Justification: The applicant's justification is presented in an attached letter. Present Use of Property: Single Family Residential Proposed Use of Property: Single Family Residential STAFF REPORT A. Public Works Issues: No Comments. B. Staff Analysis: The R-2 zoned property at 2 Castle Rock Cove is occupied by a two-story brick single family residence. There is a two -car wide driveway from Castle Rock Cove which serves as access. The property slopes. downward from front to back and side to side (west to east). The lot has street frontage on the south, west and portion of the east property lines. There is also a 25 foot platted building line along the south, west and east property lines. Approximately two (2) years ago an uncovered, unenclosed deck was constructed on the rear northeast corner of the residential structure. The deck is approximately 11 feet by 24 feet and is approximately 10 feet above grade at its highest point. The deck is also located adjacent to a wood fence which is located on the rear (north) property line. JANUARY 30, 2006 ITEM! NO.: 3 ICON'T. Section 36-254(d)(3) requires a minimum rear setback of eight (8) feet for this R-2 zoned corner lot. Therefore, the applicant is requesting a variance to allow the existing deck with a reduced rear setback. Staff is supportive of the requested variance. Although staff typically does not support structures with no rear setback, the deck is unenclosed and uncovered, and has existed for two (2) years. Staff became aware of the deck structure when a City building inspector questioned its setback while making a footing inspection on the single family residence under construction on the adjacent property to the north. Since the time the deck was constructed no complaints have been received from the neighbors. Given the existing circumstances, including the slope of the property and the reduced buildable area because of the three (3) street frontages and platted building lines, staff will support the setback variance to allow the deck to remain. If this deck structure is ever removed, staff recommends it be replaced with a new deck structure which conforms to ordinance standards. C. Staff Recommendation: Staff recommends approval of the requested rear setback variance, subject to the following conditions: 1. The deck structure must remain uncovered and unenclosed. 2. If the deck structure is ever removed, it must be replaced with a deck which conforms to ordinance standards. 3. A building permit (triple fee) must be obtained for the deck structure. BOARD OF ADJUSTMENT: (JANUARY 30, 2006) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval. The applicant offered no additional comments The item was placed on the Consent Agenda and approved as recommended by staff by a vote of 5 ayes and 0 nays. 2
