been built. The water outlet, that is directed towards Mrs. Wahlgreen's and my back yards, also flows directly into her garden. All the auto pollutants (oil, gas, antifreeze, dirt, grime) washes directly into our yards. There has to be a way for the City to help us. I have owned my property for six years. Until the parking lot, there has never been a sheet of water running across the rear yard and abruptly hitting any structure in its way. Opposite side of the carport and between the house. We are asking that the proposed PDO include all the properties owned by the Doctors office and a true planned development be reviewed. Segmenting the development into separate projects is skirting the City's requirements and regulations. When I have contacted the owners about the problem I have been told, "We have met the requirements of the City," and "It is not our problem, the City approved it," and finally "I don't care." They are using the rules of the City and passing blame onto the City. We are asking for relief from the stormwater that is aimed directly onto our properties. The City needs to protect the homeowners from commercial. When I purchased the property all the 4/9/2009 Page 3 of 3 surrounding lots were residential. Two houses have since been removed and the applicant is asking for two more to be removed and a rezoning. If the applicant is not willing to be a "good neighbor" and do what is right for the individual homeowner, then the City needs to deny this request and support the homeowner. I have met with Hillcrest Residents Association (HRA) on Monday April 13th, where the developer and engineer made a presentation to the HRA. At that time, I also presented my concerns and the HRA agreed with my concerns and also had some other issues. After 1.5 hours we were not able to solve everything and decided to meet again on April 20th. Between those two HRA meeting I met with the developer's engineer (Joe White of White- Daters) and we have walked and driven the site. He has also meet with Mr. Floriani of Public Works and they have come up with a solution. Mr. White presented me with the solution and I set up a meeting for Mr. White to met Mrs. Wahlgreen and her son. We met at Mrs. Wahlgreen's house and Mr. White made his presentation to us. Myself, Mrs. Wahlgreen and Mike Wahlgreen all agreed that the solution met all of our needs and did not just move the problem down to somebody else. Yesterday (Monday April 20th), the immediate neighbors met with HRA, the developer and Mr. White. Mr. White presented the revised plan that resolved the flooding issues and also answered the questions the HRA had on the design of the building. The HRA voted unanimously to support the project with all the revisions. Tuesday evening I met with Tim Lawrenz, another immediate neighbor, and showed the drawings and updated him on the meetings. He is also in support and will attend the Planning Commission meeting on April 30th with myself, and the Wahlgreens. On April 20, 2009, the HRA Board voted to support the request by University Properties to rezone two existing residential properties on "C" Street to the Planned Development Office to allow the construction of a surgery center. The HRA Board's support is conditioned upon the following actions that University Properties has agreed to implement to assuage drainage concerns related to this project and the parking lot to the east. University Properties has agreed to drain and divert water off the roof (sloped and residential in design) of the new surgery center and the front portion of the lot and direct it east to C Street where it will flow into an existing open ditch, then north on Pierce to an existing storm water pipe at the exiting condo project at the corner of Lee and Pierce.
