AN ORDINANCE TO REPEAL ORDINANCE NO. 19,93.1 TITLED TRICE
4 SURGERY CENTER SHORT -FORM POD AND TO REVOKE A
5 PLANNED ZONING DISTRICT LOCATED ON THE SOUTHEAST
6 CORNER OF KANIS ROAD AND LABELLE DRIVE (Z-8296-A), TO
7 DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES.

9 WHEREAS, Ordinance No. 19,931 was passed on March 18, 2008, establishing a planned zoning
10 district titled Trice Surgery Center Short -Form POD; and
11 WHEREAS, the time for approval of the POD has expired and the owner of the subject property has
12 agreed to the repeal of the "PZD" ordinance and restoration of the zoning classification as previously
13 existed;
14 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
15 OF LITTLE ROCK, ARKANSAS:
16 Section 1. That Ordinance Numbers 19,931 is hereby repealed, removing from the official zoning
17 map the classification POD Planned Office Development District.
18 Section 2. That the property described as: Part of the NE '/4 of Section 11, T-1-N, R-13-W, Little
19 Rock, Pulaski County, Arkansas, more particularly described as follows:
20 Commencing at the centerline of Section 11, T-1-N, R-13-W, a found one (I) -pipe;
21 thence S88°03'35"E 1026.19 feet to a set %2-inch rebar; thence NO1°41'47"E 472.71 feet
22 to the point of beginning a set ''/2" rebar; thence NOl °41'47"E 225.08 feet to a set '/2-inch
23 rebar on the south right-of-way of Kanis Road; thence with said right-of-way
24 S88058'33"W 270.35 feet to a set 1/2-inch rebar; thence along a curve to the left 137.91
25 feet having a radius of 200.0 feet and having a chord bearing and distance of
26 S69013'21"W 135.19 feet to a set'/2-inch rebar; thence S49°28'08"W 67.26 feet to a set
27 '/2-inch rebar; thence along a north tangent curve to the right 123.62 feet, having a radius
28 of 305.0 feet and having a chord bearing and distance of S20°01'46"E 122.78 feet to a set
29 %2-inch rebar, thence S88°06'59"E 399.33 feet to the point of beginning; containing 1.99
30 acres, more or less, be rezoned to R-2, Single -Family.
31 Section 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
32 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
33 necessary to affect and designate the change provided for in Sections 1 and 2 hereof.

1 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
2 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
3 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
4 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
5 ordinance.
6 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
7 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
8 Section 6. It is hereby determined by the Board of Directors of the City of Little Rock that
9 there is immediate need to revoke Trice Surgery Center Short -Form POD (Z-8296-A); an
10 emergency is therefore declared to exist and this ordinance shall be in full force and take effect

The request is a revocation of an expired POD zoning and
the restoration of the previously held R-2, Single-family
zoning.

Staff recommends approval of the requested revocation of
the expired POD zoning. The Planning Commission voted
to recommend approval of the requested revocation of the
expired POD zoning by a vote of 11 ayes, 0 noes and
0 absent.
The Planning Commission reviewed the proposed
revocation request along with a rezoning request for
the Manor Short -form PD-O at its February 16, 2012,
meeting. There were no registered objectors present. The
John Barrow Neighborhood Association and the
Brownwood Terrace Neighborhood Association were
notified of the Public Hearing.
BACKGROUND
The Board of Directors adopted Ordinance No. 19,931 on
March 18, 2008, establishing Trice Surgery Center
Short -form POD. The approval allowed the construction of
a surgery center containing 18,375 square feet located on
1.99 acres. The center was proposed as a single story
building with 70 parking spaces. The hours of operation
approved were from 8 am to 6 pm Monday through Friday.
There was no overnight stay proposed for the center. The
site plan included the placement of a single driveway to
serve the development located on Labelle Drive. The drive
was to be shared between the property and future
development to the south. The underlying zoning for the
property is R-2, Single-family. No development has
occurred.
Per Section 36-458(a) Cause for revocation as enforcement
action. The Planning Commission may recommend to the
Board of Directors that any PUD or PD approval be
revoked and all building permits or certificates of
occupancy be voided under the following circumstances:
(1) The applicant has not submitted a final development
plan to staff. Where a staged development plan is approved
the Board of Directors may revoke the entire preliminary
plan or may revoke only that stage on which a final plan
has not been submitted and approved. (2) Construction has
not commenced within the time allowed. (3) The applicant
has not adhered to the development schedule as stated in
the approved preliminary plan.
In addition, to the revocation for cause, Section 36-454(e)
final development plan states the applicant shall have three
(3) years from the date of passage of the ordinance
approving the preliminary approval to submit the final
development plan. Request for extensions of time shall be
submitted in writing to the Planning Commission, which
may grant one (1) extension of not more than two (2) years.
Failure of the applicant to file a timely extension shall be
cause for revocation of the PUD as provided in the
ordinance.
The revocation hearing was held by the Little Rock
Planning Commission on February 16, 2012. The owner of
the property was present at the Planning Commission
public hearing. The item was approved by the Planning
Commission on the Commission's Consent Agenda.
