Because of a previous commitment I will not be able to attend the hearing on March 30'h in front of the planning Commission and I would like you to provide this correspondence as my formal objection to this change. My wife and I have lived and raised our family in this pristine country side of residential zoning for 19 years. You can imagine my dismay when I was informed that directly across the street from my residence a construction storage yard and office complex was proposed to be built. I know I speak for myself and the two neighbors on either side me that "we do not want this zoning change to be granted" and that this area should remain zoned residential, they are just older and too intimidated with this type of proceeding to speak out. Put yourself in my position and imagine looking out your front window to see construction equipment, a parking lot and office building with day-to-day business coming and going. Or better yet, how would anyone like a back hoe being loaded on to a semi tractor trailer rig at 6:00 am across the street from your bedroom. Preventing this type of commotion in residential areas is precisely why we have zoning regulations. I can also only assume that if some day it was necessary to sell my home that there would be very few people interested in the view and that the value would be greatly diminished due to commercial development ten feet on the other side of the street. This area is growing and many new houses have recently been built with -in site of this property and they should also know that this possible change could jeopardize the value and setting of their investment as well. Please consider the negative impact commercial development would have on this area before allowing any changes to take place. I have nothing against the petitioning construction company; I only want it to remain zoned residential as intended by the original zoning decision years ago. My goal is to convenience you that this is not necessary and that it would not be in the best interest of the neighborhood. I hope to this by calling your attention to the following four points: TO BUILD A CONSTRUCTION COMPANY ON THIS PROPERTY WILL REDUCE THE VALUE OF THE HOMES IN THE IMMEDIATE AREA. No one can put an exact number on it, but it would be 10 to 25 percent depending on many variables. Some of which are age, value, condition, and location. To use round numbers, if a home is worth $200,000.00, it will cost the homeowner from $20,000 to $50,000. If the home is worth $100,000.00 it will be $10,000 to $25,000. But everything is relative, $10,000 to one person is the same as $20,000 to another. If you doubt my numbers, ask yourself, how much would it cost you, if someone built a construction company next door to your home, or in your neighborhood. SOME OF THE RESIDENTS ARE OVER 65 AND WILL NOT HAVE AN OPPORTUNITY TO RECOVER THE LOSS Some of the homeowners are over age 65, most are over age 50. My wife and I are age 68, we will be age 69 in less than two months. Barbara Barkley, a retired nurse lives in an old family home that she was raised in and has remodeled and invested a great deal of money. For most people their largest single investment is their home. This loss will be especially hard, for the elderly. They will likely never recover the loss. Many can't afford to move. They sure can't after they take this loss in the value of their home. They will have to live with the changes in the neighborhood. The construction company has other options. They can build elsewhere. The homeowners are already here. They don't have a choice. IT WILL CHANGE THE AREA. THE QUALITY OF LIFE FOR THE HOMEOWNERS WILL BE REDUCED. There will be more traffic. (The plan calls for 10 employees and 21 parking spaces). There will be more traffic because of office workers, vendors, project managers, delivery trucks, and people seeking employment going to and from the business. There will be more noise. (A 50'X60' warehouse is planned, it is to be expanded to 120'X60'). Equipment and supplies will be loaded and unloaded. This will mean noise from loud engines, power lifts, trucks emptying dumpsters, banging of ramps and tailgates, and yelling to be heard over the noise. Much of this will take place early in the morning or late in the afternoon when it will most affect the quiet enjoyment of the neighborhood. It will definitely reduce the quality of life in the neighborhood. IT IS NOT NEEDED. THERE ARE OTHER SITES AVIALABLE TO THEM. There are many other sites within a short distance that would meet the needs of a construction company. There are sites on Col Glenn Road between Shackleford Road and I-430, on Shackleford Road between Col. Glenn Road and Stagecoach Road, on Col Glenn Road closer to LR less than 2 miles from 1-430, on Talley Road less than a mile from I-430. Besides these, there are sites in the Industrial district off 65h street. All these sites are centrally located and have good access to the expressway system. And they are already zoned commercial or have no homes close to them. There are many others that I have not named. You could say they will cost more. I say cost who more? Any thing the construction company saves by building here will come out of the pockets of the homeowners in the neighborhood. Many of who are elderly. Summary It will lower the value of the homes in the neighborhood. It will reduce the quality of life in the neighborhood. The elderly will be hurt the most. It is not needed. There many other sites available to them. The question is not to rezone or not. It comes down to: do you save money for the construction company at the expense of the homeowners? Please consider these points when you make your decision. However, if this application is approved over the objections of the neighbors, I respectfully request the following changes be made to the planned development: The plans now show an undisturbed buffer area along the east side of the property of 9 feet. I ask that you increase this undisturbed buffer area to 30 feet beginning at the back of the parking lot, going north, to the northeast corner. I ask that you increase the undisturbed buffer area along the north side from 31 feet to 100 feet. I request that the screen fence requirement along the east side be changed to natural foliage of plants and trees, which are already there and can just be left undisturbed. An alternative would be to leave the trees, remove the undergrowth in the area adjacent to the parking lot and office building, replace it with shrubs to meet the screen fence requirement and leave the balance of the east side undisturbed. This would allow a more professional appearance for the business. These changes will not interfere with the planned use of the property and it will act as a buffer for the noise and be more pleasing to the eye. LU06-18-05 • The planned zoning district request is not for a Contractor's Yard but for an Office/ Warehouse. ■ While there are several nice older home sites along Lawson, there has been only one new home built on Lawson Road in the past several years. Any residential development is taking place in areas off of Lawson Rd. • It is .6 of a mile from our proposed site to Colonel Glenn and within that distance; there are 3 construction companies' offices and an automotive repair shop. In addition there is a church and at least two rental houses. Clearly there is a lot of Mixed Use between our site and Colonel Glenn. • The Master Street Plan calls for Lawson to be a minor arterial. By city standard, this means at least a 4 lane street and possibly a 5 lane street. This, in our opinion, does not seem conducive to future residential development but would be for commercial development. • The Zoning and Land Use you have been provided do not show all of the commercial development along Lawson. Please compare them with the satellite picture I have provided. COMMENTS DEALING WITH ITEM NO. 21 FILE NO. Z -8008-A • Alessi Keyes new office will be a first class office building nicely landscaped. It will enhance the neighborhood and will increase not lower property values. • We do not own any heavy equipment or eighteen wheelers. We do own a backhoe and a skytrack but they stay on jobs 98% of the time. There may be an occasional delivery by an eighteen wheeler but that would be once every other month on average. We do not have trucks or workers that come to the office before starting work. • Currently we only have 8 people in the office and the number of visitors, while it varies will only average about 5 or 6 per day. • We have agreed to comply with all technical requirements including buffer zone and set backs. ■ While I am sure we have not looked at every site, we have spent almost 2 years looking at various sites. Issues like location, size and configuration of the lot or the owner's unwillingness to break out a smaller parcel and zoning restrictions that did not allow a warehouse prevented us from buying other sites. 9 Please see comments listed for item No. 20 above.
