AN ORDINANCE APPROVING A PLANNED ZONING
DEVELOPMENT AND ESTABLISHING A PLANNED OFFICE
DISTRICT TITLED TRICE SURGERY CENTER SHORT -FORM
POD (Z-8296), LOCATED ON THE SOUTHEAST CORNER OF
KANIS ROAD AND LABELLE DRIVE, LITTLE ROCK,
ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF
THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described property
be changed from R-2 to POD:
Part of the NE '/4 of Section 11, T-1-N, R-13-W, Little Rock, Pulaski
County, Arkansas, more particularly described as follows: Commencing at
the centerline of Section 11, T-1-N, R-13-W, a found 1" pipe; thence
S88003'35"E 1026.19 feet to a set '/2" rebar; thence N01°41'47"E 472.71
feet to the point of beginning a set '/2" rebar; thence N01041'47"E 225.08
feet to a set'/2" rebar on the south right of way of Kanis Road; thence with
said right of way S88058'33"W 270.35 feet to a set '/2" rebar; thence along
a curve to the left 137.91 feet having a radius of 200.0 feet and having a
chord bearing and distance of S69013'21"W 135.19 feet to a set'/2" rebar;
thence S49°28'08"W 67.26 feet to a set %2" rebar; thence along a north
tangent curve to the right 123.62 feet, having a radius of 305.0 feet and
having a chord bearing and distance of S20'01'46"E 122.78 feet to a set
'/2" rebar; thence S88°06'59"E 399.33 feet to the point of beginning;
containing 1.99 acres more or less.
SECTION 2. That the approval of Trice Surgery Center Short -form POD (Z-8296),
located on the Southeast corner of Kanis Road and Labelle Drive is subject to compliance
with the following additional conditions:
That the preliminary site development plan/plat be approved as submitted,
including all staff comments and conditions as outlined in the Planning
Commission Agenda Staff Report in paragraphs D, E, F and including any
conditions indicated in the staff analysis in paragraph H and subject to
additional conditions imposed at the Planning Commission Public Hearing
as amended by the applicant.
SECTION 3. That the preliminary site development plan/plat be approved as
recommended by the Little Rock Planning Commission.
SECTION 4. That the change in zoning classification contemplated for Trice
Surgery Center Short -form POD (Z-8296), located on the Southeast corner of Kanis Road
and Labelle Drive is conditioned upon obtaining a final plan approval within the time
specified by Chapter 36, Article VII, Section 36-454 (e) of the Code of Ordinances.
SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to affect and designate the change
provided for in Section 1 hereof.
SECTION 6. That this Ordinance shall not take effect and be in full force until
the final approval of the plan.
SECTION 7. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.

The applicant is proposing a rezoning of the site from R-2,
Single-family to POD to allow the construction of a
medical office/surgery center on this 1.99 acres site.

Staff recommends approval of the requested POD zoning.
The applicant has addressed staffs concerns related to the
street design and sight distance concerns previously raised.
The Planning Commission voted to recommend approval of
the requested zoning by a vote of 8 ayes, 0 noes and
3 absent.
The Planning Commission reviewed the proposed POD
request at its February 14, 2008, meeting. There were no
registered objectors present. The Brownwood Terrace
Neighborhood Association, the John Barrow Neighborhood
Association, all residents who could be identified located
within 300 feet of the site and all property owners located
within 200-feet of the site were notified of the Public
Hearing.
BACKGROUND
The applicant is requesting a rezoning of this 1.99 acre site
from R-2, Single-family to Planned Office Development to
allow the construction of an 18,375 square foot medical
office/surgery center on the site. The site plan indicates the
placement of 70 parking spaces to serve the center.
The hours of operation are normal office hours or from 8:00
am to 6:00 pm Monday through Friday. There is no
overnight stay proposed for the center. The site plan
indicates the placement of a dumpster near the southwest
corner of the building. A note indicates the dumpster will
be serviced during daylight hours only.
A monument sign is proposed consistent with signage
allowed in office zones. Building signage is proposed on
the facades fronting Kanis and Labelle Drive.

development proposal and the staff analysis and
recommendation.

Please find enclosed four (4) copies of the revised site plan for the above referenced
project. The following are responses to staff comments received at Subdivision
Committee:
Planning Staff Comments:
1. Notices have been prepared and will be mailed today, January 30, 2008.
Receipts will be provided to staff.
2. The surgery center will be open during normal business hours, Monday through
Friday and there will be no overnight stays.
3. The dumpster will be serviced during business hours.
4. Number of doctors and staff members is not'known at this time.
5. The maximum building height will be 40'
6. Monument signage and building signage has not been determined. Both the
monument and building signage will conform to code.
7. The transformer pad and condenser units have been moved to the west side of
the building.
8. The screening fencing on the south and east sides of the site will be wood
privacy.
9. The number of beds is unknown at this time.
Public Works Comments:
1. The required right of way will be dedicated.
2. The new Kanis Road centerline was provided to us and the site has been re-
configured to conform to the impact of the street re -alignment. Half street
improvements will be constructed on Kanis to comply with Master Street Plan
requirements.
