Section 1. That the zoning classification of the following described property be changed from PD -O;

particularly described as follows: beginning at a point 80.7 feet east and 170.0 feet

Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and

The request is to amend the previously approved PD -0 to
allow the existing office user to expand their present
building square footage by 4,128 square feet located on two
levels.

Staff recommends approval of the requested revision to the
existing PD -0 zoning. The Planning Commission voted to
recommend approval of the requested revision to the
existing PD -0 zoning by a vote of 10 ayes, 0 noes and
1 absent.
The Planning Commission reviewed the proposed PD -0
request at its February 20, 2014, meeting. There were no
registered objectors present. All property owners located
within 200 -feet of the site along with the John Barrow
Neighborhood Association were notified of the Public
Hearing.
BACKGROUND
Ordinance No. 19,473 adopted by the Little Rock Board of
Directors on February 7, 2006, rezoned the site from R-3,
Single-family to PD -O to allow an existing structure to be
utilized as an office use. Interior renovations were
proposed to the structure and the existing parking lot was to
be resurfaced. The applicant proposed a six (6) foot fence
along the street right-of-way of West 41" Street and
Stannus Road. A gate was to be placed along Stannus
Road. Fencing was also proposed to be placed along the
mid -point of the property with the remainder of the parking
to be left open for employees of Wilson Elementary School
and Rosedale Baptist Church to utilize as overflow parking.
The structure contained 5,600 square feet and was
constructed as a Masonic Lodge in 1951. Prior to the
applicant's occupancy the structure had been vacant since
1998.
The site plan included a Phase II portion for development.
The applicant indicated future plans included the
construction of a second building on the site not to exceed
5,600 square feet. All required parking to satisfy an office
development would be included in the development of the
Phase II portion of the site. The Phase II portion of the
development has not been constructed.
The current request is to amend the previously approved
PD -O to allow the existing office user to expand their
present building square footage. The existing building
contains 5,608 square feet located on two levels. The
proposed addition is to allow 4,128 square feet of floor area
on two levels. Upon completion the total building square
footage on both levels will be 9,736 square feet of floor
area.
The site plan indicates the placement of 34 on-site parking
spaces. Four of the spaces will be located in front of the
building and the remaining spaces will be located in the
rear of the building. Based on the typical minimum parking
required to serve an office use 24 parking spaces would be
required. Currently the proposed parking area in the rear of
the building is paved but not striped for parking. Upon
redevelopment of the site striping and landscape islands
will be installed in this area.

Landscape Ordinance. Staff recommends in addition to the
existing trees and shrubs shown on the site plan the
applicant provide one (1) additional tree and place
additional shurbs within the landscape area on Stannus
Road to screen the paved area. In addition staff
recommends additional shurbs be placed within the
landscape strip along 41" Street adjacent to the paved area
to aid in screening the parking lot. The applicant is
agreeable to staff's request.

Thanks for taking the time to assist me in better understanding what needs to be done as to
ARM's business hours and number of employees. As we discussed, please let this letter serve as
my request for an amendment to the prior listing of ARM's hours and number of employees.
As we discussed, ARM is not a retail establishment, and we have no customers who visit our
office with rare exceptions during normal business hours of 8AM to 5PM. We will from time to
time have auditors (usually no more than two) in to review our books etc., but they are here for
no longer than a few days. Other than Federal Express, UPS, US postal service, and office
supply delivery personnel, there is no other traffic coming or going from ARM's campus during
normal business hours.
As we discussed ARM has grown over the last 7 years from 25 employees to 38. The maximum
number of employees ARM will have at our location fluctuates from time to time depending on
natural disasters such as hurricanes, earthquakes, tornadoes, hail storms, and other weather
phenomena. To refresh your memory, ARM is a third party administrator for foreign insurance
companies such as Lloyds, London. We handle insurance claims throughout America. Given the
time zones across America, (not to mention the time zone differentials with Europe) we may
have employees in the office as early as 6 AM, and sometimes staying as late as 7 PM to assist
people who have suffered a loss as a result of things like the natural disasters listed above, and
the routine matters that happened such as fires, thefts, etc.
In addition, there are several employees that work flextime hours to allow mothers to be home at
the time their children arrive home from school at the end of the day, or to allow dads to be
available during the morning; therefore they work late in the evenings.
As mentioned earlier in this letter, ARM works natural disasters throughout America which can
lead to 1000's of claims coming to ARM in a short period of time from people in the affected
regions. ARM also work with FEMA during these times of national emergencies. For this
reason, ARM from time to time will employee temporary employees for as long as 60 days to
assist with the volume of work to be done in a short time. I predict ARM will not have over 70

workers on its premise at any given time, but will likely have 10 to 15 additional personnel
during times of crisis over its current staffing level.
Finally, as we discussed, we have two employees that do housekeeping on the weekends. They
are normally here on either Saturday or Sunday depending on their schedule. You advised that is
not a problem when we last spoke. If I have misunderstood our conversation, please let me
know and please include these hours/days in my request for the amendment.
Please keep in mind, ARM is a quite office. There is no music, no customers coming and going
at odd hours, and no noise that will disturb our neighbors who are adjacent to our property. With
this in mind, we have three residences that are in close proximity to ARM's structure, along with
Wilson Elementary School, and the Rosedale Baptist Church which is now some form of a
fraternal organization involving sororities. With this thought in mind, there is really no one
present in our general area with the exception of the three residences before or after normal
business hours. We've never received any complaints from any of our neighbors as to the time
extended hours we work which once again does not annoy or aggravate any of our neighbors. I
suspect the reason for no complaints other than those listed above, is because we are separated
from our neighbors by streets or 100's of feet from our structure which is situated on a one acre
tract of land.
For all of these reasons, I would respectfully request an amendment to our classification (if I am
using the wrong terms and confusing you, please contact me) regulating businesses. Please let
this letter serve as my request for the business hours to be amended to 6 AM in the morning until
7 PM in the evening. I would like the number of employees to be listed at no greater than 70.
Please let me know if I have followed the proper procedures in seeking this amendment. If this
request is not the correct format to do it, please advise and provide me with instructions and any
forms that you require to complete this task.
In the meantime, I will be sending out notices to all of the neighbors as required prior to the
February meeting at City Hall. You mentioned I would need to sign some form of an affidavit to
attest that I had sent the letters a second time. Please provide me with that affidavit so I may
return it to you in anticipation of the meeting in February.

To whom it may concern:
Affirmative Risk Management (ARM) continues to grow and as a result is approaching the
Planning and Development Department in order to obtain permission to add to the existing
building and also encompass the remainder of ARM's existing parking lot within the fenced
compound. At the present time the existing parking lot at the rear of ARM's current structure is
not enclosed with fencing and is being utilized a basketball area (ARM funded this and paved the
area for local children to play for the last 6 years) and for overflow parking for PTA meetings
and school events related to Wilson Elementary.
As ARM has grown it has taken over existing training, conference, and storage areas within its
current structure to seat personnel. As a result, ARM is in need of new floor space to utilize as
on site storage of documents, supplies, and equipment. ARM is currently using floor space from
Rosedale Baptist Church for this purpose as an overflow. This agreement with Rosedale will
likely not be available in the future.
In addition, ARM's training area and conference room(s) is no longer available for their intended
purpose which creates a hardship related to continuing education of staff and business meetings
along with a location for staff to enjoy their lunches.
ARM has been a good neighbor to all adjacent homeowners, churches, and schools including
being a corporate PTA member to Wilson and Romine Elementary whom ARM sponsors with
cash donations for events that are otherwise not funded by public proceeds. ARM sees no
change in our support of the local businesses or homeowners who are in the general Rosedale
area as a result of expanding its current building.
Based on historical activities of ARM's, there is not any anticipated increase in the traffic
associated with an expansion of the existing structure or encompassing the existing parking lot.
If the Department of Planning and Development permits ARM to expand its current structure as
illustrated in the attached sit plan, the rear parking lot will be used to replace those parking
spaces that will be utilized for the building expansion.

The current level of traffic created by ARM's personnel is the same it has been for the last 4
years, with slightly higher than normal traffic in the neighborhood being consistent with normal
