Staff presented the item stating the applicant had not contacted staff with regard to disposition of this item since the previous public hearing. Staff presented a recommendation of withdrawal, without prejudice, and recommended the applicant refile the request if and when the applicant decided to move forward with the rezoning of this parcel. There was no further discussion of the item. The chair entertained a motion for placement of the item on the Consent Agenda for approval of the withdrawal request. The motion carried by a vote of 9 ayes, 0 noes and 2 absent. VA ITEM NO.: 13. NAME: Jerel Short -form PD-R LOCATION: located at 8405 Ferndale Cut-off Planning Staff Comments: Z-8293 1. Provide notification of all property owners located within 200-feet of the site, complete with the certified abstract list, notice form with affidavit executed and proof of mailing. The notice must be mailed no later than January 30, 2008. The Office of Planning and Development must receive the proof of notice no later than February 8, 2008. 2. Provide a cover letter detailing the proposed development including total building square footage, total building height, proposed construction materials and roof treatment. 3. Provide the existing right of way for Ferndale Cut-off. 4. Will the new units provide covered parking? If so provide the location of the proposed covered parking area. 5. Any additional site lighting must be low level and directional, directed downward and into the site. 6. Provide a letter from the area volunteer fire department indicating their knowledge of the project and their ability to serve the development. 7. Provide the septic certification for the proposed new construction. 8. Provide the source of water for the site. 9. Will the site be maintained as a single tract? Neighborhood Associations -- Not an active association in the area. Variance/Waivers: None requested. Public Works Conditions: 1. Ferndale Cutoff at this location is classified on the Master Street Plan as a principal arterial. Dedication of right-of-way to 55 feet from centerline is required. Since the existing structure and pump house are only 50 feet from the centerline, a dedication of right-of-way 48 feet from centerline is required. 2. This property shows to be located in the 100 year floodplain. Contact Pulaski County Planning Department for more information pertaining to construction in the floodplain at this location. Utilities and Fire Department/County Planning: Item # 13. Wastewater: Property outside the service boundary. Provide the means of wastewater disposal. Entergy: No comment received. Center -Point Ener : Approved as submitted. AT & T: No comment received. Central Arkansas Water: All Central Arkansas Water requirements in effect at the time of request for water service must be met. Contact Central Arkansas Water if larger and/or additional water meter(s) are required. If a larger and/or additional meter is needed, a Capital Investment Charge based on the size of the meter connection(s) will apply to this project in addition to normal charges. Fire Department: Fire hydrants maybe required. The site is located outside the City limits of Little Rock but within the Extraterritorial Planning Jurisdiction. Provide approval from the area volunteer fire department indicating their knowledge of the project and their ability to serve the development. County Planning: Establish the appropriate base flood elevation, fill to one foot above the established elevation and obtain a flood development permit from Pulaski County Planning. CATA: The site is not located on a CATA Bus Route Parks and Recreation: No comment. Planning Division: This request is located in the Chenal Planning District. The Land Use Plan shows Single Family for this property. The applicant has requested to rezone the property from R-2, Single-family to Planned Residential Development to allow the addition of a duplex structure on the site maintaining the existing single-family structure. Because the overall density is still below the requirements for Single Family and it will be one development with one ownership, this request does not propose sufficient change that would require a change to the Land Use Plan. Master Street Plan: Ferndale Cutoff is shown as a Principal Arterial. The primary function of a Principal Arterial is to serve through traffic and to connect major traffic generators or activity centers within urbanized areas. Entrances and exits should be limited to minimize negative effects of traffic and pedestrians on Ferndale Cutoff since it is a Principal Arterial. This street may require dedication of right-of-way and may require street improvements for entrances and exits to the site. Bicycle Plan: A Class III bike route is shown along Ferndale Cutoff. A Class III bikeway is a signed route on a street shared with traffic. No additional paving or right-of-way is required. Class III bicycle route signage may be required. Neighborhood Action Plan: This area is not covered by a Neighborhood Action Plan. Item # 11 Landscape: 1. The site plan must comply with the City's landscape and buffer ordinance requirements. 2. A small amount of landscaping will be required in conjunction with this development. 3. All the newly landscape areas must be irrigated with an automatic irrigation system. 4. The zoning buffer ordinance requires a fifteen foot wide (15') land use buffer along the eastern property line. Seventy percent (70%) of this area is to remain undisturbed. 5. The zoning buffer ordinance requires a twelve foot wide (12') land use buffer along both the northern and the southern property lines. Seventy percent (70%) of this area is to remain undisturbed. 6. The zoning buffer ordinance requires an average fifteen foot wide (15') street buffer and in no case less than half, along the western property line next to the street. Additional Comment — The Planning Commission and Board of Directors will no longer allow presentation boards to present materials. You must have all presentation material in a size that can be ro'ected on the screen — a maximum size of 11 x 17 but preferably the material should be no larder than 8'/z by 14. Revised plat/plan: Submit four (4) copies of a revised preliminary plat/plan (to include the additional information as noted above) to staff on Wednesday, January 30, 2008. Item # 13.
