That Ordinance Numbers 19,931 is hereby repealed, removing from the official zoning 17 map the classification POD Planned Office Development District. 18 Section 2. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent 7 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. 8 Section 6. It is hereby determined by the Board of Directors of the City of Little Rock that 9 there is immediate need to revoke Trice Surgery Center Short -Form POD (Z-8296-A); an 10 emergency is therefore declared to exist and this ordinance shall be in full force and take effect 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 from and after its passage and approval. Submitted by: Department of Planning and Development SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION Action Required gOrdinance Resolution Approval Information Report Approved By Bruce Moore The request is a revocation of an expired POD zoning and the restoration of the previously held R-2, Single-family zoning. I None. Staff recommends approval of the requested revocation of the expired POD zoning. The Planning Commission voted to recommend approval of the requested revocation of the expired POD zoning by a vote of 11 ayes, 0 noes and 0 absent. The Planning Commission reviewed the proposed revocation request along with a rezoning request for the Manor Short -form PD-O at its February 16, 2012, meeting. There were no registered objectors present. The John Barrow Neighborhood Association and the Brownwood Terrace Neighborhood Association were notified of the Public Hearing. BACKGROUND The Board of Directors adopted Ordinance No. 19,931 on March 18, 2008, establishing Trice Surgery Center Short -form POD. The approval allowed the construction of a surgery center containing 18,375 square feet located on 1.99 acres. The center was proposed as a single story building with 70 parking spaces. The hours of operation approved were from 8 am to 6 pm Monday through Friday. There was no overnight stay proposed for the center. The site plan included the placement of a single driveway to serve the development located on Labelle Drive. The drive was to be shared between the property and future development to the south. The underlying zoning for the property is R-2, Single-family. No development has occurred. Per Section 36-458(a) Cause for revocation as enforcement action. The Planning Commission may recommend to the Board of Directors that any PUD or PD approval be revoked and all building permits or certificates of occupancy be voided under the following circumstances: (1) The applicant has not submitted a final development plan to staff. Where a staged development plan is approved the Board of Directors may revoke the entire preliminary plan or may revoke only that stage on which a final plan has not been submitted and approved. (2) Construction has not commenced within the time allowed. (3) The applicant has not adhered to the development schedule as stated in the approved preliminary plan. In addition, to the revocation for cause, Section 36-454(e) final development plan states the applicant shall have three (3) years from the date of passage of the ordinance approving the preliminary approval to submit the final development plan. Request for extensions of time shall be submitted in writing to the Planning Commission, which may grant one (1) extension of not more than two (2) years. Failure of the applicant to file a timely extension shall be cause for revocation of the PUD as provided in the ordinance. The revocation hearing was held by the Little Rock Planning Commission on February 16, 2012. The owner of the property was present at the Planning Commission public hearing. The item was approved by the Planning Commission on the Commission's Consent Agenda.
