Construction Company of Little Rock/ Verizon Wireless PROPOSAL: A tower use permit is requested to allow for construction of a wireless communication facility with support structure (tower) on this C-3 zoned property. STAFF REPORT: On December 28, 2005, the applicant requested deferral of this item. Staff recommends deferral to the March 2, 2006 meeting. PLANNING COMMISSION ACTION: (JANUARY 19, 2006) The applicant was present. There were no objectors present. Staff informed the Commission that the applicant had requested deferral of the item to the March 2, 2006 meeting. There was no further discussion. The item was placed on the Consent Agenda and deferred to the March 2, 2006 Agenda. The vote was 10 ayes, 0 noes and 1 absent. TAFF REPORT: On February 8, 2006, the applicant requested deferral of this item. The applicant is continuing to work on site location so as to minimize the effect on neighboring properties. Staff recommends deferral to the April 13, 2006 meeting. PLANNING COMMISSION ACTION: (MARCH 2, 2006) The applicant was not present. There were no objectors present. Staff informed the Commission that the applicant had requested deferral of the item. There was no further discussion. STAFF UPDATE: FILE NO.: Z-7983 On March 28, 2006, the applicant requested that this item be withdrawn. Staff recommends approval of the withdrawal requests. PLANNING COMMISSION ACTION: (APRIL 13, 2006) The applicant was not present. There were no objectors present. Staff informed the Commission of the withdrawal request. There was no further discussion. The item was placed on the Consent Agenda and approved for withdrawal by a vote of 8 ayes, 0 noes and 3 absent. 2 SUBDIVISION COMMITTEE COMMENTS DECEMBER 22, 2005 ITEM NO.: 13 VERIZON WIRELESS TOWER USE PERMIT (Z-7983) Planning Staff Comments: 1. There is no Bill of Assurance issue. 2. Show required landscaping around perimeter of WCF site or request variance and offer justification for not installing landscaping. 3. Show dimensions from tower and equipment to the lease boundary lines and to property lines to the north, south, east and west (instructions for filing # 3). 4. Provide statement that tower will be constructed to accommodate two additional antennae arrays and that collocation of other WCF providers will be allowed. 5. Due to proximity to adjacent residential properties, staff suggests the use of stealth technology; i.e. pull the antenna in to the body of the tower (Section 36-593(d)). 6. Provide supporting documentation that a WCF with support structure (tower) is needed at this site. Applicants shall demonstrate that a reasonable good faith attempt was made to find a collocation site acceptable to engineering standards and that none was technically or practically feasible. (Section 36-596 (a)). A tower for Verizon was recently approved 4,200± feet east of this site at 12,900 Cantrell Road. Variance/Waivers: • Reduced setback from adjacent residential properties. • Landscape standards for WCFs • Waiver of right-of-way dedication. Public Works: 1. A special Grading Permit for Flood Hazard Areas will be required per Section 8-283 prior to construction. 2. The structure excluding fencing must be constructed to least 1 foot above the base flood elevation. All supporting electrical and mechanical equipment must be located above the base flood elevation. A minimum finish floor elevation of all structures of 1 foot above the base flood elevation is required to be shown on plat and grading plans. 3. A grading permit in accordance with Section 29-186 (c) & (d) will be required prior to any land clearing or grading activities at the site. Site grading, and drainage plans will need to be submitted and approved prior to the start of construction. 4. Provide a Sketch Grading and Drainage Plan of development per Section 29-186 (e). Utilities and Fire Dmartment/County Planning: Wastewater: Sewer service not required for this project. Entergy: No comments received. Reliant: No comments received. Southwestern Bell: No comments received. Water: No objection. Fire Department: No Comments. County Planning: No Comments. CATA: The site is located on the Highway 10 Express bus route. Provide notification of property owners located within 200 -feet of the site, complete with the certified abstract list, notice form with affidavit executed and proof of mailing. Notices must be completed by January 4, 2006.
