(Z-8142-A) Submitted by: Planning & Development SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION Action Required 1 Approved By Ordinance Resolution Approval Information Report Bruce Moore The owner of the 20.455 acre property located on the west side of Shackleford Road, approximately '/ mile north of Colonel Glenn Road, is requesting that the zoning be reclassified from R-2 to MF-18. None Approval of the Ordinance. The Planning Commission reviewed this issue at its February 24, 2011 meeting. There were no objectors present. All owners of property located within 200 feet of the site, all residents within 300 feet who could be identified, and the John Barrow Neighborhood Association were notified of the rezoning request. The Commission voted, as part of the Consent Agenda, to recommend approval of the rezoning. The vote was 11 ayes, 0 nays, and 0 absent. BACKGROUND LBI, Inc., owner of the 20.455 acre property located on the west side of Shackleford Road, approximately '/ mile north of Colonel Glenn Road, is requesting to rezone the property from "R-2" Single Family District to "MF-18" Multifamily District. The rezoning is proposed to allow future multifamily development of the property. The property is currently undeveloped and mostly wooded. The property has varying degrees of slope. Most of the property is at a higher elevation than Shackleford Road. Portions of the property have recently been cleared of trees. A Land Alteration Variance was approved on May 20, 2010 for the clearing and replanting of trees. The general area contains a mixture of uses and zoning. Undeveloped property (zoned R-2 and 0-2) is located north and west of the subject property. A large mobile home park and office warehouse development are located across Shackleford Road to the east. A mini -warehouse development and office warehouses are located to the south. Additional commercial and light industrial uses are located to the east and west along the Colonel Glenn Road corridor. The City's Future Land Use Plan designates this property as Residential High Density. The requested MF-18 zoning does not require a Land Use Plan Amendment. Staff is supportive of the requested rezoning to MF-18. Staff views the request as reasonable. Staff feels that a multifamily development will be a nice addition to the existing use mix in this area near the intersection of I-430 and Colonel Glenn Road. With the growing commercial developments to the west and north (Shackleford Crossings), a multifamily development with the potential of 360 units will aid in supporting these developments. Our opinion is the same as it has been for many years. This area doesn't need more apartment complexes to help create new problems to an already existing one with approximately 6 complexes already within a 5 mile radius of 36th & John Barrow Roads, and a new apartment development is underway at Shackelford Crossing which is less than 3 miles from this proposed development. The trailer park directly to the east of this propety has given us lots of headaches in the past and with the addition of apartments who knows what may arise We encourage new development in our area, however, not the type that will only service a hand full of people and pose more problems for an area in transition. No contact has been made with the neighborhood Association and we were unaware of this application until we received information from the planning department. We request your support in denying this application, or ask applicant to defer until we can meet with them at our March meeting.
