BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,ARKANSAS. SECTION 1. That the zone classification of the following property be and is hereby changed as indicated: Z-8141 — Described as part of the NE `/4 SW `/4 of Section 16, T-1-N, R-13-W, Pulaski County, Arkansas more particularly described as follows: Commencing at the NE corner of said NE `/4 SW `/4, Section 16; thence N87055'00"W, 409.00 feet to the point of beginning; thence SO1°07'04"W, 416.00 feet; thence N87°37' 13"W, 214.06 feet; thence NO1 °03' 15"E, 414.90 feet; thence S87°55'00"E, 214.50 feet to the Point of Beginning, containing 89,005 sq. ft. or 2.0433 acres more or less: From "R-2" Single Family District to "0-3" General Office District. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. (Z-8141) Submitted by: Planning & Development SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION Action Required I Approved By Ordinance Resolution Approval Information Report Bruce Moore The owner of the 2.04 acre property located at 11701 West 36th Street is requesting that the zoning be reclassified from "R-2" Single Family District to "0-3" General Office District. I None Approval of the Ordinance. The Planning Commission reviewed this issue at its December 21, 2006 meeting. There were no objectors present. All owners of property located within 200 feet of the site, all residents within 300 feet who could be identified, and the John Barrow Neighborhood Association were notified of the public hearing. The Commission voted, as part of the Consent Agenda, to recommend approval of the rezoning. The vote was 11 ayes, 0 nays and 0 absent. BACKGROUND Pauline Myers, owner of the 2.04 acres located at 11701 West 36th Street, is requesting to rezone the property from "R-2" Single Family District to "0-3" General Office District. The rezoning is proposed to utilize the existing residential structure as an office use. There is currently a one-story rock and frame single family residential structure located within the south half of the property. There are several accessory buildings (garage and barn -type structure) located on the east and south sides of the residential structure. The general area contains a mixture of zoning and a large amount of undeveloped property. The Church at Rock Creek development and undeveloped R-2 zoned property are located across West 36th Street to the north and northeast. There are two (2) single family residences in front of the church property along the north side of West 36th Street. There are single family residences on large lots to _the east and west, with undeveloped R-2 and MF-12 zoned property further east. Undeveloped OS, R- 2 and C-2 zoned property is located to the south. The City's Future Land Use Plan designates this property as "Mixed Office Commercial". The requested 0-3 zoning does not require an amendment to the Land Use Plan. Staff is supportive of the requested zoning. Staff views the request as reasonable. The church property to the north is zoned POD. One (1) of the residential structure in front of the church was recently rezoned to 0-3. There is also a large 0-2 zoned tract to the west, at the intersection of West 36`i' Street and Bowman Road. Staff believes rezoning this 2.04 acre property to 0-3 and continuing the office zoning pattern in this immediate area will have no adverse impact on the adjacent properties or the general area. 2 ORDINANCE NO.
