I also am using this means to communicate with you because of the limited time before the hearing by the Planning Commission on Thursday, and also because of the seriousness with which I and other property owners consider this issue. I strongly protest the proposal to rezone this property and I urge you to use the resources and influence of your office to do the same. I plead and urge the Planning Commission to uphold the integrity of the Zoning regulations of this City, and to protect the rights and interests of the homeowners who rely on those zoning regulations. I live directly across the street from the propose zoning change, and would be affected by an office building at this location. Property owners directly to the North of this property would be affected, as well as property owners directly to the South of the property. Can you imagine living in the residence on the North, and having an office building facing you just a few feet from your front lawn and your home? Can you imagine driving out of your residence onto Katillus Rd and be faced with the side of an office building where there had previously been residential property? Those of us who live in this area have made substantial financial investments in our homes, relying on the integrity of the zoning regulations that are in place. Please do not allow a Developer/Entrepeneur to change the environment for business purposes. Please do not allow commercial development to creep off the Hwy 10 corridor into our residential area. There is not a need for an office building at the proposed location; there is ample office space only a few yards away, on Hwy 10. It also seems that the Developer is undermining the value of his own patio home community adjacent to the lot in question. Further, it does not seem to even be a wise choice financially to stick an office building on this narrow space. And thirdly, REZONING THIS LOT ONLY INVITES FUTURE PETITIONS TO REZONE ADJACENT PROPERTY. PLEASE DO NOT ALLOW COMMERCIAL DEVELOPMENT TO CREEP SOUTH ON KATILLUS ROAD! I believe it is the purpose of the Zoning regulations to protect the the interests of the Citizens and it is the purpose of the Commission to assure that these regulations are upheld. Please do not allow a commercial office building (regardless of the architectural style) to be squeezed into a narrow lot in a residential area. I wanted to write and express my surprise and disappointment with staffs decision not to support the rezoning of lot 25 in the Longleaf subdivision. I feel that the rezoning of this property will be additive to the well being of the area and also to the city of Little Rock. I have therefore concluded that I have not properly explained why I desire to have the property rezoned. As you probably know, lot 25 actually sits outside of the Longleaf subdivision fronting on Katillus road and running parallel to Cantrell Road. There is a piece of property that is approximately 300 feet deep that is situated between Lot 25 and Cantrell. This piece of property has already been under contract once and I believe the developer was seeking a mixed use of office and commercial. Historically, houses that are located next to commercial projects do not appreciate in value or quality over time. My experience in development is that generally a transition area is provided between intersections like this one and residential properties. Lot 25 would serve as a screening between the residential area and the future use The structure we are proposing to put on lot 25 is a residential structure. Please examine the picture below. � e; Jam. t��y: �+-�-''� y 1L •.Y' _� 7F • Page 2 August 27, 2008 This is a residential structure that is identical to all construction in style and design on Longleaf and most of the construction in Montagne. This is what we propose putting on lot 25. The parking will be behind the building so that it will not be visible from the street. There is no plan for overhead lighting. All landscaping will be identical to the landscaping in the Longleaf subdivision. Any signage will meet the city code for signage. We are proposing a small single user office building that will operate from 8 to 5. Please understand — I still have 19 houses to build and sell in Longleaf. If I did not feel the project was additive to the neighborhood I would not do it. In fact, I have sold the lot directly behind lot 25 and the homeowner was highly in favor of our proposed use. She fully understands the concepts I have described above. In examining the projects currently around Montagne, I have noticed there is an office complex that will have multiple tenants and also extends deeper than the project I am proposing. It is also two stories in height and adjoins Montagne on their north and east border. It has big parking lots with overhead lighting and big signage. I would like to know why the city was in support of a project that was more invasive and of a higher density that is right by this piece of property. Please feel free to respond to this question. Knowing that the city allowed and supported such a project further supports our desire to have a single level structure to buffer the residential housing from any future development on this site. However, our buffer will be a single level residential structure that will be used as an office. I am respectfully asking that you reconsider the rezoning of the lot. Our goal is low impact, suburban office that blends with the residential 100%. It will act as a buffer between a denser residential area and an office commercial zone. The people that are buying houses in our new subdivision get the concept and feel that it will be additive to their living environment. I would like to have staffs support if possible. I have always done whatever the city has required and have generally exceeded the city requirements. The developments in Little Rock I have been involved in include Reservoir Heights, Stagecoach Village, Taylor Park, Greystone of Little Rock and now Longleaf. These have all turned out to be nice subdivisions that are and will be desirable places to live. I am proposing to rezone lot 25 as an additive feature to the city that will make Longleaf Cove a nicer place to live. Please let me know your decision. Montagne Court, which is located on the east side South Katillus, is a planned community of 60 brick patio homes. Currently, 51 homes are owner occupied, 4 are under construction and 5 lots remain to be built on. I am responding to you in reference to the proposed rezoning of Lot 25, Longleaf Cove which proposes to allow for the construction of a new 3200 square foot office building on a site platted for single-family lots. If I understand your zoning definitions correctly, I believe the site in question is currently zoned PDR and the requested change is to POD. I can assure you that the Montagne Court property owners are adamantly opposed to such rezoning. Our petition opposing such rezoning is being completed and will be forwarded to your office. Our criteria for opposing such change is very simple. A commercial building with its accompanying shmage and Parking lot does not belong right in - middle of a residential zone. As I understand it, the entire west side of South Katillus is zoned R-2 or PDR from Highway 10 south to Valley Falls Estates. In addition, the Longleaf Cove plat calls for a green belt along its entire northern boundary providing separation between Longleaf Cove and the single family residences directly to the north extending to Highway 10. The green belt serves as a noise and visual barrier to all of the surrounding residences including Montagne Court. Construction of the proposed commercial building will result in the destruction of a healthy portion of this green belt. South Katillus will bear a lot of increased traffic with the advent of the new elementary school on West Taylor Loop and the addition of twenty more patio homes to be constructed by Jim D. Swink and D. June Swink on the west side of South Katillus bordering Valley Falls Estates. The proposed office will only add to the congestion. Our opposition to the rezoning is as follows: 1) I have reviewed the developers plat and it is apparent that it does not comply with the Landscape Ordinance which calls for a nine -foot perimeter landscape strip. 2) The proposed office building is at least 300 feet south of Hightway 10 on the west side of South Katillus right in the midst of single family homes. 3) With the addition of 24 single family homes in Longleaf Cove there will be in excess of 110 homes accessing the .4 mile length of South Katillus. 4) The completion of the new elementary school on West Taylor Loop will funnel more traffic on to South Katillus and Forrest Lane. 5) The proposed office building will result in commercial signage and lighting in a residential area which will adversely influence property values. As noted in my earlier correspondence to Association opposes the rezoning request. follows: you, the Montagne Court Properly Owners Our opposition to the rezoning request is as 1) Graham Smith's plat does not comply with the Landscape Ordinance which calls for a nine -foot perimeter landscape strip. 2) The addition of a commercial building on the west side of South Katillus will extend 300 feet into the existing residential area. Historically, commercial property will diminish the value of surrounding homes. 3) In addition to the petition containing the signatures of Montagne Court Property Owners I have spoken to the residents on the one acre lot adjacent to Lot 25 on the north and they are in opposition to the rezoning and have written to your office expressing their objection. As well, I have spoken to property owners on the south border of Longleaf Cove and they are also opposed to any rezoning. 4) This rezoning will create additional traffic on South Katillus which will also have to accommodate the increased traffic generated by the new elementary school under construction on West Taylor Loop. 5) Clearly, a rezoning of Lot 25 does not add any value to the residential community along South Katillus. It becomes an undesireable distraction to the residents who live, walk, and bike on South Katillus. Again, we, the Montagne Court property owners, request that the rezoning application be denied. I urge you to use the resources and influence of your office to do the same. Please consider my following comments. I plead and urge the Planning Commission to uphold the integrity of the Zoning regulations of this City, and to protect the rights and interests of the homeowners who rely on those regulations. I live directly east of the proposed zoning change, and would be affected by an office building at this location. Homeowners directly to the North of this property would be affected, as well as homeowners directly to the South of the property. The developer/petitioner knew this is residential property. Can you imagine living in the home on the North, and having an office building (regardless of its architectural style) facing you just a few feet from your front lawn and your home? Can you imagine driving out of your residence onto Katillus Rd and be faced with the side of an office building where there had previously been residential property? The developer knew this is residential property. Those of us who live in this area have made a substantial financial investment in our homes, relying on the integrity of the zoning regulations that are in place. Please do not allow a Developer/Entrepreneur to change this environment for business purposes and affect the lives and property values of so many people. Please do not allow commercial development to creep off Hwy 10 into our residential area! There is not a need for an office building at this location; there is ample office space only a few yards away on Hwy 10. It also seems that the Developer is undermining the value of his own patio home community that is under construction adjacent to the lot in question. Further, it seems it would be an unwise choice financially for him to stick an office building on this narrow space. And thirdly, REZONING THIS LOT ONLY INVITES FUTURE SPECULATION AND PETITIONS TO REZONE NEARBY PROPERTY. PLEASE DO NOT ALLOW COMMERCIAL DEVELOPMENT TO CREEP SOUTH ON KATILLUS ROAD! I believe it is the purpose of the Zoning regulations to protect the interests of the Citizens and it is the purpose of the Commission to assure that these regulations are upheld. Please do not allow this commercial office building to be squeezed into a narrow lot in a residential area. Please protect the homeowners who rely on you. There is no justification for change. As the enclosed plat shows, lot 25 faces Katillus and does not actually sit in the subdivision. This design was necessary due to the shape of the land. It was and still is out intent to use lot 25 as a screening to separate our subdivision from whatever will be developed on the comer of Highway 10. Our current plan is to build an affordable house on the lot that will be easy to sell with a price point of $150,000. Due to rising costs, this is not going to allow us to build a structure that we feel would be additive to the area over the long term. Again, we still feel we have to build a structure on this sight but want to build a quality structure that will add to the value of the neighborhood. We are asking the city to give us zoning approval to build a residential type structure not to exceed 2800 square feet that will serve as the offices for our company. With this zoning, it allows us to build a nicer structure that we feel will be a good buffer and will be more conducive with the current architecture in the neighborhood. We are proposing to build a residential structure with residential materials that will match the current architecture currently existing in Montagne and Longleaf Cove. The structure will be 4 sides brick and parking will be behind the building. This will preserve the residential look that we are trying to achieve. I have enclosed a plat and a rendering of the structure we are wanting to place on the sight. My company develops residential neighborhoods in the central Arkansas area. We do not have or operate any large equipment and the traffic to our office is very light. Our hours of operation are 8:30 to 4:30 and I currently have 4 employees. I wanted to write and express my surprise and disappointment with staffs decision not to support the rezoning of lot 25 in the Longleaf subdivision. I feel that the rezoning of this property will be additive to the well being of the area and also to the city of Little Rock. I have therefore concluded that I have not properly explained why I desire to have the property rezoned. As you probably know, lot 25 actually sits outside of the Longleaf subdivision fronting on Katillus road and running parallel to Cantrell Road. There is a piece of property that is approximately 300 feet deep that is situated between Lot 25 and Cantrell. This piece of property has already been under contract once and I believe the developer was seeking a mixed use of office and commercial. Historically, houses that are located next to commercial projects do not appreciate in value or quality over time. My experience in development is that generally a transition area is provided between intersections like this one and residential properties. Lot 25 would serve as a screening between the residential area and the future use The structure we are proposing to put on lot 25 is a residential structure. Please examine the picture below. Page 2 August 27, 2008 This is a residential structure that is identical to all construction in style and design on Longleaf and most of the construction in Montagne. This is what we propose putting on lot 25. The parking will be behind the building so that it will not be visible from the street. There is no plan for overhead lighting. All landscaping will be identical to the landscaping in the Longleaf subdivision. Any signage will meet the city code for signage. We are proposing a small single user office building that will operate from 8 to 5. Please understand — I still have 19 houses to build and sell in Longleaf. If I did not feel the project was additive to the neighborhood I would not do it. In fact, I have sold the lot directly behind lot 25 and the homeowner was highly in favor of our proposed use. She fully understands the concepts I have described above. In examining the projects currently around Montagne, I have noticed there is an office complex that will have multiple tenants and also extends deeper than the project I am proposing. It is also two stories in height and adjoins Montagne on their north and east border. It has big parking lots with overhead lighting and big signage. I would like to know why the city was in support of a project that was more invasive and of a higher density that is right by this piece of property. Please feel free to respond to this question. Knowing that the city allowed and supported such a project further supports our desire to have a single level structure to buffer the residential housing from any future development on this site. However, our buffer will be a single level residential structure that will be used as an office. I am respectfully asking that you reconsider the rezoning of the lot. Our goal is low impact, suburban office that blends with the residential 100%. It will act as a buffer between a denser residential area and an office commercial zone. The people that are buying houses in our new subdivision get the concept and feel that it will be additive to their living environment. I would like to have staffs support if possible. I have always done whatever the city has required and have generally exceeded the city requirements. The developments in Little Rock I have been involved in include Reservoir Heights, Stagecoach Village, Taylor Park, Greystone of Little Rock and now Longleaf. These have all turned out to be nice subdivisions that are and will be desirable places to live. I am proposing to rezone lot 25 as an additive feature to the city that will make Longleaf Cove a nicer place to live. Please let me know your decision.
