3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH WILLARD LEE LOOPER, D/B/A CENTRAL
5 ARKANSAS EXCAVATION, INC., IN AN AMOUNT NOT TO EXCEED
6 TWO HUNDRED EIGHTY-SIX THOUSAND DOLLARS ($286,000.00),
7 PLUS APPLICABLE TAXES AND FEES, FOR THE PURCHASE OF
8 INTERMEDIATE COVER TOP SOIL FOR THE CITY OF LITTLE
9 ROCK'S SANITARY LANDFILL; AND FOR OTHER PURPOSES.

11 WHEREAS,the Public Works Department Solid Waste Services Division utilizes Intermediate Cover
12 Top Soil for the Class I and Class IV Cells of the City of Little Rock's Sanitary Landfill; and,
13 WHEREAS, in response to a requirement made by the Arkansas Department of Environmental
14 Quality, the need exists to purchase additional Intermediate Cover Top Soil for the Class I and Class IV
15 Cells of the City's Sanitary Landfill; and,
16 WHEREAS,through the process of Competitive Requirement Exemption,as authorized by the City's
17 Procurement Division,Willard Lee Looper,d/b/a Central Arkansas Excavation, Inc.,was chosen to provide
18 Intermediate Cover Top Soil, in an amount not to exceed Two Hundred Eighty-Six Thousand Dollars
19 ($286,000.00), plus applicable taxes and fees.
20 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. The Board of Directors hereby authorizes the City Manager to enter into a contract with
23 Willard Lee Looper, d/b/a Central Arkansas Excavation, Inc., in an amount not to exceed Two Hundred
24 Eighty-Six Thousand Dollars($286,000.00),plus applicable taxes and fees,for the purchase of Intermediate
25 Cover Top Soil for the Class I and Class IV Cells of the City's Sanitary Landfill.
26 Section 2. Funds for this purchase are allocated in the Solid Waste Enterprise Fund, Account No.
27 603120.
28 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
29 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
30 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
31 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
32 resolution.
33 Section 4. Repealer. All laws,ordinances,resolutions, or parts of the same,that are inconsistent with
34 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
