That Ordinance Numbers 19,843 is hereby repealed, removing from the 17 Official Zoning Map the classification PCD. 18 SECTION 2. That the property described as: Lots 1 and 2 and the West % of Lot 3, Block 19 16, Rectortown Addition to the City of Little Rock, Pulaski County, Arkansas, is hereby revoked and 20 the underlying UU, Urban Use Zoning District zoning classification is hereby restored to the 21 property. 22 SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances of the 23 City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and 24 in the respects necessary to affect and designate the change provided for in Sections 1 and 2 hereof. 25 SECTION 4. Severability. In the event any title, section, paragraph, item, sentence, 26 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, 27 such declaration or adjudication shall not affect the remaining portions of the ordinance which shall 28 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was 29 not originally a part of the ordinance. 30 SECTION 5. Repealer. Submitted by: Department of Planning and Development SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION Action Required gOrdinance Resolution Approval Information Report Approved By Bruce Moore The applicant is requesting revocation of a previously approved PCD and restoration of the underlying UU, Urban Use District zoning. I None. Staff recommends approval of the requested PCD revocation. The Planning Commission voted to recommend approval of the requested zoning by a vote of 9 ayes, 0 noes and 2 absent. The Planning Commission reviewed the proposed PCD revocation request at its July 11, 2013, meeting. There were no registered objectors present. The Hanger Hill Neighborhood Association and the MacArthur Park Property Owners Association were notified of the Public Hearing. BACKGROUND Ordinance No. 19,843 adopted by the Little Rock Board of Directors on November 6, 2007, rezoned the site from UU, Urban Use District to PCD to allow the utilization of an existing industrial building as a pet daycare. The intent was to begin with 45 dogs and be provided the ability to expand to 90 dogs as the business grew. The approval allowed an area of outdoor play for the dogs. Outdoor activities are typically not allowed in the UU, Urban Use Zoning District thus necessitating the rezoning request to PCD. The pet daycare no longer occupies the building. Per Section 36-454(d) The owner of an approved PD or PUD may, for cause, request repeal of the ordinance establishing the development when it has been determined that the development will not occur. A written request may be filed with the City staff at any time up to three (3) years after the date of adoption of the ordinance creating the PUD or PD. The request shall set forth the cause of the repeal. According to the ordinance, the Planning Commission recommendation on the repeal request shall be forwarded to the Board of Directors for their consideration. The board of directors may grant or deny the request or return the request to the planning commission for further study. If the request is approved, an ordinance shall be adopted repealing the PUD or PD. The owner has stated the pet daycare is no longer occupying the building. The owner is requesting the PCD zoning be revoked and the UU, Urban Use Zoning District zoning be restored. The approved PCD was to allow a use on the property which is not allowed under the UU, Urban Use Zoning District. There was no new construction with the approval. Staff recommends the current PCD zoning classification be revoked and the previously held UU, Urban Use zoning be restored. The request must be reviewed by the Planning Commission and Board of Directors. The request must be received by June 3, 2013 to be placed on the Planning Commissions July 11, 2013, public hearing. The item will then be forwarded to the Board of Directors for final approval which will most likely be their August 20, 2013 meeting.
