The applicant is proposing the rezoning of this site from
R-2 to PD -R to allow the placement of two manufactured
homes on the site.

Staff recommends approval of the requested PD -R zoning.
The Planning Commission voted to recommend approval
of the requested zoning by a vote of 7 ayes, 4 noes and
0 absent.
The Planning Commission reviewed the proposed PD -R
request at its May 11, 2006, meeting. There were
registered objectors present. All property owners located
within 200 -feet of the site, all residents who could be
identified located within 300 -feet of the site and the Upper
Baseline Neighborhood Association, the Windamere
Neighborhood Association and Southwest Little Rock
United for Progress were notified of the public hearing.
BACKGROUND
I
The applicant is proposing the removal of the existing
single-family residence and the placement of two (2)
manufactured homes and a single garage/shop building on
the site. The site plan indicates the placement of a single
20 -foot drive to access the site and six (6) parking spaces
to serve the residences. The owner has indicated he will
live in the primary unit and one of the units will be offered
for rent. The primary unit is proposed as a 32 -foot by 80 -
foot home containing 2,560 square feet and the rental unit
is proposed as 30 -feet by 50 -feet containing 1,500 square
feet.

record and site plan for the applicant's specific
development proposal and the staff analysis and
recommendation.

ORDINANCE NO.
AN ORDINANCE APPROVING A PLANNED ZONING
DEVELOPMENT AND ESTABLISHING A PLANNED
RESIDENTIAL DISTRICT TITLED STANTON ROAD
SHORT -FORM PD -R (Z-8034), LOCATED AT 8501
STANTON ROAD, LITTLE ROCK, ARKANSAS,
AMENDING THE OFFICIAL ZONING MAP OF THE
CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zoning classification of the following described property
be changed from R-2 to PD -R:
Part of the S % of the SE 1/4 NW 1/4 SE 1/4, Section 31 T -1-N, R -12-W,
Pulaski County, Arkansas more particularly described as follows:
Beginning at the SW corner of the S 1/2 SE 1/4 NW 1/4 SE 1/4, Section 31,
Thence North 81 feet; thence East 410.0 feet; thence South 81 feet; thence
west 410.0 feet to the point of beginning containing 0.76 acres more or
less.
SECTION 2. That the preliminary site development plan/plat be approved as
recommended by the Little Rock Planning Commission.
SECTION 3. That the change in zoning classification contemplated for Stanton
Road Short -form PD -R (Z-8034), located at 8501 Stanton Road is conditioned upon
obtaining a final plan approval within the time specified by Chapter 36, Article VII,
Section 36-454 (e) of the Code of Ordinances.
SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to affect and designate the change
provided for in Section 1 hereof.
SECTION 5. That this Ordinance shall not take effect and be in full force until
the final approval of the plan.
SECTION 6. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.

Per our recent conversation, 3 am writing to clarify my intentions regarding the above
referenced development application.
A great deal of attention has been tocusetl on the perception that the proposed homes in
this development will be "mobile homes". While these homes are pre -constructed and
will be brought to the site on wheels- the similarity ends.
These will be modular (t%vo section) homes, built to HUD standards. My intent is that
these homes will be permanently affixed to the property and cease to be mobile in nature:.
This includes:
1. Removing all running gear used fo- trana'port including the axels and tongue.
2. Securing there on a permanent foundation (pier and beam) and
"underpinning' with split -faced block or brick.
3. All steps, and sidewalks will be permanent rnasanr4.
4. Covered parking will be provided, although maybe not immediately.
5. Homes will be vinyl sided and asphaii shingled.
6. Landscaping and privacy fencing is planned.
7. Although these horses are `titled" as persottel property, my intent is to `retire"
the titles and have them declared appurtenam to the real estate for all intents
and purposes, including taxation.
Once completed, these homes will appear to be site built, having only a positive impact
on the neighborhood.
As an aside, if it were feasible financially, 1 would prefer to conventionally build
something else on the property. The reality is that new residential construction is running
$90 per square foot or more Residential property values in the area will only support
$60- $65 per square foot. New conventional construction would result in a negative
ecluity position from the start. although the numbers have changed, this is why there has
been no new residential constrrtction on Stanton Rd. in over 30 years. Given the :act that

the property is surrounded on two sides by a mobile home park, my options are farther
limited. After careful consideration, I feel that my proposal is the only rational approach
while having a positive impact on the neighborhood. Utility systems -Rill not be
overtaxed, traffic impact will be minimal, and the appearance of die neighborhood will be
improved. This development will result in an under utilized property, that presently is a
breeding ground for unsavory behavior, dumping and graffiti, being put to a more
productive use, consistent with it's surroundings.
I otitim other properly on Stanton Rd., including 8301 Stanton., 8305 Stanton, 8307 Stanton
and the mobile home park on Larry Circle (a private road off Stanton). I also intend to
live in one of the units proposed. I have a vested interest in the neighborhood and would
not consider this development if I felt it would have any negative impact on me
personally or the area.

Per our recent conversation, 1 am writing to clarify my intentions regarding the above
referenced development application.
A great deal of attention has been focused on the perception that die proposed homes in
this development will be "mobile homes". While these homes ary pre -constructed and
will be brought to the site on wheels, the similarity ends.
These will be modular (two section) homes, built to HUD standards. My intent is that
these homes will be permanently affixed to the property and cease to be mobile in nature.
This includes:
1. Rernovittg all running gear used for transport including the axels and tongue.
2. Securing them on a permanent foundation (pier and beam) and
"underpinning" with split -faced block or brick. --
3. All steps, and sidewalks will be permanent masonry.--

4. Covered parking will be provided, although maybe not immediately. —
5. Homes will be vinyl sided and asphalt shingled.
6. Landscaping and privacy fencing is planned. +
7. Although these homes are `titled" as personal property, my intent is to "retire"
the titles and have them drelamd appurtenant to the real estate for all intents
and purposes, including taxation.
Once completed. these homes will appear to be site built, having only a positive impact
on the neighborhood.
As an aside, if it were feasible financially, 1 would prefer to conventionally build
something else on the property. The reality is that new residential construction is running
$80 per square foot or more. Residential property values in the area will only support
$60- $65 per square foot. New conventional ranstrUCtion would result hi a negative
equity position from the start. Although rhe numbers have changed, this is why there has
been no new residential construcrion on Stanton Rd. in over 30 years. Given the fact that

the property is surrounded on two sides by a mobile home park, my options are further
limited. After carefial consideration, I feel that my proposal is the only rational approach
while having a positive impact on the neighborhood. Utility systems 'Mu not be
overtaxed, traffic impact will be minimal, and the appearance of the neighborhood will be
improved. This development will result in an under utilized property, that presently is a
breeding ground for unsavory behavior, dumping and graffiti, being put to a more
productive use. consistent with it's surroundings.
1 own other property on Stanton Rd., including 8301 Stanton, 8305 Stanton, 8307 Stanton
and the mobile horse park on Larry Circle (a private road off Stanton). I also intend to
live in one of the units proposed. I have a vested interest in the neighborhood and would
not consider this development if I felt it would have any negative impact on me
personally or the area.

Yard, front means the required area of open
space extending across the full width of the lot,
the depth of which shall be the least distance
between the front lot line and the nearest point of
the main building or of any open, unenclosed
porch or paved terrace as measured from the
exterior face of the building foundation.
Yard, interior means any yard which does not
run adjacent to or parallel with a public right-of-
way or a designated floodway.
Yard, rear means the required area of open

Zoning district means a section of a city desig-
nated in this chapter in which requirements for
the use of land and building and development
standards are prescribed.
Zoning district boundary means that boundary
line which separates unlike zoning districts.
Zoning lot means a parcel of land that is
designated by its owner or authorized agent as a
tract, all of which is to be used, developed or built
upon as a unit under a single ownership. A zoning
lot may consist of any standard lot or a combina-
tion of a lot and any legally recorded portion of a
lot that existed prior to the passage of this chap-
ter. When determining the front, rear and side
yard setbacks for a zoning lot, the required dis-
tance shall be measured from the exterior bound-
aries of the zoning lot.

Sec. 36-3. Same—Uses.
The following definitions and explanatory notes
supplement, restrict, and define the meaning and
intent of the use regulations in this chapter. The
first eight (8) uses listed are residential in nature
and have been grouped at the top of the list. Other
uses follow in alphabetical order:
High rise, multifamily means any structure
housing residential units (public or private) which
exceeds a height of thirty-five (35) feet.
Manufactured home means a factory -assem-
bled detached dwelling unit with the following
characteristics:
(1) Designed for full-time occupancy and con-
taining sleeping, bath, and kitchen facili-
ties.
(2) Connections for utilities systems provided
on the intended site.
(3) Designed for highway transport with
wheels, chassis, tongue, and other fea-
tures related to transportability.
(4) Conformance with the minimum construc-
tion standards of the federal mobile home
regulations of Title VI of Public Law 93-
383, USC 5401.
This structural type is required to be placed upon
permanent foundation supports with anchorage
complying with the city's building codes. This
definition shall be deemed to include modular
homes that are factory assembled. This structural
type is expressly prohibited in all zoning districts
except R-7 and R -7A where it is a use by right
subject to site plan review, and the R-2, R-3, and
R-4 districts where it is allowed by conditional
use permit.

shall not be less than four thousand (4,000)
square feet.
(5) Other area regulations and siting stan-
dards. The following minimum siting stan-
dards shall apply to all instances of place-
ment of a manufactured home in the R-2
single-family district by conditional use
permit:
a.. A pitched roof of three (3) in twelve
(12) or fourteen (14) degrees or
greater.
b. Removal of all transport elements.
C. Permanent foundation.
d. Exterior wall finished so as to be
compatible with the neighborhood.
e. Orientation compatible with place-
ment of adjacent structures.
f. Underpinning with permanent ma-
terials.
g. All homes shall be multisectional.
h. Off-street parking per single-family
dwelling standard. -
(6) Accessory structures and additions. Acces-
sory structures or principal building ad-
ditions of conventional on-site construc-
tion are permitted by right.

Sec. 36-255. R-3 Single-family district.
(a) Purpose and intent. The R-3 single-family
district is established in order to provide an
appropriate district for existing developed areas
occupied by smaller scale single-family housing
while at the same time maintaining reasonable
standards of light, air and similar amenities for
living. This section applies to such district. It is
intended that this district be utilized for new
constr-.ction only within the existing urban area
Arid especially for 'infill development. Within the
;H=3rlistrict, all buildings, structures or uses hav-

ing commercial characteristics shall be excluded
whether operated for a profit or otherwise. Acces-
sory uses, conditional uses and home occupations
specifically provided for in this chapter, however,
shall be allowed provided they do not have objec-
tionable characteristics and provided further that
they otherwise conform to the provisions of this
chapter.
(b) Use regulations.
(1) Permitted uses. Permitted uses are one (1)
single-family dwelling on any lot or par-
cel.
(2) Other uses. Accessory, home occupation,
special use, conditional uses or temporary
uses allowed within the R-3 single-family
district shall be the same as those in the
R-1 and R-2 districts except that two-
family residences, accessory dwellings, day
camps, day nursery, day care centers,
adult day care centers, and manufactured
homes may be allowed as conditional uses
in R-3 as specifically approved by the
planning commission.
(c) Height regulations. No building hereafter
erected or structurally altered shall exceed a
height of thirty-five (35) feet.

(d) Area regulations.
(1) Front yard. There shall be a front yard
setback having a depth of not less than
twenty-five (25) feet.
(2) Side yard. There shall be a side yard on
each side of the building having a width of
not less than ten (10) percent of the aver-
age width of the lot, not to exceed five (5)
feet.
(3) Rear yard. There shall be a rear yard
setback having a depth of not less than
twenty-five (25) feet. In the case of a
corner lot, however, when providing a
twenty-five foot exterior side yard, the
rear yard may be reduced to not less than
eight (8) feet.
(4) Lot area regulations_ There shall be a lot
area of not less than five thousand (5,000)
square feet. In addition, there shall be a
minimum lot width of not less than fifty
