3 A RESOLUTION AUTHORIZING THE CITY OF LITTLE ROCK,
4 ARKANSAS, TO ENTER INTO A DECLARATION OF RESTRICTIVE
5 COVENANTS WITH WOMEN & CHILDREN FIRST AND THE
6 ARKANSAS DEVELOPMENT FINANCE AUTHORITY; AND FOR
7 OTHER PURPOSES.

9 WHEREAS,The City of Little Rock is the owner of certain real property located in Little Rock,Pulaski
10 County,Arkansas, hereinafter referred to as the"Leased Premises"and more particularly described as:
11 City of Little Rock, Arkansas- Daily Drive. A part of the N 1/2 of the NW 1/4 of Section
12 I, Township 1 South, Range 13 West, Pulaski County, Arkansas, more particularly
13 described as follows: commencing from the southeast comer of the N '/2 of the NW ''A
14 of Section 1, Township I South, Range 13 West; thence (PT NW NE & PT NE NW
15 MPDA COM SW COR NW NE TH S87*1 1'39"E AL SLN OF SD NW NE 154.94'
16 TO POB TH NO2*07'40" E550.68' TH S87*47'40"W300.0' TH

18 BLOCK 11 FAIRFIELD SUB & CONTINUING E IN R/W OF WARREN ROAD
19 300')to the point of beginning.This land is known as Parcel No.45L0010000703 and
20 contains 3.79 acres; and.
21 WHEREAS, the City of Little Rock hereinafter referred to as the "City" and Women and Children
22 First: The Center Against Family Violence hereinafter referred to as "Women and Children First" entered
23 into a lease agreement dated October 16,2019,for a period of ninety-nine(99)years; and,
24 WHEREAS, Women and Children First have been awarded Home-American Rescue Plan (HOME
25 ARP) Funds from the Arkansas Development Finance Authority hereinafter referred to as "ADFA" to
26 develop a forty-four(44) unit non-congregate shelter project located on the leased property;and,
27 WHEREAS, the City, Women and Children First and ADFA, pursuant to the Home-ARPA
28 Agreement, are required to enter into a Declaration of Restrictive Covenants Agreement.
29 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
30 OF LITTLE ROCK,ARKANSAS:
31 Section 1. The City Manager is hereby authorized to execute a Declaration of Restrictive Covenants
32 Agreement between the City, Women and Children First and ADFA.
33 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
34 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or

1 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
2 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
3 resolution.
4 Section 3. Repealer. All laws,ordinances, resolutions,or parts of the same,that are inconsistent with
5 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
