As to the requirement to provide an affidavit of the property owner (new tower), or tower owner (collocation) please note that this work will involved alteration of Verizon Wireless equipment that is currently located on the tower. Since the only changes will be to equipment owned by the applicant, we submit that no authorization of an outside party is required. As to the requirement to provide ERP Information, the applicant submits that since the Verizon antennas were previously approved at the current height that this requirement does not apply. In addition, since the antennas that will be replace by more modern antennas, and since the FCC categorically excludes from review all antennas that are over 10 meters in height (these antennas are at 45.72 meters) the ERP information request is not applicable. I need clarification and confirmation on a couple of issues before I process the application. When the site was originally approved on August 22, 2005, the approval was granted based on documentation and drawings showing full compliance with the standards for WCF's established by Chapter 36, Article XII of the City's Code of Ordinances. Those standards included specific screening and landscaping. Page 3.1 of your submittal indicates an existing 6 foot tall wood privacy fence enclosing the compound. The code requires and the original approval was granted based on an 8 foot tall privacy fence. Please confirm that the fence meets the requirement of 8 feet in height. If it is, in fact, a 6 foot fence, the application cannot be approved at staff level. The original approval included a landscape plan in conformance with the Code requirement. You did not include a landscape plan. Please confirm that the landscaping was, in fact, installed to comply with Code and is in place. If not, I cannot approve the application at staff level.
