3 AN ORDINANCE TO REPEAL ORDINANCE NO. 19,915 (FEBRUARY 59
4 2008), TITLED THE HOUSE OF VISION SHORT -FORM POD, LOCATED
5 AT 1921 WRIGHT AVENUE (Z-8292-B), IN THE CITY OF LITTLE ROCK,
6 ARKANSAS, AND REVOKING A PLANNED ZONING DISTRICT; AND
7 FOR OTHER PURPOSES.

9 WHEREAS, Ordinance No. 19,915 was adopted by the Little Rock Board of Directors on February 5,
10 2008, establishing a PZD, Planned Zoning District, titled The House of Vision Short -Form POD, located
11 at 1921 Wright Avenue (Z-8292-B); and,
12 WHEREAS, the development as approved for The House of Vision Short -Form POD, located at.1921
13 Wright Avenue, is no longer a viable project and the owner of the subject property has requested the repeal
14 of the PZD ordinance and restoration of the zoning classification as previously existed; and,
15 WHEREAS, the Little Rock Planning Commission reviewed the request for revocation for The House
16 of Vision Short -Form POD, located at 1921 Wright Avenue (Z-8292-B), at their June 28, 2018, public
17 hearing and voted 10 ayes, 0 nays, 1 absent and 1 recusal (Commissioner Laha) to forward the revocation
18 request to the Little Rock Board of Directors for final action.
19 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK, ARKANSAS.
21 Section 1. That Ordinance No. 19,915 is hereby repealed, removing from the Official Zoning Map
22 the classification of POD, Planned Office Development.
23 Section 2. That the underlying R-4, Two -Family District, classifications be restored to the property
24 described as: The west eighty-two (82) feet of Lots 1, 2, 3, 4 and 5 and the west eighty-two (82) feet of
25 the North '/2 of Lot 6, Block 2, Moore and Penzel Addition to the City of Little Rock, Pulaski County,
26 Arkansas.
27 Section 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock,
28 Arkansas, and Designated District Map be and is hereby amended to the extent and in the respects necessary
29 to affect and designate the change provided for in Sections 1 and 2 hereof.
30 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
31 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
32 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
33 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
34 ordinance.

Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with
the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

This comes as a follow-up to our conversations via telephone regarding my request to revoke the POD Zoning of
the house/property described as Lot 1- Block 2 - Moore & Penzel - 1921 Wright Avenue, Little Rock, Ark 72202 - W82' of
LTS 1 th ru 5 & W 82 of N 1 /2 of LT 6.
As discussed, it has not been successful being zoned as Business/Quiet Office in the past years. I am unsure as to
whether it was the location or something else. It was my intention to try to help people, especially in this area, with
office space and/or other small social, family gathering, or other small business activities. It was not has ended up as I
desired - turned out to be a tax burden/expense to me.
Now, I am planning to use it for families needing Section 8 Housing. Hopefully, this will still help some families.

SYNOPSIS The request is a revocation of the previously approved
PD-O, Planned Development Office Zoning District and the
restoration of the underlying R-4, Two-family Zoning
District.
FISCAL IMPACT I None.
RECOMMENDATION Staff recommends approval of the requested PD-O
Revocation. The Planning Commission voted to
recommend approval of the PD-O Revocation by a vote of
10 ayes, 0 noes, 1 absent and 1 recusal (Commissioner
Laha).
BACKGROUND Ordinance No. 19,915, adopted by the Little Rock Board of
Directors on February 5, 2008, rezones the site from R-4,
Two-family District to POD to allow the existing duplex to
be renovated for an activity center and private offices. The
applicant proposed persons using the House of Vision, an
office next door located at 1971 Wright Avenue, as meeting
room space to plan activities, extended business meetings,
private family gatherings and other small community
meetings. The House of Vision allowed free office space for

job development and placement of ex -felons; stop the
violence program, personal growth and development for
targeted populations and other community services.
Ordinance No. 21,001 adopted by the Little Rock Board of
Directors on March 3, 2015, allowed a revision to the
previously approved POD to allow the use of a portion of the
structure as residential. The building located on the site was
constructed as a duplex. The structure served as an activity
center and private office space. The unit located at 1921
Wright Avenue will become the private residence while the
1853 Summit unit would continue to function with private
offices, meeting space and public gathering space. The
residential request was to accommodate a family member in
need of a place to live on a temporary basis.
The structure contained 4,900 square feet. The residence
was to contain 2,200 square feet and the remaining 2,700
square feet was to be used for office space and public
gatherings. The applicant stated the uses included
graduation ceremonies for Dr. Emma Rhodes Education
Center (EREC) located at 1815 Wrights Avenue, small
community meetings, extended business meetings not held
in the EREC building and office space.
Per Section 36-454(d) The owner of an approved PD or PUD
may, for cause, request repeal of the ordinance establishing
the development when it has been determined that the
development will not occur. A written request may be filed
with the City staff at any time up to three (3) years after the
date of adoption of the ordinance creating the PUD or PD.
The request shall set forth the cause of the repeal.
According to the ordinance, the Planning Commission
recommendation on the repeal request shall be forwarded to
the Board of Directors for their consideration. The Board of
Directors may grant or deny the request or return the request
to the Planning Commission for further study. If the request
is approved, an ordinance shall be adopted repealing the
PUD or PD.
The owner is requesting the POD zoning be revoked and the
underlying R-4, Two-family District zoning be restored.

CONTINUED
The Planning Commission reviewed the proposed PD-O
request at its June 28, 2018, meeting and there were no
registered objectors present. The Central High and Wright
Avenue Neighborhood Associations and all property owners
located within 200-feet of the site were notified of the public
hearing. Please see the attached Planning Commission
minute record and site plan for the applicant's specific
development proposal and the staff analysis and
recommendation.
