AN ORDINANCE APPROVING A PLANNED ZONING
DEVELOPMENT AND ESTABLISHING A PLANNED
COMMERCIAL DISTRICT TITLED AMERICA BEST INNS AND
SUITES SHORT -FORM PCD (Z-8234), LOCATED ON
MABELVALE PIKE AT 1-30, NEAR 10200 1-30, LITTLE ROCK,
ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF
THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES,
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described property
be changed from R-2, Single-family to PCD:
Part of the SE '/a, SE '/4, of Section 34, T-1-N, R-13-W, Little Rock,
Pulaski County, Arkansas, more particularly described as follows:
Commencing at the southeast corner of the SE '/4, SE '/4, T-1-N, R-13-W;
Thence N00°44'E along the east line of said SE '/4, SE '/4, 252.6 feet;
Thence N27°08'30"W 30.0 feet; Thence N27°08'30"W 170.07 feet to the
point of beginning; Thence N80°24' 15"W 308.36 feet to the right of way
of Mabelvale Pike; thence N41°02'00"E 202.50 feet; thence S74°18'00"E
180.02 feet; thence S00°42'00"W 155.12 feet to the point of beginning
containing 0.92 acres more or less.
SECTION 2. That the approval of America Best Inns and Suites Short -form PCD
(Z-8234), located on Mabelvale Pike at I-30, near 10200 1-30 is subject to compliance
with the following additional conditions:
■ That the preliminary site development plan/plat be approved as submitted,
including all staff comments and conditions as outlined in the Planning
Commission Agenda Staff Report in paragraphs D, E, F and including any
conditions indicated in the staff analysis in paragraph H and subject to
additional conditions imposed at the Planning Commission Public Hearing
as amended by the applicant.
SECTION 3. That the preliminary site development plan/plat be approved as
recommended by the Little Rock Planning Commission.
SECTION 4. That the change in zoning classification contemplated for America
Best Inns and Suites Short -form PCD (Z-8234), located on Mabelvale Pike at 1-30, near
10200 I-30 is conditioned upon obtaining a final plan approval within the time specified
by Chapter 36, Article VII, Section 36-454 (e) of the Code of Ordinances.
SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to affect and designate the change
provided for in Section 1 hereof.
SECTION 6. That this Ordinance shall not take effect and be in full force until
the final approval of the plan.
SECTION 7. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.

The applicant is requesting a rezoning of the site from R-2,
Single-family to PCD to allow the construction of a hotel.

Staff recommends approval of the requested PCD zoning.
The Planning Commission voted to recommend approval of
the requested zoning by a vote of 8 ayes, 1 no, 1 absent and
1 open position.
The Planning Commission reviewed the proposed PCD
request at its September 27, 2007, meeting. There were
registered objectors present. The Town and Country
Neighborhood Association, Southwest Little Rock United
for Progress, all residents who could be identified located
within 300 feet of the site and all property owners located
within 200-feet of the site were notified of the Public
Hearing.
BACKGROUND
The applicant is proposing to construct a two story 32-room
hotel on this 0.95 acre site. The site plan indicates the
placement of a 25-foot building setback along the street
side and a 25-foot rear yard setback. The northern building
setback has been indicated at 15-feet as typically required
in the commercial zoning district for C-3, General
Commercial District. The maximum building height has
been indicated at 35-feet also as typically allowed in the
C-3, General Commercial District zoning classification.
A total of 32 rooms are proposed with 34 parking spaces.
Based on the typical minimum parking requirement for a
hotel 35 spaces would typically be required. Although the
site is not providing adequate parking to meet the typical
minimum parking demand, staff does not feel the reduced
number of parking spaces will significantly impact the
development or the area.
The plan indicates the placement of building landscaping in
compliance with the requirements of the landscape
ordinance. The applicant has indicated plantings will be
installed and pots of seasonal color will be added to the site
to soften the building and parking areas.
Staff previously raised concerns with the proposed
development as originally proposed, indicating they felt the
developers were maximizing the development with
buildings and parking and paying little attention to the site
design. Staff feels the amended site plan more fully
complies with typical minimum ordinance requirements for
development of a commercial site.

Patel, President of D&R Management Co., a construction and financial
consultant.
• David Patel's company will build, manage and own a 25% stake in this hotel.
• ABIS will be a 31 room hotel - NOT an extended stay hotel.
• Applicant's company is making a $2 Million investment in this project.
• Applicant's marketing study shows a definite need for new hotels in this area.
• Applicant has a solid history of providing safe, clean, family -oriented and
attractive hotel accommodations for its customers.
■ Applicant is negotiating to purchase land and build a 72 + room Comfort Inn
Suites across 1-30 next to Applebee's restaurant in Mabelvale Plaza.
■ This project is expected to generate $480,000 to $500,000 first year tax revenues
which, in turn, would create about $50,000 in taxes to city, county and state and
$18,000 in real property taxes.
• ABIS is an "interior property" which means access to all rooms will be only
through a lobby with multiple security cameras operated 24/7 on premises and
fully staffed 24/7.
• Hotel will be constructed of all brick exterior containing with a two story canopy
over the entrance.
• Project site is located directly across Mabelvale Pike from Arkansas Highway and
Transportation Department and adjacent to Harley Davidson dealership.
• Applicant has good history of business relationship with Arkansas Highway
Department officials, employees and guests at other hotels owned by applicant in
Little Rock.
0 Project will create 10-12 full and part time jobs.
• David Patel has been making a strong financial investment in Southwest Little
Rock for over thirteen years and still has the confidence and willingness to invest
in this area.
• Applicant will be adding another lane to Mabelvale Pike frontage at the cost of
approximately $20,000.
• Applicant's operations manager is Jennifer Ringgold who has over 12 years
experience running hotels of applicant. Ms. Ringgold's husband is a Little Rock
Police Department vice officer and her father is a thirty year veteran U.S.
Marshall.
• Other successful hotel projects of Applicant:
1. Built and managed Comfort Inn on Geyer Springs Road in
Southwest Mall - Sold about two years ago and is now Best Western
Luxury Inn & Suites.
2. Applicant purchased frontage of vacant Southwest Mall and
developed hotel and sold portion to developer of current Arkansas State
Police headquarters.
3. Purchased and developed UA Theater in Southwest Mall and sold
to Ron Sherman Studios.
4. Built and currently manages Comfort Inn on Shackleford Road in
West Little Rock.
5. Owns land in Shackleford Crossing for construction of new $7M
Comfort Suites Hotel.
6. Numerous U.S. Secret Service Agents protecting Vice President Al
Gore stayed in applicants' Comfort Inn in West Little Rock. The hotel and
David Patel were presented with a plaque from the White House awarded
for their accommodations.
CONCLUSION:
This application is a good land use of this 0.95 acre vacant property in Southwest Little
Rock. Approving this application will advance the City Board policy to "create an
environment that attracts new business, retains and encourages growth for existing
