1 A grading permit in accordance with section 29-186 (c) & (d) will be required prior to any land
clearing or grading activities at the site. Other than residential subdivisions, site grading and
drainage plans must be submitted and approved prior to the start of construction. The cost will be

9 Damage to public and private property due to hauling operations or operation of construction related
equipment from a nearby construction site shall be repaired by the responsible party prior to issuance

10 Vegetation must be established on disturbed area within 21 days of completion of harvest activities.
11 Erosion controls must be installed to reduce discharge of polluted stormwater.
12 The location of vehicle tracking pads has been located. A tracking pad must be constructed per Little
Rock Code Sec. 29-190(12). This tracking pad should be maintained during construction activities.
13 Asher Ave and Mabelvale Pike should be swept and vacuumed as often as needed to reduce the
amount of sediment deposited on public streets and highways.
14 The side slopes of the excavation must not exceed a 3:1 slope.
15 Who is responsible for maintenance of the excavated area at the completion of the project?

2 With site development, provide design of street conforming to the Master Street Plan. Construct one-
half street improvement to Edswood Road including 5-foot sidewalks with planned development. Per
the Master Street Plan, this section of Edswood will be a divided street with a 110 ft right-of-way, 14
ft median, 2 - 26 ft travel lanes and 5 ft sidewalks on both sides of the street. The applicant has
proposed to make an in -lieu payment for the street improvements.
3 Storm water detention ordinance applies to this property. Show the proposed location for stormwater
detention facilities on the plan.

5 Due to Edswood Drive being classified as a principal arterial street, driveway locations and widths

spacing on an arterial street is 300 ft from other driveways and 150 from property lines. The width of a
driveway must not exceed 30 feet. Lots 1 - 5 of the subdivision are only allowed a maximum of 2
driveways. Due to the street elevation on the north end of the subdivision, shared driveways should
be installed on the lot lines between lots 4 & 3 and lots 1 & 2. If privacy gates are proposed to be
installed the key pad to the gate should be located 30 ft from the future back of curb on Edswood Road
and a turnaround provided for a SU-30 vehicle to exit the driveway without having to back into a
principal arterial street (Edswood Rd).

Dear Ms. James:
River Market Tower, a 19 story mixed use structure at 315 Rock Street, contains 6,000 square feet of
retail/commercial space in 3 bays that fronts on E. 3`d Street. Dugan's Pub sits on the corner and
Workplace Resource occupies the easternmost space. The owners of Dugan's Pub, Don Dugan and Tasha
Stratton, want to open a small market in the middle bay called Stratton's Market at Dugan's Pub. It will
sell convenience items like snacks, soft drinks, aspirin, soap and paper towels, as well as deli meats and
fresh flowers. They also want to sell beer and wine, which is what requires this change in the previously
approved PZD.
The purpose of the market is to serve the growing residential neighborhood in the area, the daytime
office population, and visitors in the nearby hotels. Many residents have voiced an interest in this
concept, and Mr. Dugan and Ms. Stratton are attempting to respond to this and provide this needed
service.
The property was developed and is managed by Moses Tucker Real Estate, and is owned by River
Market Tower, LLC, of which I am one of the managing members. There is no bill of assurance for the
horizontal property regime, but a master deed and by-laws is available if needed.

We are pleased to announce the opening of our new neighborhood market, Stratton's Market
at Dugan's Pub. My husband, Don Dugan, and I opened Dugan's Pub in River Market Tower 18
months ago. When the space adjacent to us became available, we saw an opportunity to fill a
need in the neighborhood. Stratton's Market opened last month and serves breakfast, cold
sandwiches, fresh produce, herbs, milk and eggs, toiletries, cleaning supplies, market staples
and popular convenience items. The store is open 7:00 AM to 8:00 PM Monday through
Thursday, 7:00 AM to 9:00 PM Friday and Saturday, and is closed on Sundays.
We also want to sell select wines and popular beer, as well as craft beer and choice upper end
beer. This requires approval from the city of Little Rock. We already have approval from the
state of Arkansas subject to city approval.
I wanted to let you know we are making this application and invite you to try out the store. Our
desire is to listen to our neighbors, and offer the products you want and need. Please stop by

Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
ordinance.
Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

The request is to amend the currently approved PCD to add
a food store under 5,000 square feet of gross floor area,
with sales of beer or wine as an allowable use.

Staff recommends approval of the requested PCD zoning.
The Planning Commission voted to recommend approval of
the requested zoning by a vote of 11 ayes, 0 noes and
0 absent.
The Planning Commission reviewed the proposed PCD
request at its June 21, 2012, meeting. There were no
registered objectors present. All property owners located
within 200-feet of the site and the River Market District
Neighborhood Association were notified of the Public
Hearing.
BACKGROUND
Ordinance No. 19,765 adopted by the Little Rock Board of
Directors on June 19, 2007, rezoned the site from UU to
PCD to allow the development of the 19-story mixed use
building presently located on the site. The applicant
proposed the development of the site with retail uses on the
first floor and residential units on the remaining floors. The
rezoning was necessary to allow an increase in the allowed
density per the R-6, High-rise Zoning District. The
approval also allowed a variance to allow an increase in
building height from the typical standard of the UU Zoning
District. The maximum height typically allowed per the
LU Zoning District is 15-stories. (The approval allowed
for a 20-story building.)
Ordinance No. 20,568 adopted by the Little Rock Board of
Directors on April 3, 2012, modified the zoning ordinance
to require certain uses be considered as a conditional use
permit. Section 10 of Ordinance No. 20,568 amended
Section 36-299(c)(2) to add food store under 5,000 square
feet of gross floor area, with sales of beer or wine to the
listing of conditional use permits. Since the property is
zoned PCD a revision to the PCD is being sought to allow
the alcohol sales in -lieu of filing a CUP.
River Market Tower, a 19-story mixed use structure at
315 Rock Street, contains 6,000 square feet of
retail/commercial space in three (3) bays that front on
East P Street. Dugan's Pub sits on the corner and
Workplace Resource occupies the easternmost space. The
owner of Dugan's Pub is proposing to open a small market
in the middle bay called Stratton's Market at Dugan's Pub.
It will sell convenience items such as snacks, soft drinks,
aspirin, soap and paper towels, as well as deli meats and
fresh flowers. The market will also sell beer and wine,
which is the reason for the change in the previously
approved PCD.

AN ORDINANCE APPROVING A PLANNED ZONING
DEVELOPMENT AND ESTABLISHING A PLANNED
COMMERCIAL DISTRICT TITLED RIVER MARKET
TOWER REVISED SHORT -FORM PCD (Z-8208-A),
LOCATED AT UNIT 102 RIVER MARKET TOWER,
LITTLE ROCK, ARKANSAS, AMENDING THE
OFFICIAL ZONING MAP OF THE CITY OF LITTLE
ROCK; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described
property be changed from PCD to Revised PCD:
Lot 1 River Market Place an Addition to the City of Little Rock,
Pulaski County, Arkansas.
SECTION 2. That the approval of River Market Tower Revised Short -
form PCD (Z-8208-A), located at Unit 102 River Market Tower is subject to
compliance with the following additional conditions:
That the preliminary site development plan/plat be approved
as submitted, including all staff comments and conditions as
outlined in the Planning Commission Agenda Staff Report in
paragraphs D, E, F and including any conditions indicated in the
staff analysis in paragraph H and subject to additional conditions
imposed at the Planning Commission Public Hearing as amended
by the applicant.

SECTION 3. That the preliminary site development plan/plat be
approved as recommended by the Little Rock Planning Commission.
SECTION 4. That the change in zoning classification contemplated for
River Market Tower Revised Short -form PCD (Z-8208-A), located at Unit 102
River Market Tower is conditioned upon obtaining a final plan approval within the
time specified by Chapter 36, Article VII, Section 36-454 (e) of the Code of
Ordinances.
SECTION 5. That the map referred to in Chapter 36 of the Code of
Ordinances of the City of Little Rock, Arkansas, and designated district map be and
is hereby amended to the extent and in the respects necessary to affect and
designate the change provided for in Section 1 hereof.
SECTION 6. That this Ordinance shall not take effect and be in full force
until the final approval of the plan.
SECTION 7. Severability. In the event any title, section, paragraph,
item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to
be invalid or unconstitutional, such declaration or adjudication shall not affect the
remaining portions of the ordinance which shall remain in full force and effect as if
the portion so declared or adjudged invalid or unconstitutional was not originally a
part of the ordinance.
SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the
same that are inconsistent with the provisions of this ordinance are hereby repealed
to the extent of such inconsistency.
