HomeMy WebLinkAboutZ-8273 ApplicationORDINANCE NO, 19,885 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED RESIDENTIAL DISTRICT TITLED AUXOR ARMS APARTMENTS LONG -FORM PD-R (Z-8273), LOCATED AT 9101 AUXOR ROAD, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE, CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from R-2 to41£-H )b h n Lot I McConnell's 2"d Subdivision in the City of Little Rock, Pulaski County, Arkansas as recorded in Plat Book No. 27 Page 45. SECTION 2. That the approval of Auxor Arms Apartments Long -form PD-R (Z-8273), located at 9101 Auxor Road is subject to compliance with the following additional conditions: ■ That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Auxor Arms Apartments Long -form PD-R (Z-8273), located at 9101 Auxor Road is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36-454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. Submitted by: Department of Planning and Development SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION Action Required 40rdinance Resolution Approval Information Report Submitted By Bruce Moore Citv Manager The applicant is seeking a rezoning for this site from R-2 to PD-R to recognize the existing use and allow additional parking to be constructed on the site. I None. Staff recommends approval of the requested PD-R zoning. The Planning Commission voted to recommend approval of the requested zoning by a vote of 11 ayes, 0 noes and 0 absent. The Planning Commission reviewed the proposed PD-R request at its November 8, 2007, meeting. There were no registered objectors present. The Upper Baseline Neighborhood Association, Southwest Little Rock United for Progress, all residents who could be identified located within 300 feet of the site and all property owners located within 200-feet of the site were notified of the Public Hearing. BACKGROUND The site is located on Auxor Road and was constructed prior to the City annexing the area. The site is presently zoned R-2, Single-family with a nonconforming apartment complex. The site contains 100 apartments contained in 12 buildings. The apartment buildings are two story structures` with a maximum height of 24 feet. 'A one story brick office building containing 2,031 square feet and a one story laundry and maintenance shop containing 1,570 square feet are also located on the site. The site contains a total of 150 parking spaces. The applicant is proposing a rezoning of the site to PD-R to allow the addition of 25 new parking spaces located along the northern perimeter of the site.
