3 AN ORDINANCE TO AMEND SECTION 3 OF LITTLE ROCK, ARK.,
4 ORDINANCE NO. 16,829 (JANUARY 3, 1995), TO RESTRICT PUBLIC
5 VEHICULAR ACCESS ON THE VACATED PORTION OF ROCK
6 STREET, BETWEEN EAST MARKHAM STREET AND EAST 2ND
7 STREET, IN THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR
8 OTHER PURPOSES.

10 WHEREAS, on January 3, 1995, the Board of Directors passed Little Rock, Ark., Ordinance No.
11 16,829, vacating and closing Rock Street, between East Markham Street and East Second Street, also
12 referred to as Block 36, Original City of Little Rock, Arkansas, and Block 8, Pope's Addition to the City
13 of Little Rock, Arkansas;and,
14 WHEREAS,the recent Interstate 30 improvements and circulation plan has changed the public access
15 for pedestrian and vehicles within the immediate area;and,
16 WHEREAS,safe pedestrian access areas are of utmost importance; therefore, Ordinance No. 16,829
17 needs to be amended to restrict public vehicular access through this vacated section of Rock Street.
18 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
19 OF LITTLE ROCK,ARKANSAS:
20 Section 3 of Ordinance No. 16,829 be replaced as follows:
21 Section 3. Central Arkansas Library System (CALS), on behalf of petitioner City of Little
22 Rock, Arkansas, shall, at its sole cost and expense, repair landscape and maintain the vacated
23 portion of Rock Street, and keep the same open for controlled public use and access from
24 President Clinton Avenue, south to the south access point of the existing alley access, between
25 the existing parking garage and the CALS Building, located at 100 South Rock Street. From the
26 said alley, south to East 2"d Street, access shall be limited to pedestrian use, provided that
27 vehicular access may be permitted at CALS' discretion until such time as a new driveway is
28 completed providing access from East 2"d Street to the existing surface parking lot between South
29 Rock Street and River Market Avenue, north of,an contiguous to, East 2"d Street.

32 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
33 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
34 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and

1 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
2 ordinance.
3 Section 3. Repealer. All laws, ordinances and resolutions, or parts of the same, that are inconsistent
4 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency, including but
5 not limited to Little Rock, Ark., Ordinance No. 16,829(January 3, 1995).
