Dear Monte:
On behalf of Ladley & Jesha Abraham, we are submitting a request for a variance of the
front building line of 25'-0" for the property located at Lot 41, Hickory Creek Subdivision,
Phase I. The existing lot is located at the end of a cul-de-sac and is a vacant lot. We propose
a new single-family house with an attached open but covered porte-cochere. The north
portion of the proposed porte-cochere encroaches within the 25'-0" building line
approximately 6'-0" and the south portion of the porte-cochere encroaches within the 25'-0"
building line approximately 8'-0". Due to the unusual shape of the lot and the client's
desire to have a circular driveway, we propose this location for the porte-cochere. It is not
uncommon to have a circular driveway in this subdivision.
In the Bill of Assurance of Hickory Creek Subdivision, Little Rock, Arkansas, it states that
no principal dwelling shall be located on any lot nearer than 25 feet from the rear lot line.
The proposed single-family residence meets this guideline.
The proposed plans and location of the porte-cochere have been reviewed and approved by
the Hickory Creek Property Owner's Association. The attached documentation shows the
signatures for approval dated October 4, 2005. If more information is needed, please

After several revisions to assure oonfwmity with the neighborhood's architectural style, the iTIc3.ory Creek
Property Owners Board appf oved a set of pians for this house. However, in our con 9ideraoon, all of our
discussions with Cho owner and builder cantered on house design and we did not consider any
encroachment in the 25 foot setback requirement.
Hickory Creek has always insisted that homes constructed here comply with the 25 foot setback
requirement which is in our Bill of Assurance as well as in city code regulations. In fact, we have, in the
Past two years, had to resort to legal means to require that M'o proposed residences remove footings that
had been poured in violation of setb>a & mirwnums.
Neighbors on both sides of the proposed house have houses with approximately 40 foot and 60 foot
setbacks respectively and have objected to the proposed variance. They will appear ed your meeting today.

We have received notice of the hearing for 404 Hickoy Creek Ct. (HCC) seekuig s set
bank variance of six feet from the required 25 feet. We are opposed to this variance and
wish to register as strong a statement as possible against this request. Our home at 402
HCC sets back 46 feet from the curb whereas the neighbor's home, 405 Hickory Creek
Ct., sets back 72 feet from the curb_
The stag$estiori that the other hcme wouid be sited between our homes within 19 f"x of
the curb would simply overwhelm the cui de sac and the appearance of the neighborhood.
We have attached pictures of both the existing home, and the proposed setback for 404
HCC. It is clear that both existing homes would not be in view of each other but would
be limited to the view of the proposed home and its proximity to the curb. We ftel this
variance will haN e a significant impact on the future value of our borne and the current
aesthetics of our neighborhood.

After much thought and consideration, w� have decided that we must oppose the request
for the zoning varinnet for a reduced from yard set back from the curb to rhe front of the
structure un the home to i'+a built at 404 Hickory Creek Court Southeast, Little Rack,
Arkansas.
We want to snake it clear that we do not wish to Create a negative impact for our future
neighbors.
However, the house located at 402 Hickory Creek Court Southeast is approximately 46
feet from the curb to the closest part of the sauc=e. My hoam is alapmximawly 72 feet
from the curb to the closest pant of the structure. It seems by allowing a variance to begin
a structure approximately 18 to 19 feet froze the curb when the homes directly on either
side are more than 20 feet further back from the curb would be visually out of place.
Also, tht variance as requested is to place a parte-cohare in front of their home at 404
Hickory Creek Court Southeast Thus, if the variance wis denied to accommodate the
porte•ooherc, itwould ould not adversely affect the ability of the landowner to bald a home
on the lol nor would it negatively impact the amount of living space (square footage) as
planned by the landowner.

Dear Monte:
On behalf of Ladley & Jesha Abraham, we are submitting a request for a variance of the
front building line of 25'-0" for the property located at Lot 41, Hickory Creek Subdivision,
Phase I. The existing lot is located at the end of a cul-de-sac and is a vacant lot. We propose
a new single-family house with an attached open but covered porte-cochere. The north
portion of the proposed porte-cochere encroaches within the 25'-0" building line
approximately 6'-0" and the south portion of the porte-cochere encroaches within the 25'-0"
building line approximately W-0". Due to the unusual shape of the lot and the client's
desire to have a circular driveway, we propose this location for the porte-cochere. It is not
uncommon to have a circular driveway in this subdivision.
In the Bill of Assurance of Hickory Creek Subdivision, Little Rock, Arkansas, it states that
no principal dwelling shall be located on any lot nearer than 25 feet from the rear lot line.
The proposed single-family residence meets this guideline.
The proposed plans and location of the porte-cochere have been reviewed and approved by
the Hickory Creek Property Owner's Association. The attached documentation shows the
signatures for approval dated October 4, 2005. If more information is needed, please

Hickory Creek has always insisted that homes constructed here comply with the 25 foot setback
requirement which is in our Bill of Assurance as well as in city code regulations. In fact, we have, in the
past two years, had to resort to legal means to require that two propowd residences remove footings that
had been poured in violation of setback minimums.
Neighbors on both sides of the proposed house have houses with appro>; iwav ly 40 foot and 60 foot
setbacks respectively and have objected to the proposed variance. They will appear at your meeting Today.
The purpose of this letter is to inform you that, while the POA Architectural Review Committee and
Board have approved the design of the house, we have not consented to any waiver of the 25 foot setback
requirement that prevails in this neighborhood and for which no variance has been approved.

We have received notice of the hearing for 404 Hickory Creek Ct. (HCC) seeking a set
back variance of six fleet from the required 25 feet. We are opposed to this variance and
wish to register as strong a statement as possible against this request. Our home at 402
HCC sots back 46 feat from the curb whereas the neighbor's home, 405 Hickory Creek
Ct., sets back 72 feet from the curb.
The suggestion that the other home would be sited between our homes within 19 Feat of
The curb would simply overwhelm the ctrl de sac and the appearance of the neighborhood.
We have attached pictures of both the existing homes and the proposed setback for 404
HCC. It is clear that both existing homes would not be in view of each other but would
be limited to the view of the proposed home and its proximity to the curb. We feel this

After much thought and consideration, we have decided that we must oppose the request
for the zoning variance for a reduced frout yard set back from the curb to the front of the
structure on the home to be built at 404 Hickory Creek Court Southeast, Little Rock,
Arkansas.
We want to make it clear that we do not wish to create a negative impact for our future
neighbors.
However; the house located at 402 Hickory Creek Court Southeast is approximately 46
feet from the curb to the closest part of the structure. My home is approximately 72 feet
from the curb to the closest part of the structure. It seems by allowing a variance to begin
a structure approximately 18 to 19 feet from the curb when the homes directly on either
side are more than 20 feet further back from the curb would be visually out of place.
Also, the variance as requested is to place a porte-cohere in fzont of their home at 404
Hickory Creek Court Southeast. Thus, if the variance %as denied to accommodate the
porta-cohere, it would not adversely affect the ability of the landowner to build a horse
on the lot nor would it negatively impact the amount of living space (square footage) as
planned by the landowner.
