During the meeting issues pertaining the floodplain development, street improvements, and right-of-way dedications were discussed. Based on these discussions Public Works staff has made revisions to the following comments/conditions to the development application to better identify and/or clarify the processes required for the development: 1. The 2nd Street public right-of-way is to be dedicated to the eastern property line of city park property. A concrete driveway apron should be installed where the proposed public right-of-way ends at the eastern property line of the city park property. 2nd Street should be constructed to a minimum 36 ft width from back of curb to back of curb. 90 degree parking is not allowed within the 2nd St. ROW. The parking should be revised to a parallel parking design within the 2nd Street right-of-way on the north and south sides of 2nd Street. 2. Plans of all work in right-of-way shall be submitted for approval prior to start of work. Obtain barricade permit prior to doing any work in the right-of-way from Traffic Engineering at (501) 379-1805 (Travis Herbner). 3. A grading permit in accordance with Section 29-186 (c) & (d) will be required prior to any land clearing or grading activities at the site. Other than residential subdivisions, site grading and drainage plans must be submitted and approved prior to the start of construction. 4. A special Grading Permit for Flood Hazard Areas will be required per Section 8-283 prior to construction. 5. The minimum finished floor elevation of the inhabitable structures on the property must be at least 1 foot above the base flood elevation and shown on any approved plans and/or plats. 6. Alteration of the water course will require approval from the Little Rock District of the US Army Corps of Engineers prior to start of work. The City recognizes receipt of a copy of the permit dated July12, 2012. 7. Street Improvement plans shall include signage and striping. Traffic Engineering must approve completed plans prior to construction. 8. Alteration or use of the levee will require approval from the Little Rock Pulaski County Levee District prior to the start of work. 9. Per Section 36-341 no structure shall be closer than twenty-five (25) feet to any established floodway line. The storage or processing aboveground and the storage belowground of material and fuel which is flammable or explosive or which could otherwise be injurious to human, animal or plant life in time of flood shall be unlawful. Floodways shall be kept free of structural involvement including fences, open storage of materials and equipment, vehicle parking and other impediments to the free flow of floodwater. 10. Streetlights are required by Section 31-403 of the Little Rock code. Provide plans for approval to Traffic Engineering. Streetlights must be installed prior to platting/certificate of occupancy. Contact Traffic Engineering 379-1813 (Greg Simmons) for more information. 11. Obtain permits prior to doing any street cuts or curb cuts. Obtain barricade permit prior to doing any work in the right-of-way. Contact Traffic Engineering at (501) 379-1805 (Travis Herbner) for more information. 12. The proposed park design should be reviewed by the Little Rock Parks Department. Contact Mark Webre at 371-6851 for additional assistance. 13. Damage to public and private property due to hauling operations or operation of construction related equipment from a nearby construction site shall be repaired by the responsible party prior to issuance of a certificate of occupancy. 14. Provide the grading and construction phasing plan. 15. Prior to construction of retaining walls, an engineer's certification of design and plans must be submitted to Public Works for approval. After construction, an as -built certification is required for construction of the retaining wall. 16. Cul-de-sacs built within public commercial street ROW must be constructed with an outside curb diameter of 100 ft. minimum. 17. The proposed site is within the adopted regulatory floodway. The proposed alterations in the floodway will require the applicant to obtain a conditional letter of map revision (CLOMR) approval from the Federal Emergency Management Agency prior to issuance of a grading permit and/or a building permit. If the approved CLOMR identifies no rise in the flood elevations and the completed construction phase is certified thru an as -built survey as consistent with the design proposed with the CLOMR, a subsequent Letter of Map Revision (LOMR) will not be required and a certificate of occupancy can be issued for that particular phase. Upon approval of the phase's construction and pending completion of as -built surveys, a temporary certificate of occupancy will be issued. 18. Storm water detention ordinance applies to this property. The project would qualify for a contribution in -lieu of construction at the time of the building permit. Recently, staff met with the applicant concerning File No.: Z -7919-D, the Rock City Marina and Yacht Club Long -form PCD. During the meeting; issues pertaining the floodplain development, street improvements, and right-of-way dedications were discussed. The applicant has amended the application as approved by the Planning Commission on August 22, 2013. The applicant has removed parking on the south side of the levee; the public street (East 2"d Street) has been extended to the east property line of the CLR Parks' property; and the applicant has agreed that approval of a conditional letter of map revision ("CLOMR") will be obtained from the Federal Emergency Management Agency ("FEMA") prior to the issuance of a grading permit and/or building permit. As in the application approved by the Planning Commission on August 22, 2013, the applicant is again seeking two (2) variances from the Board of Directors to CLR code of ordinances which as provided in the Public Works conditions. The Planning Commission approved a variance from Section 29-186(b) to allow advanced grading of future phases with construction of Phase 1. The applicant has indicated all the site work will be completed with the first phase of the development to allow the site to balance excavated material and eliminate the need to haul material from the site to only bring material back to the site when development of a particular phase begins. No action is required on this variance by the Board of Directors. The applicant is requesting a variance from Section 36-341(h)(2)a to allow structures closer than 25 ft from the established floodway line. The applicant proposes to construct buildings, aboveground storage tank, fences and railing, restroom facilities, vendor booths, pool, and other permanent structures up to the floodway line. The applicant is also requesting a variance from Section 36-341(h)(2)d to allow structural involvement including fences, open storage or materials and equipment, vehicle parking and other impediments to the free flow of floodwater. The applicant has agreed that approval of a CLOMR will be obtained from FEMA prior to the issuance of a grading permit and/or building permit. Staff supports these variances since the encroachments are required to be approved by FEMA. Action is required to be taken on this variance by the Board of Directors. I relayed to her that staff could recommend a diameter of 100 ft or greater since the fountain is proposed to be removed from the center. From the below email, Ms Catlett now desires to replace the fountain with a sculpture. The diameter that staff approved is based on the round -a -bout (cul de sac) with no obstruction(s) in the center. City Parks Department will pick up garbage and trash in the Park Area and remainder of the Premises according to the standard for routine collection performed by the City in its other parks. (That is normally Monday, Wednesday and Friday pickup during the summer, only 2 times a week during the rest of the year.) Tenant shall provide any additional garbage and trash collection needed during the week and Tenant shall also provide cleanup and garbage and trash collection during all events on the Premises that are not sponsored by the City. The City shall be responsible for cleanup and garbage and trash collection during all events on the Premises that are City -sponsored events. John will not agree to pick up trash during the week. The Park will have to exist with normal trash collection as other parks do. He will agree to clean up after his special events and City cleans up after City events Tenant shall be responsible for all costs and fees associated with Tenant?s marina operations, including but not limited to the gas refueling station, monument sign, boardwalk, consumption of water, lighting on the Premises except for Park Area, and disposal of garbage, trash and human waste, such as that resulting from servicing of boats. The City should waive fees relating to building permits and inspections for the improvements on the Public Park and Public Marina, including the parking areas, boat docks, public restaurant and store. Tenant shall be responsible for maintaining the fountain on the Premises and paying for water consumption for the fountain. Tenant shall obtain the approval of the Landlord for the design of the fountain prior to construction. (Alternatively, what is now shown as the fountain on the Premises could be landscaping with a piece of sculpture. The City does not want to be responsible for maintaining the fountain, since upkeep can be problematic and fountains can be expensive and an attractive nuisance.) The fountain will be eliminated and replaced by a sculpture so this issue can be avoided. The Tenant Street Improvements, so far as I am aware, consist only of standard Entergy street lighting and signage for the streets. Submitted by: Department of Planning and Development SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION Action Required gOrdinance Resolution Approval Information Report Approved By Bruce Moore The applicant is proposing to reestablish the previously approved PCD zoning for the site to allow the construction of a mixed use development including retail, restaurants, multi -family and a marina. I None. Staff recommends approval of the requested PCD zoning. The Planning Commission voted to recommend approval of the requested zoning by a vote of 8 ayes, 0 noes and 3 absent. The Planning Commission reviewed the proposed PCD request at its August 22, 2013, meeting. There were no registered objectors present. All property owners located within 200 -feet of the site along with the East Little Rock Neighborhood Association were notified of the Public Hearing. BACKGROUND In 2005 a PCD was approved for the development of this site as a mixed use development containing apartments, retail uses, marina and a public boat launch ramp. In 2007 City owned property was added to the overall development plan to include the development of a city park and provide an extension of the River Trail. The development did not occur and on September 23, 2010, the Little Rock Planning Commission approved a two (2) year time extension for submission of the final development plan. The development did not occur and the PCD zoning has expired. On July 14, 2011, the Little Rock Planning Commission reviewed and provided a recommendation of approval to allow the reestablishment of the PCD zoning and site plan. As a part of the recommendation the Commission recommended prior to the item being forwarded to the Board of Directors the applicant secure several approvals including approval from the Levee District, the Corp of Engineers and the City of Little Rock to allow development to occur on property not owned by the applicant. The applicant failed to provide the responses to staff. The item was not forwarded to the Board of Directors for final action. The applicant is now proposing to amend the previously approved site plan and reestablish the PCD zoning. There are four different aspects of the development planned for this site; the marina, restaurant, city park, and the apartment/clubhouse/pool complex. There will be a floating restaurant with a ships store for commercial sales which will also offer the sale of beer, wine and alcohol, vendor booths, bathrooms and shower facilities and reserved covered parking. There are also vendor booths located within the city park area. The apartment development consists of 192 residential units and a clubhouse/pool office. The Marina development consists of 11 docks which contain approximately 427 watercraft slips. The request includes a variance to allow advanced grading of the site including installation of the seawall, permission to install fencing and a temporary guard shack, allowance for parking in the floodway, and a sign variance. OA BACKGROUND CONTINUED After the Planning Commission public hearing the applicant amended the site plan to remove the proposal to construct the River Trail and a second parking lot located on Levee District property. The applicant contacted the Levee District concerning improvements on their property. The Levee District will not give him permission to make any improvements on their ownership. The Levee District is currently going through a recertification process for the levee and does not want to jeopardize or slow down the approval process for recertification of the levees. With the revision there is now only one parking lot south of the levee on East 3 Street. The parking lot is located at East 2nd and Reichardt Street on property owned by the City of Little Rock. The applicant indicates the parking is proposed primarily for users of the City parking and River Trail System.
