AN ORDINANCE APPROVING A PLANNED ZONING
DEVELOPMENT AND ESTABLISHING A PLANNED
COMMERCIAL DISTRICT TITLED SONIC DRIVE-IN
BASELINE ROAD SHORT -FORM PCD (Z-8259), LOCATED AT
4501 BASELINE ROAD, LITTLE ROCK, ARKANSAS,
AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF
LITTLE ROCK; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described property
be changed from R-2, Single-family to PCD:
Part of the NE '/4 NE '/4 Section 6, T-1-S, R-12-W, Pulaski County,
Arkansas, more particularly described as follows: That part of Lot 1 Hill
Thomas Addition lying south of State Highway 388 Right of way being
further described as follows: Beginning at the NE corner of Section 6, T-
1-S, R-12-W, thence south 75.65 feet, thence west 30 feet to a right of way
marker on the State Highway 388 right of way, thence S03°45'48"W,
along the east side of Lot 1 184.54 feet to a point; thence N86°38' 11 "W
105.0 feet to a point; thence NO3°44' 10"E 218.48 feet to a point on State
Highway 388 Right of way to a right of way marker,; thence S87°35'14"E,
41.82 feet along said Right of way to a Right of way marker, thence
S36°14'09"E 46.06 feet to the point of beginning containing .52 acres
more or less.
SECTION 2. That the approval of Sonic Drive-in Baseline Road Short -form PCD
(Z-8259), located at 4501 Baseline Road is subject to compliance with the following
additional conditions:
• That the preliminary site development plan/plat be approved as submitted,
including all staff comments and conditions as outlined in the Planning
Commission Agenda Staff Report in paragraphs D, E, F and including any
conditions indicated in the staff analysis in paragraph H and subject to
additional conditions imposed at the Planning Commission Public Hearing
as amended by the applicant.
SECTION 3. That the preliminary site development plan/plat be approved as
recommended by the Little Rock Planning Commission.
SECTION 4. That the change in zoning classification contemplated for Sonic
Drive-in Baseline Road Short -form PCD (Z-8259), located at 4501 Baselin6 Road is
conditioned upon obtaining a final plan approval within the time specified by Chapter 36,
Article VII, Section 36-454 (e) of the Code of Ordinances.
SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to affect and designate the change
provided for in Section 1 hereof.
SECTION 6. That this Ordinance shall not take effect and be in hall force until
the final approval of the plan.
SECTION 7. &verabilily. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.

The applicant is seeking a rezoning of this non -conforming
site to Planned Commercial Development to allow an
existing patio area to be covered by an arched canopy.
None.
Staff recommends approval of the requested PCD zoning.
The Planning Commission voted to recommend approval of
the requested zoning by a vote of 9 ayes, 0 noes, 1 absent
and 1 open position.
The Planning Commission reviewed the proposed PCD
request at its September 27, 2007, meeting. There were no
registered objectors present. The Upper Baseline
Neighborhood Association, Southwest Little Rock United
for Progress, all residents who could be identified located
within 300 feet of the site and all property owners located
within 200-feet of the site were notified of the Public
Hearing.
BACKGROUND
The applicant is seeking a rezoning of this non -conforming
site to Planned Commercial Development to allow an
existing patio area to be covered by an arched canopy.
There are no other modifications proposed to the site with
the application request.
