4. RESOLUTION NO. 12 975: To authorize the City Manager to enter into contracts

Synopsis: Enter into contracts with ten (10) organizations to provide summer recreation programs
to Lithe Rock youth, ages 6-I5. Funding available from FUTURE Little Rock Special Projects

S. RESOLUTION NO. 12 976; A resolution authorizing the City Manager to enter into
a contract with "A" Demolition Asbestos Abatement, for the demolition of twenty- one
(21) residential properties within the City of Little Rock, Arkansas. Stag recommends❑pproval.
Synopsis: The properties in question have already been condemned by the Mayor and the Board of
Directors, and are in such a condition as to cause a negative environmental impact in a residential
neighborhood. This resolution authorizes the City Manager to assign the contact with "A"
Demolition, to raze and remove the structures.
6. RESOOLUTION NO. 12 977: To authorize the City Manager to enter into an
agreement with Riverfest, Inc., to provide a major festival in J111his Breckling Riverfront
Park; and for other purposes. Staff recommends approval.
Synopsis: A resolution authorizing the City Manager to enter into an agreement with Riverfest, Inc.,
to provide a major festival in Julius Breckling Riverfront Park, and other purposes.
7. RESOLUTION NO. 12 978: To express the willingness of the City of Little Rock,
to utilize federal -aid recreational fonds for the Arkansas River Trail; and for other
purposes. Staff recommends approval.
Synapsis: A resolution to authorize the City Manager to apply for federal -aid funds for additional
construction.
Director Adcock made the motion, seconded by Director Cazort, to adopt the Consent
Agenda. By unanimous voice vote of the Board Members present, the Consent Agenda
was adopted.
OTHER ITEM (Item 8)
8. ORD NANCE NO- 2414$: To dispense with the requirement of competitive bidding
and authorize the City manager to enter into a contract with Motorola, Inc., as the sole
source provider, to purchase fourteen (14) portable radios in the amoun
Sfat of $70,407.66.

Synopsis: The purchase of the radios is to supply the current recruit class and for spares in
emergencies.
The ordinance was read the first time. Director Adcock made the motion, seconded by

ordinance was read the second time. Director Adcock made a motion, seconded by
Director Cazort, to suspend the rules and place the ordinance on third reading. By
unanimous voice vote of the Board Members present, the ordinance was approved.
SEPARATE ITEMS (Items 9 -11)
9. ORDINANCE NO.20,109; Z-8165-A: Reclassifying property located along the east
side of Rahling Road, south of Pebble Beach Drive from R-2 and MF-18 to OS, R-2, MF-
18, 0-3 in the City, of Little Rock, Arkansas, amending the Official Zoning Map of the
City of Little Rock, Arkansas; and for other purposes. Planning Commission: 8 yea, 2 nays,
and t abstention. Staff recommends denial.
Synopsis: The owners of 68.93 acres of undeveloped property located along the east side of Rabling
Road, south of Pebble Beach Drive are requesting that the zoning be reclassified from R-2 and MF-
18 to OS, R-2, MF-18, 0-3, and C-3 (with conditions).
Director Wyrick stated that she would have to recuse and leave the room during the
discussion for these items, as her son-in-law is an attorney with the law firm representing
the applicant.
The ordinance was read a first time. Director Adcock made the motion, seconded by
Director Richardson, to suspend the rules and place the ordinance on second reading. By
unanimous voice vote of the Board Members present, the rules were suspended and the
ordinance was read the second time. Director Adcock made a motion, seconded by
Director Cazort, to suspend the rules and place the ordinance on third reading. By
unanimous voice vote of the Board Members present, the rules were suspended and the
ordinance was read the third time.
Bill Spivey: Mr. Spivey stated that he had presented the Board with a letter in which the
applicant outlined three (3) additional more restrictive changes to the uses set forth; in
one case imposing upon the applicant's greater obligation to build traffic calming devices
on the proposed Wellington Plantation Lane. Mr. Spivey asked that the Board consider
the changes as a further amendment.
Director Cazort made the motion, seconded by Director Adcock, to amend the
application, by unanimous voice vote of the Board Members present, the application
was amended.
Tim Daters: Gave an overview of how the plan and the application were developed.
Ernie Peters: Gave an overview of the traffic volumes and patterns in and around the
proposed development.
Vice Mayor Fortson asked where the traffic calming devices that were proposed in the
letter would be located. Mr. Spivey stated that one of the devices would be located at the

intersection of Beckenham Drive and Wellington Plantation Lane; with another located
before Wellington Plantation Lane enters Wellington.
Director Kumpuris asked what were the long-range planning for the streets in question.
Planning & Development Director Tony Bozynski stated that the Master Street Plan
showed both Wellington Plantation Lane and Beckenham Drive intersecting Rahling
Road as collectors; however, what was being proposed was to do away with the two (2)
connections and create one (1) connection with Wellington Plantation Lane intersecting
Rahling Road.
Director Cazort asked if the roads were presently constructed in a way that could connect
both streets to Rahling Road, as the Master Street Plan stated. Mr. Bozynski stated that it
was staff s opinion that the roads could be constructed as stated in the Master Street Plan.
Director Hurst asked for clarification regarding the actual amount of acreage that the
property was originally zoned for and the amount of acreage that the applicant wanted to
achieve through the rezoning. Mr. Spivey stated that at present, there was approximately
twenty (20) acres of MF-18 property that was actually zoned more than twenty (20) years
ago. When the application was filed over a year ago, the applicant proposed an
additional twenty (20) acres of MF-18 tract to the north. After considerable discussion
with the neighborhoods, that request went before the Board of Directors in November
with the request that it be sent back to the Planning Commission to have the northern
MF-18 tract be re -designated as 0-3; General Office. The Planning Commission did
approve the change and at present, there was no increase in the amount of MF-18
acreage; however, the proposal reconfigured the boundaries.
Bill Rector, 4322 I Street: Stated that Planning Commission voted 11-0 in favor of the
application due to the fact that they understood that this was the best way to get the
connections to Rahling Road made. Mr. Rector stated that Master Street Plan needed to
be completed in order for the traffic flow to work best within the City.
Elvin Shuffield: Stated that he represented the joint venture that was selling the property
to Deltic Timber.
Anthony Fulgham, 40 Ledgelawn Drive: Stated that he was the President of the Chenal
Ridge Neighborhood Association, and that Chenal Ridge was the closest neighborhood to
proposed project. Mr. Fulgham stated that initially the Association was opposed to the
proposed multi -family; however, after meeting with the applicant and the changes were
made, the Association supported the project and felt that it would be good for Rahling
Road.
Dick Fletcher, 14 Lorian Drive: Stated that he was a Board Member of the Chenal Ridge
Neighborhood Association and that he felt that with the changes that the applicant had
made, it would be a good development for the area.
Keith Wingfield, 6 Tory Court: Stated that he lived in the Villages of Wellington and he
felt that the applicant listened to the concerns of the neighborhood and made several
changes; therefore, he now supported the proposed project.

Lance Hines 409 Wellinglon. Woods Loo : Stated that he was President of the Villages
of Wellington Property Owner's Association, and that they were the largest neighborhood
that would be affected by the development. Mr. Hines stated that all of the changes were
made on the northern end of the development, and that the majority of the MF-18 was
located near their neighborhood. The Association would like for the MF-18 to be
redirected back on Rahling Road. Mr. Hines stated that the Association sent out a survey
to all the residents and that 91 % of the residents were opposed to the rezoning as a whole.
Mr. Hines stated that the Association met with Deltic in January to voice their concerns;
however, due to the fact that applicant did not address several of their concerns, the
Association did not support the application.
Bud Laumer, 13320 Beckenham Dive: Stated that he was a certified planner and felt
that the Board needed to support Planning Staff s recommendation of denial for the
application and that the City should remain true to the Master Street Plan.
Geoffrey Addison, 6 Wellington Parish Cove: Felt that the aggressive zoning change
would create a hazardous traffic situation for the many children and pedestrians in the
area and urged the Board to vote against the rezoning.
And L&IbL 13501 Beckenham Drive: Stated that he was the President of the Hillsboro
Neighborhood Association and that they were opposed to the rezoning of the property.
Jeff Cook 9 WelliVon Parish Cove: Stated that he was not opposed to the existing
street plan and urged the Board to vote against amending the Master Street Plan and the
proposed rezoning.
Don ChAneL 13900 Beckenham Drive: Stated that he represented the Pleasant Heights
Neighborhood Association and that they felt the design of the plan would increase overall
traffic in the area, and asked that the Board support the Planning Staffs recommendation.
David Fox, 1 Wellington Parish Cove: Stated that he opposed the rezoning of the
property and felt that the Board should support Planning Staff.
Ann Kamps, 13911 Beckenham Drive: Stated that the Board should support the Planning
Staff and the individuals and neighborhoods they represent and vote against the rezoning.
Ruth Bell 7611 Briarwood Drive: Stated that she represented the League of Women
Voters and that the League did not support the proposed rezoning.
David Craft, 130 Wellington Plantation Lane: Complemented the professionalism of the
Planning Staff and urged the Board to vote against the proposed rezoning.
Director Hendrix asked Mr. Bozynski if staff s position had changed with the new
changes proposed by the applicant. Mr. Bozynski stated that staff s position had not
changed and that they did not support the intensity of the development along this segment
of Rattling Road.
Director Kumpuris asked what the estimated costs would be if the City were responsible
for acquisition and construction of the Beckenham Road to collector street standards.
Bill Henry, Public Works Traffic Engineering Manager, stated that the approximate cost
to construct 1,400 feet of roadway would be $600,000, or $400 per foot. Right-of-way
cost at $4.00 per square foot would be approximately $325,000; bringing the total amount
in the range of $1,000,000.

Director Wright made the motion, seconded by Director Hendrix to call the question. By
voice vote, of the Board Members present, the motion to call the question failed.
By roll call vote of the Board Members present, the votes were as follows: Ayes: Hurst;
Kumpuris; Vice Mayor Fortson. Nays: Keck; Adcock; Hendrix; Richardson; Cazort;
and Wright. Recusal: Wyrick. By a vote of 3 ayes, 6 nays, and 1 recusal, the
ordinance failed.
Due to the fact that Item #9 failed, the applicant asked to withdraw Items # 10 & # 11.
Director Keck made the motion, seconded by Director Adcock, to accept the request for
withdrawal. By unanimous voice vote of the Board Members present, the request for
withdrawal was granted.
10. ORDINANCE; MSP-08-01: To amend the Master Street Plan (19,152) realigning
Beckenham Drive to Wellington Plantation, prior to connection with Rahling Road; and
for other purposes. Planning Commission: 11 yeas, 0 nays. Staf"recommends denial.
Synopsis: A Master Street Plan Amendment (MSP08-01) to realign Beckenham Drive (Collector) to
intersect with Wellington Plantation (Collector) prior to either connection with Rahling Road
(Arterial), resulting in only one (1) connection to Rahling Road.
Item was withdrawn by applicant.
11. ORDINANCE;_LU08-19-02: To amend the Land Use Plan (16,222) in the Chenal
Planning District from Residential Low Density and Residential Medium Density to
Commercial, Office, Residential High Density, Residential Low Density and Open
Space; and for other purposes. Planning Commission: 8 ayes, 2 nays. Staffrecommends denial.
Synopsis: A Land Use Plan Amendment in the Chenal Planning District from Single Family and
Low Density, Residential Medium Density to Commercial, Office, Residential High Density,
Residential Low Density and Open Space.
Item was withdrawn by applicant.
PUBLIC HEARING (Item 10)
12. PUBLIC HEARING & RESOLUTION; Z-1703-A: Rescinding the Planning
Commission's action denying a Conditional Use Permit to allow retail sales and Special
Event Center in the exiting building on the I-2 and C-4 zoned property located at 3224
Mabelvale Pike. Planning Commission: 0 ayes, 8 nays, 2 absent. Staff recommends denial.
Synopsis: The applicant is appealing the Planning Commission's denial of a Conditional Use Permit
to allow a retail sales and a special event center in the existing building on the I-2 and C-4 zoned
property located at 3224 Mabelvale Pike.
Mayor Stodola opened the public hearing and asked if there was anyone present that
desired to speak to the issue.

Michael Vick 4316 West 24'h Street: Stated that he was in support of the proposed
development.
GgU Shorter: Stated that he was the applicant for the proposed project and asked for the
Board's support.
Tony Woods: Stated that he was Mr. Shorter's partner in the project and that they
wanted to enhance the community and provide the individuals in the area with a location
that to hold special events.
Director Richardson asked the applicant if they had plans to pave the gravel lot for the
addition of more parking. Mr. Woods stated that currently, they had enough parking;
however, they did plan to pave the lot if the application were approved.
Nakia Preston, 5420 West 33'd Street: Stated that she lived in the neighborhood and was
supportive of the proposed project.
Ron Copeland. 2801 South University: Stated that he was the Director of the University
Partnership District, which was a program to develop the areas around the University of
Arkansas at Little Rock (UALR), and that the District did not support the application.
Mayor Stodola closed the public hearing.
The applicants asked that the application be withdrawn.
Director Cazort made the motion, seconded by Director Richardson, to accept the request
for withdrawal. By unanimous voice vote of the Board Members present, the request
for withdrawal was granted.
CITIZEN'S COMMUNICATION
There were no individuals present that wanted to address the Board during Citizen's
Communication.
Director Keck made the motion, seconded by Director Cazort, to adjourn the meeting.

Road as collectors; however, what was being proposed was to do away with the two (2)
connections and create one (1) connection with Wellington Plantation Lane intersecting
Rahling Road.
Director Cazort asked if the roads were presently constructed in a way that could connect
both streets to Rahling Road, as the Master Street Plan stated. Mr. Bozynski stated that it
was staff s opinion that the roads could be constructed as stated in the Master Street Plan.
Director Hurst asked for clarification regarding the actual amount of acreage that the
property was originally zoned for and the amount of acreage that the applicant wanted to
achieve through the rezoning. Mr. Spivey stated that at present, there was approximately
twenty (20) acres of MF-18 property that was actually zoned more than twenty (20) years
ago. When the application was filed over a year ago, the applicant proposed an
additional twenty (20) acres of MF-18 tract to the north. After considerable discussion
with the neighborhoods, that request went before the Board of Directors in November
with the request that it be sent back to the Planning Commission to have the northern
MF-18 tract be re -designated as 0-3; General Office. The Planning Commission did
approve the change and at present, there was no increase in the amount of MF-18
acreage; however, the proposal reconfigured the boundaries.
Bill hector, 4322 1 Street: Stated that Planning Commission voted 11-0 in favor of the
application due to the fact that they understood that this was the best way to get the
connections to Rahling Road made. Mr. Rector stated that Master Street Plan needed to
be completed in order for the traffic flow to work best within the City.
Elvin Shuff`ield: Stated that he represented the joint venture that was selling the property
to Deltic Timber.
Anthony Fulgh40 Ledgelawn Drive: Stated that he was the President of the Chenal
Ridge Neighborhood Association, and that Chenal Ridge was the closest neighborhood to
proposed project. Mr. Fulgham stated that initially the Association was opposed to the
proposed multi -family; however, after meeting with the applicant and the changes were
made, the Association supported the project and felt that it would be good for Rahling
Road.
Dick Fletcher, 14 Lorian Drive: Stated that he was a Board Member of the Chenal Ridge
Neighborhood Association and that he felt that with the changes that the applicant had
made, it would be a good development for the area.
Keith Win f6eld, 6 Tory Court: Stated that he lived in the Villages of Wellington and he
felt that the applicant listened to the concerns of the neighborhood and made several
changes; therefore, he now supported the proposed project.

Lance Hines 409 Wellinglon Woods Loo : Stated that he was President of the Villages
of Wellington Property Owner's Association, and that they were the largest neighborhood
that would be affected by the development. Mr. Hines stated that all of the changes were
made on the northern end of the development, and that the majority of the MF-18 was
located near their neighborhood. The Association would like for the MF-18 to be
redirected back on Rahling Road. Mr. Hines stated that the Association sent out a survey
to all the residents and that 9 1 % of the residents were opposed to the rezoning as a whole.
Mr. Hines stated that the Association met with Deltic in January to voice their concerns;
however, due to the fact that applicant did not address several of their concerns, the
Association did not support the application.
Bud Laumer, 13320 Beckenham Drive: Stated that he was a certified planner and felt
that the Board needed to support Planning Staffs recommendation of denial for the
application and that the City should remain true to the Master Street Plan.
Geoffrey Addison, 6 Wellington Parish Cove: Felt that the aggressive zoning change
would create a hazardous traffic situation for the many children and pedestrians in the
area and urged the Board to vote against the rezoning.
Andy Lqi& 13501 Beckenham Drive: Stated that he was the President of the Hillsboro
Neighborhood Association and that they were opposed to the rezoning of the property.
Jeff Cook, 9 Wellington Parish Cove: Stated that he was not opposed to the existing
street plan and urged the Board to vote against amending the Master Street Plan and the
proposed rezoning.
Don ChdneL 13900 Beckenham Drive: Stated that he represented the Pleasant Heights
Neighborhood Association and that they felt the design of the plan would increase overall
traffic in the area, and asked that the Board support the Planning Staff's recommendation.
David Fox, 1 Weilin on Parish Cove: Stated that he opposed the rezoning of the
property and felt that the Board should support Planning Staff.
Ann Kamps, 13911 Beckenham Drive: Stated that the Board should support the Planning
Staff and the individuals and neighborhoods they represent and vote against the rezoning.
Ruth Bell, 7611 Briarwood Drive: Stated that she represented the League of Women
Voters and that the League did not support the proposed rezoning.
David Cra 130 Wellin on Plantation Lane: Complemented the professionalism of the
Planning Staff and urged the Board to vote against the proposed rezoning.
Director Hendrix asked Mr. Bozynski if staff's position had changed with the new
changes proposed by the applicant. Mr. Bozynski stated that staffs position had not
changed and that they did not support the intensity of the development along this segment
of Rahling Road.
Director Kumpuris asked what the estimated costs would be if the City were responsible
for acquisition and construction of the Beckenham Road to collector street standards.
Bill Henry, Public Works Traffic Engineering Manager, stated that the approximate cost
to construct 1,400 feet of roadway would be $600,000, or $400 per foot. Right-of-way
cost at $4.00 per square foot would be approximately $325,000; bringing the total amount
in the range of $1,000,000.

wanted to enhance the community and provide the individuals in the area with a location
that to hold special events.
Director Richardson asked the applicant if they had plans to pave the gravel lot for the
addition of more parking. Mr. Woods stated that currently, they had enough parking;
however, they did plan to pave the lot if the application were approved.
Nakia Preston, 5420 West 33'd Street: Stated that she lived in the neighborhood and was
supportive of the proposed project.
Ron Copeland, 2801 South University: Stated that he was the Director of the University
Partnership District, which was a program to develop the areas around the University of
Arkansas at Little Rock (UALR), and that the District did not support the application.
Mayor Stodola closed the public hearing.
The applicants asked that the application be withdrawn.

PARTICIPATION additional conditions to the original application on April 2,

All owners of property located within 200 feet of the site,
all residents within 300 feet who could be identified, and

Neighborhood Associations were notified of the public
hearings. Additionally, all registered objectors to the
original application were notified of the April 2, 2009
public hearing.
BACKGROUND On October 2, 2008, the Planning Commission approved a
rezoning application for 68.93 acres of property located
along the east side of Rahling Road, south of Pebble Beach
Drive. The approved rezoning was from R-2 and MF-18 to
OS, R-2, MF-18, 0-3 and C-3. The proposed rezoning
was divided into 14 areas, as described in the attached
October 2, 2008 Planning Commission minute record.
Prior to action on the application by the Board of
Directors, the applicant revised the application for 20.30
acres of the property, noted as "Area 2" in the attached
minute record and sketches. The Planning Commission
approved this 20.30 acres for a rezoning from "R-2" Single
Family District to "MF-18" Multifamily District. The
applicant amended the request to a rezoning from "R-2" to
"0-3" General Office District for the 20.30 acres labeled as
"Area 2". The Board of Directors sent the revised
application back to the Planning Commission for
reconsideration.
The revised application was placed on the February 5,
2009 Planning Commission agenda. Prior to the meeting,
the applicant made further revisions to the application by
proposing additional restrictions/conditions on the
proposed rezonings. The restrictions/conditions are
outlined in a document submitted by the applicant dated
January 28, 2009, and noted as "Exhibit A" in the attached
proposed ordinance.

CONTINUED
On February 5, 2009 the Planning Commission conducted
a public hearing on the revised application. On advice of
the Deputy City Attorney present, the Commission
considered the entire application as a revised application.
The Commission voted to recommend denial of the revised
application.
The City Attorney's Office later ruled that the February 5,
2009 Planning Commission action was inappropriate. It is
the City Attorney's opinion that only the revisions to the
previously approved application should have been
considered and not the entire application. Therefore, the
revisions to the application were sent to the Planning
Commission for reconsideration as follows:
1. Proposed rezoning of "Area 2" (20.30 acres) to
"0-3" instead of the previously approved "MF-18".
2. Proposed additional restrictions/conditions placed
on the property as outlined in the document from
John William Spivey, III (Wright, Lindsey and
Jennings, LLP) dated January 28, 2009. Copy of
document attached an "Exhibit A" in the proposed
ordinance.
On April 2, 2009 the Planning Commission conducted a
second public hearing on the revised application. The
Commission approved the revised application as noted
above. The April 2, 2009 Planning Commission minute
record is attached for Board review.
Staff did not support the original application, and as such
could not support a revised application. Staff believes it is
most appropriate for this property to develop as it is
currently zoned (R-2 and MF-18). Several streets within
adjacent developed single family residential neighborhoods
currently "stub out" at the boundary of this property.
These streets include Lorian Drive and Levant Drive to the
north, Bradbury Drive and Beckenham Drive to the east
and Wellington Plantation Drive and Wellington Plantation
Lane to the south. Staff believes continuation of these
streets into the subject property, with additional single
family residential development, would be the best use of

the property. A portion of the property (with the south
half) is currently zoned MF-18, and a future development
of this property would take access from Rahling Road or
an extension of Wellington Plantation Drive. Additionally,
there is a large amount of undeveloped property, currently
zoned for Multifamily, Office and Commercial
development, within the nearby Chenal Parkway and
Highway 10 vicinity. Staff feels that additional
Multifamily, Office and Commercial zoning along this
section of Rahling Road which is more single family
residential in nature, would be detrimental to the existing
neighborhoods, creating additional traffic and a level of
noise and light pollution which should not be introduced
into this area.

No other proposed amendments or modifications to Item MSP08-01 have been offered nor are
any presented for further consideration in this communication.
II. Items Z-8165-A and LU08-19-02 were essentially considered together at the October 2,
2008 meeting. Prior to the October 2, 2008 Planning Commission meeting, the Applicant
voluntarily amended its application to eliminate certain "permitted" uses and "conditional"
uses from those otherwise allowable in the "C-3" zone for which approval was sought from the
Planning Commission. A list of the remaining uses was submitted to you at the October 2,
2008 Planning Commission meeting, and was made a part of the item as approved by the
Commission.
1. As a result of the Applicant's continuing discussions with members of the
neighborhoods and representatives of the CRPOA, we have learned that among the most
important concerns of the neighbors is that no "big box" uses or developments that could yield
high traffic volume be located within the "C-3" or "0-3" areas. After exploring and discussing
these concerns with representatives of the CRPOA we have prepared a further modification to
the list of "permitted" and "conditional" uses and added certain other limitations upon
development within the "C-3" and "0-3" areas and seek now to further amend the application
to be consistent with these further modifications. Attached as part of this letter as Exhibit "A"
is a copy of the "C-3" permitted and conditional uses which has been marked to illustrate the
Applicant's initial voluntary limitations and to show those further limitations to uses in the "C-
3" zone. The list of those permitted and conditional uses which were voluntarily eliminated as
part of the application approved at the October 2, 2008, meeting are shown in Exhibit "A"
with a "single strike through line." In addition to the uses which were initially voluntarily
eliminated by the Applicant, a further list of changes is highlighted with a "double strike
through line" along with certain further limitations which have voluntarily been agreed to by
the Applicant.

We are attorneys for the Applicants ("Applicant") in connection with the above identified items
and we are contacting you today on their behalf. At the October 2, 2008, Regular Meeting of
Little Rock Planning Commission, the above identified items were presented for your
consideration. All three items were approved by a majority of the Commission. Subsequent to
Commission approval, and following continuing discussions with members of various property
owners' associations and individual residents, Items Z-8165-A and Item LU08-19-02 were
referred back to the Commission, at the request of the Applicant, by the City Board of
Directors for consideration of an amendment to the pending application. In short, the
amendment requests revision of the currently approved "MF18" zoning for the approximate 20
acre tract in the northern portion of the overall 134 acre parcel to an "0-3" designation. This
matter was scheduled to come before the Commission at its meeting on December 18, 2008,
however the Applicant sought and received approval for deferral when it learned that only
seven members of the Commission would attend the December 8, 2008 meeting.
Prior to the December 8, 2008 meeting, and in the weeks since that time, the Applicant has
continued its discussions with members of the nearby neighborhoods and, more specifically,
the Chenal Ridge Property Owner's Association ("CRPOA"), and has reached a set of

understandings with the CRPOA which will result in the CRPOA's endorsement of the pending
application, subject to further modifications.
Discussions with at least one other POA are ongoing and it is the Applicant's hope that further
understandings may be reached ultimately with that POA. The purpose of this letter is to
outline for the Commission the commitments which have previously been made by the
Applicant and the additional agreements reached through further negotiations and discussions
with the CRPOA. In the following paragraphs we will outline these modifications for your
further consideration.
I. First, we will address item MSP08-01, which was approved by a unanimous vote of
Commission on October 2, 2008, and for which no subsequent amendments or modifications
are sought. At the October 2, 2008 meeting, the Applicant submitted three commitments to the
City which were read into the record and were made a part of the application at the request of
the Applicant. These commitments included, as they were read into the record on October 2,
2008, the following:
441.
1. To immediately commence the design for Beckenham, Wellington Plantation
and the completion of Rahling Road adjacent to the subject property and will commence
construction of all streets, stormdrainage and related infrastructure as soon as practically
possible allowing for all necessary governmental approvals.
442. To contribute up to $325,000 for construction of the portion of Beckenham
outside of the subject property upon conditions that:
(a) the City acquire the right-of-way for that portion of the street; and
(b) the City cooperate with Deltic in the design and approval of plans for
Beckenham such that construction of the entire street and related infrastructure may be
accomplished as a part of a single project thus resulting in cost savings through the
design, engineering and simultaneous construction of the entire street and related
infrastructure.
643. To include as part of the Master Street Plan construction and installation of
traffic signals at the intersection of Beckenham/Plantation Drives and Rahling Road." (In
subsequent discussion at the October 2, 2008 meeting, it was mentioned that the City's Public
Works' staff might prefer to install a traffic circle at the intersection of Beckenham/Plantation
Drives and Rahling Road instead of traffic signals. The Applicant agreed that it would include
construction of a traffic circle in lieu of traffic signals at that location, if requested by the
City.)

No other proposed amendments or modifications to Item MSP08-01 have been offered nor are
any presented for further consideration in this communication.
II. Items Z-8165-A and LU08-19-02 were essentially considered together at the October 2,
2008 meeting. Prior to the October 2, 2008 Planning Commission meeting, the Applicant
voluntarily amended its application to eliminate certain "permitted" uses and "conditional"
uses from those otherwise allowable in the "C-3" zone for which approval was sought from the
Planning Commission. A list of the remaining uses was submitted to you at the October 2,
2008 Planning Commission meeting, and was made a part of the item as approved by the
Commission.
1. As a result of the Applicant's continuing discussions with members of the
neighborhoods and representatives of the CRPOA, we have learned that among the most
important concerns of the neighbors is that no "big box" uses or developments that could yield
high traffic volume be located within the "C-3" or "0-3" areas. After exploring and discussing
these concerns with representatives of the CRPOA we have prepared a further modification to
the list of "permitted" and "conditional" uses and added certain other limitations upon
development within the "C-3" and "0-3" areas and seek now to further amend the application
to be consistent with these further modifications. Attached as part of this letter as Exhibit "A"
is a copy of the "C-3" permitted and conditional uses which has been marked to illustrate the
Applicant's initial voluntary limitations and to show those further limitations to uses in the "C-
3" zone. The list of those permitted and conditional uses which were voluntarily eliminated as
part of the application approved at the October 2, 2008, meeting are shown in Exhibit "A"
with a "single strike through line." In addition to the uses which were initially voluntarily
eliminated by the Applicant, a further list of changes is highlighted with a "double strike
through line" along with certain further limitations which have voluntarily been agreed to by
the Applicant.
The additional limitations in the C-3 zone may be summarized as follows:
The Applicant has agreed to eliminate the following additional "permitted" uses:
Item h. Bar, lounge or tavern;
Item q. Cigar or tobacco stores uses are eliminated but the "candy store" use remains;

To the list of conditional uses in the "C-3" zone, the Applicant voluntarily agrees to add "Item
x. Convenience food store with gas pumps," which would otherwise be a "permitted use."

From the list of conditional uses in the "C-3" zone, the Applicant agrees to eliminate the
following:
Item i. Home Center; and
Item j. Eating place with drive-in service.
In addition to the "use" limitations outlined above, the Applicant also commits that no single
retail use will exceed 20,000 square feet. The Applicant believes that this limitation evidences
its recognition and intention that the proposed future development be compatible with the
existing neighborhoods surrounding the area.
2. With regard to those areas previously designated "0-3" and the area formerly
designated as "MF18" for which the Applicant seeks an amendment to "0-3," the Applicant
submits Exhibit "B" which shows a list of uses in the "0-3" zones which it has voluntarily
agreed to eliminate from the "permitted," "conditional" and "accessory" uses. These items
are shown on the attached list with a "double strike through line." Applicant has also agreed
that "Item z. School (business)"; and "Item aa. School (public or denominational)" will
become "conditional" uses instead of "permitted" uses.
In addition, the Applicant has agreed that the footprint of any single building will not be more
than 20,000 square feet and that no structure in any of the "0-3" zones will exceed three
stories in height.
III. In addition to the limitations set forth in Section II above, the applicant has further
agreed to or acknowledges the following development criteria, limitations or provisions which
shall apply to the various tracts, as appropriate:
1. All 66C-3," "0-3" and "MF18" tracts adjacent to the single family residential
tracts, shall include and comply with the City landscaping ordinance including, without
limitation, construction of landscaping buffers around the perimeters of each as provided in the
City's zoning code.
2. Access to the "MF18" property will be limited to access directly from Rahling
or through the adjacent "C-3" or "0-3" areas. There will be no direct access from Wellington
Plantation Drive unless the City requires an emergency or secondary entrance to the property
from Wellington Plantation Drive.
3. All commercial, office and multifamily tracts within the overall development
will be subject to site plan review by the City.

4. The Chenal Valley Commercial Bill of Assurance will be extended to cover all
commercial, office and multifamily areas to insure the appropriate architectural review and
approval as in all other commercial, office and multifamily areas within Chenal Valley.
5. All commercial, office and multifamily tracts will be covered by the Chenal
Valley Property Owners' Association to insure that each is maintained and operated in a
manner consistent with Chenal POA standards.
6. Deltic agrees to restrict all R-2 areas to single family residential use by
restrictive covenants or other appropriate method.
7. With respect to Deltic property west of Rahling Road, Deltic commits that
except for streets on the Master Street Plan, no neighborhoods lying west of Rahling Road will
be connected to Rahling Road adjacent to the subject property and extending north to Pebble
Beach.
8. The Applicant will fund and construct all necessary drainage and detention
infrastructure along Rahling, Beckenham and Wellington Plantation through the subject 134
acres.
These agreements are offered in good faith and as further measure of the Applicant's intention
to recognize the need to carefully monitor development within the subject 134 acre tract.
Please consider this the Applicant's request for amendment of its pending application in
recognition that all requested uses and further modifications are less intense than the
applications as approved by the Planning Commission at its October 2, 2008, meeting.

Sec. 36-301. C-3 General commercial district.
(a) Purpose and intent. The C-3 general commercial district shall be applied to the
broad range of retail uses which comprise the commercial function of the city including
groupings of freestanding commercial structures. This section applies to such district.
Permitted uses include most types of retail activity except those involving open displays
of merchandise and those which generate large volumes of vehicular traffic or are
otherwise incompatible with the purpose and intent of the C-3 general commercial
district. Retail areas zoned C-3 general commercial shall be generally concentrated as
to geographical configuration. It is anticipated, however, that in some situations,
change to another commercial or office classification may be appropriate to permit the
transition of strip retail areas to other productive forms of land use. It is the intent of
these regulations that the C-3 district be concentrated at the intersection of arterial
streets. Extension of this district along major arterial streets in linear fashion shall be
discouraged. Outdoor display of merchandise is allowed under carefully controlled
conditions.
(b) Development criteria. All commercial uses shall be restricted to closed buildings,
except parking lots, seasonal and temporary sales per section 36-298.4, and the normal
pump island services of service station operations. In addition, outdoor display of
merchandise is allowed in an area equal to one-half ( 1/2) of the facade area of the front
of the building. Certain seasonal or special event sales may be allowed when the owner
has requested a permit for such activity in conjunction with the privilege license
application. The permitting authority shall review the owner's plan or placement of
merchandise in order to assure that obstruction of drives, walks, required parking and
fire lanes does not occur. In no case shall full-time static open display be permitted.

to "OS" Open Space District, "R-2" Single Family

The rezoning is proposed for future development of the
property. The 68.93 acres proposed for rezoning is
comprised of 14 areas within the property. Following is a

acres located along the east side of Rahling Road, south of
Pebble Beach Drive. As noted above 68.93 acres is
proposed to be rezoned, leaving 58.49 acres of existing R-2

proposed rezoning will result in the following zonings for

The property is currently undeveloped and wooded. The
property has varying degrees of topography throughout the
site.
There is undeveloped R-2 zoned property immediately
north, south and east (same ownership) of the 68.93 acres
proposed for rezoning. Single family residences are
located further north, south and east. There is undeveloped
property, zoned OS and R-2 located across Rahling Road
to the west. Multifamily developments are located further
west near the Rahling Road/Kirk Road intersection. There
are other non-residential uses also further west along
Rahling Road.
The City's Future Land Use Plan designates the 68.93
acres as Single Family and Low Density Residential. A
proposed Land Use Plan amendment to Multifamily,
Commercial, Office, Single Family and Park/Open Space
is a separate item on this agenda. The applicant has also
requested a Master Street Plan amendment to realign
Wellington Plantation Drive and Beckenham Drive. This
is also a separate item on this agenda.
Staff is not supportive of the requested rezoning. Staff
believes it is most appropriate for this property to develop
as it is currently zoned (R-2 and MF-18). Several streets
within adjacent developed single family residential
neighborhoods currently "stub out" at the boundary of this
property. These streets include Lorian Drive and Levant
Drive to the north, Bradbury Drive and Beckenham Drive
to the east and Wellington Plantation Drive and Wellington
Plantation Lane to the south. Staff believes continuation of
these streets into the subject property, with additional
single family residential development, would be the best
use of the property. A portion of the property (within the

south half) is currently zoned MF-18, and a future
development of this property would take access from
Rahling Road or an extension of Wellington Plantation
Drive. Additionally, there is a large amount of
undeveloped property, currently zoned for Multifamily,
Office and Commercial development, within the nearby
Chenal Parkway and Highway 10 vicinity. Staff feels that
additional Multifamily, Office and Commercial zoning
along this section of Rahling Road which is more single
family residential in nature, would be detrimental to the
existing neighborhoods, creating additional traffic and a
level of noise and light pollution which should not be
introduced into this area.
Prior to the October 2, 2008 Planning Commission public
hearing, the applicant revised the application by adding
two (2) conditions to the proposed rezoning. The
conditions are as follows:
1. The proposed multifamily, office and commercial
zoning will require site plan review approval by the
Planning Commission.
2. Certain "permitted" and "conditional" uses (as
found in Section 36-301 of the Code) for the
proposed areas of C-3 zoning will be eliminated
from the use lists.
A list of the uses to be eliminated is shown as "Exhibit A"
within the attached rezoning ordinance.

sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not affect the remaining portions of
the ordinance which shall remain in full force and effect as if the portion so declared or
adjudged invalid or unconstitutional was not originally a part of the ordinance.
SECTION 6. Repealer. All laws, ordinances, resolutions, or parts of the same,
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
