Donna, As you alluded to since the time the floodway variance was recommended for approval by staff, the Public Works Director has changed and I do not think staff would recommend approval of the same floodway variance. In addition to the variance, please remember that the new addition to the structure must be constructed to comply with the current floodplain regulations. In other words, the top of the finished floor of the new addition must be elevated to at least 1 ft above the base flood elevation. Pertaining to the existing structure, if the cost of the improvements or renovations to the existing structure is 50% or more of the existing structure's value then the existing structure will be determined to be substantially improved as defined by FEMA which will result in the entire structure being required to be retrofitted to comply to the current floodplain regulations. Importance: High Donna Following up on our conversation this morning: I represent a group who is considering purchasing the subject property as an investment and has it under a conditional contract. The group would close in December or January, then immediately make some cosmetic improvements, including: New flooring throughout New paint throughout (interior and exterior) New cooling to bring it to "Central Heat and Air" New roof if necessary The plan would be to immediately put the property back on the market For Lease in hopes of finding either: A. A tenant who would use the property as a residence in the interim, until such time as we find an office user who will lease or buy the property. B. An office tenant who would use the property as is, without the full retrofit that is contemplated in the current PDO. We would want the right to keep the PDO in place until we found the long term office user, and at that time would want the right to expand the parking to the rear (adding the 4 new spaces in the flood way) and do the other improvements outlined in the PDO (possible expansion of the building to the west up to 730 SF, tear off the east side carport and storage shed, plus the NE corner of the structure. Will you check with the powers that be as to whether that plan is possible, or whether it would not be possible for any reason? You mentioned some concerns: 1. That placing the property back in residential use might void the existing PDO. 2. That allowing the current PDO to lapse might change the ability to allow parking in the flood way in the future.
