3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REV. CODE § 28-25
4 (1988), TO ESTABLISH THE LANDFILL FEES FOR THE CITY OF
5 LITTLE ROCK SANITARY LANDFILL; TO DECLARE AN
6 EMERGENCY; AND FOR OTHER PURPOSES.

8 WHEREAS, the City of Little Rock, Arkansas, operates a Sanitary Landfill, which accepts waste
9 products from the City and other areas; and,
10 WHEREAS, Little Rock, Ark., Ordinance No. 21,780 (September 17, 2019), amended Little Rock,
11 Ark., Rev. Code § 28-1 and § 28-28, to address issues as to solid waste, and also to establish certain fees
12 and costs; and,
13 WHEREAS, Little Rock, Ark., Ordinance No. 21,823 (December 17, 2019), amended Little Rock,
14 Ark., Rev. Code § 28-25 to increase Tipping Fees; and,
15 WHEREAS, it is important to re-evaluate and have appropriate Landfill Fees in place, and to collect
16 these fees starting March 1,2024.
17 NOW,THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
18 OF LITTLE ROCK,ARKANSAS:
19 Section 1. Little Rock, Ark., Rev. Code § 28-25 is hereby amended to read as follows:
20 (a) The following Tipping Fees shall be charged for disposal of approved solid waste at the City
21 Landfill facility:
22 (1) Class I Waste: Each ton of waste at a rate of Fifty-Five Dollars ($55.00), with a
23 minimum charge of Forty Dollars($40.00) per load.
24 (2) Class IV Waste: Each ton of waste at a rate of Fifty-Five Dollars ($55.00), with a
25 minimum charge of Forty Dollars($40.00) per load.
26 (3) Yard Waste: Each ton of waste at a rate of Fifty Dollars ($50.00), with a minimum
27 charge of Forty Dollars($40.00) per load.
28 (4) Asbestos: Each ton of waste at a rate of One Hundred Fifty-Eight Dollars ($158.00),
29 with a minimum charge of One Hundred Dollars($100.00) per load.
30 (b) The Mayor is hereby authorized to negotiate volume discount agreements with City Landfill
31 customers; however, all volume discount agreements and amounts shall be approved in
32 advance by the Board of Directors.

] Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
2 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
3 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
4 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
5 ordinance.
6 Section 3. Repealer. All laws,ordinances,resolutions,or parts of the same,that are inconsistent with
7 the provisions of this ordinance, including, but not limited to, Little Rock, Ark., Ordinance No. 21,780
8 (September 17, 2019) and Little Rock, Ark., Ordinance No. 21,823 (December 17, 2019), are hereby
9 repealed to the extent of such inconsistency.
10 Section 4. Emergency Clause. In order to meet requirement under State and Federal Regulations,
11 to assure that payment of all financial obligations necessary to fulfill those requirements and that the City's
12 ability to provide such service to the citizens is essential to the public health, safety, and welfare in the
13 Solid Waste Ordinance approved in Little Rock, Ark, Ordinance No. 21,780(September 17, 2019), to meet
14 the environmental and public safety requirements of the City;an emergency is; therefore, declared to exist,
15 and this ordinance shall be in full force and effect from and after March 1, 2024.
