HomeMy WebLinkAbout16213 1 RESOLUTION NO. 16,213 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A CONTRACT WITH ACS PLAYGROUND ADVENTURES, IN AN 5 AMOUNT NOT TO EXCEED NINETY-TWO THOUSAND DOLLARS 6 ($92,000.00), FOR THE REPAIR OF THE FITLOT STRUCTURE AT 7 MURRAY PARK THAT WAS DAMAGED AS A RESULT OF THE 8 MARCH 31,2023, EF-3 TORNADO; AND FOR OTHER PURPOSES. 9 10 WHEREAS, the Fitlot structure at Murray Park was severely damaged as a result of the March 31, 11 2023, EF-3 Tornado; and, 12 WHEREAS, prior to the damage, the structure was heavily utilized and the repair will return this 13 amenity to new condition for all users to enjoy;and, 14 WHEREAS,the Fitlot structure was donated and ACS Playground Adventures originally installed the 15 structure. Vendor selection was made utilizing the State Sourcewell Contract,No. 030117-LSI. 16 WHEREAS,the total contract amount for the repair of the Fitlot structure is not to exceed Ninety-Two 17 Thousand Dollars($92,000.00). 18 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 19 OF LITTLE ROCK,ARKANSAS: 20 Section 1. The City Manager is authorized to enter into an agreement with ACS Playground 21 Adventures, in an amount not to exceed a total cost of Ninety-Two Thousand Dollars($92,000.00), for the 22 repair of the Fitlot structure at Murray Park. 23 Section 2. Funds are available from FEMA,Account No.270459-G45DF231, in the amount of Sixty- 24 Nine Thousand Dollars ($69,000.00), and Insurance Reimbursement, Account No. 210459-S45B716, in 25 the amount of Twenty-Three Thousand Dollars($23,000.00). 26 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 27 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 28 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 29 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 30 resolution. 31 Section 4. Repealer.
