HomeMy WebLinkAbout16215 1 RESOLUTION NO. 16,215 2 3 A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER 4 INTO A CONTRACT WITH MNK, INC., IN THE AMOUNT OF SIXTY- 5 FIVE THOUSAND DOLLARS ($65,000.00), FOR THE PURCHASE OF 6 THE PROPERTY LOCATED AT 7020 COLONEL GLENN ROAD, TO BE 7 USED AS PARK PROPERTY FOR THE COSTRUCTION OF THE TRI- 8 CREEK GREENWAY; AND FOR OTHER PURPOSES. 9 10 WHEREAS,the Tri-Creek Greenway is a trail project to connect several parks in the central area of 11 the City between Hindman Park and War Memorial Park;and, 12 WHEREAS, the parcel located at 7020 Colonel Glenn Road is one of the larger and more important 13 pieces that is needed for the construction of the Tri-Creek Greenway Project;and, 14 WHEREAS,a title search was performed by Reed&Associates,Inc.,a Phase 1,Environmental Report 15 has been completed and there are no Outstanding Liens on the property. 16 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 17 OF LITTLE ROCK: 18 Section 1. The City of Little Rock Board of Directors authorizes the City Manager to enter into a 19 contract with MNK, Inc., in an amount not to exceed Sixty-Five Thousand Dollars ($65,000.00), to 20 purchase the property located at 7020 Colonel Glenn Road,for the development of the Tri-Creek Greenway 21 Project. The legal description of the property is as follows: 22 A PERMANENT CONSTRUCTION EASEMENT BEING A PART OF NORTHEAST 23 1/4 THE SOUTHWEST 1/4 OF SECTION 13, TOWNSHIP 1 NORTH, RANGE 13 24 WEST, IN THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS, AND 25 BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT 26 THE INTERSECTION OF THE WEST LINE OF SAID NORTHEAST 1/4 OF THE 27 SOUTHWEST 1/4, AND THE SOUTH RIGHT-OF-WAY 28 LINE OF WEST 36TH STREET, THENCE ALONG THE WEST LINE OF SAID 29 NORTHEAST 1/4 OF THE SOUTHWEST 1/4, S0°06'00"E 490.38' TO THE 30 NORTHWEST CORNER OF A PARCEL OF LAND HAVING A PARCEL 31 IDENTIFICATION NO. OF 44L1 1 50001 700 AND BEING DESCRIBED IN RECORD 32 DEED BOOK 2011; PAGE 040412, FILED AT THE PULASKI COUNTY 33 COURTHOUSE, THENCE ALONG THE NORTH LINE OF SAID PARCEL THE 34 FOLLOWING (4) FOUR COURSES AND DISTANCES S70°24'06"E 62.31'; THENCE [Page 1 of21 1 S69°06'34"E 21.18'; THENCE S69°06'33"E 247.80'; THENCE S70°32'52"E 48.38' TO 2 THE POINT OF BEGINNING; THENCE CONTINUING ALONG SAID NORTH 3 PARCEL LINE S70°32'52"E 337.51'TO A POINT ON THE NORTH RIGHT-OF-WAY 4 LINE OF COLONEL GLEN ROAD; THENCE ALONG SAID NORTH RIGHT-OF- 5 WAY LINE S65°23'05"W 242.19'; THENCE CONTINUING ALONG SAID NORTH 6 RIGHT-OF-WAY LINE S63°21'20"W 4.91;THENCE LEAVING SAID NORTH 7 RIGHT-OF-WAY LINE N40°51'50"W 147.63'; THENCE N 1°36'26"E 103.87' TO THE 8 POINT OF BEGINNING CONTAINING 0.78 ACRES (34,178.17 SQUARE-FEET), 9 MORE OR LESS. (Parcel No.44L1 1 50001 700) 10 Section 2. Funding for this acquisition will come from the Tri-Creek Greenway Account No.326459- 11 TS45C18. 12 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase or 13 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 14 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 15 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 16 resolution. 17 Section 4.
