AN ORDINANCE RECLASSIFYING PROPERTY
LOCATED IN THE CITY OF LITTLE ROCK,
ARKANSAS, AMENDING THE OFFICIAL ZONING
MAP OF THE CITY OF LITTLE ROCK, ARKANSAS;
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zone classification of the following property be and is
hereby changed as indicated:
Z-7883 — Described as all that part Area 203 of the Little Rock Port
Industrial Park, Little Rock, Pulaski County, Arkansas, being bound on the
South by the North right-of-way of Lindsey Road, on the West by the East
line of Tract C, Area 203, and an unplatted strip of land lying along the
East side of Tract C (sold to the owners of Tract C to be replatted into
Tract C in the future); and bound on the North and East by a segment of
South right-of-way line of the Little Rock Port Railroad; being more
particularly bound and described as follows:
Commencing at the NW corner of NE 1/a of the SE 1/a of said Section 16,
T -1-N, R -17-W, thence run N58°17'32"E, 28.09 feet to the intersection of
the East right-of-way of Fourche Dam Pike with the South right-of-way
line of the Little Rock Port Railroad Spur; thence N78°43'34"E, along
said South right-of-way line, 166.89 feet; thence continuing along said
Right -of -Way line, along an arc to the right having a Radius of 350.78
feet, an arc length of 580.30 feet, and a chord bearing and distance of
S53052'53"E, 516.35 feet to the intersection of East right-of-way line of
the Little Rock Port Railroad Spur with the North right-of-way line of
Lindsey Road; thence S78°43'34"W, along said North right-of-way line of
Lindsey Road, 516.45 feet; thence leaving said Right -of -Way line,
N11016'26"W, 380.04 feet to the Point of Beginning, containing 3.89
acres, more or less: From "I-2" Light Industrial District to "I-3" Industrial
District (North side of Lindsey Road, approximately 500 feet east of
Fourche Dam Pike).
SECTION 2. That the zoning of the above described property is subject to the
following conditions which were proposed by the applicant for the property described in
Section 1 of this ordinance and which shall be covenants running with the land to bind
subsequent grantees of the property:
The following uses are eliminated from the I-3 permitted use list and will be
prohibited uses for the property:
• Bulk storage of highly flammable and/or hazardous materials
Junk or salvage yard
• Sand, gravel or earth sales and storage
• Recycling facility, outside
• Sanitary landfill
SECTION 3. That the map referred to in Chapter 36 of the Cade of Ordinances
of the City of Little Rock and designated district map be and it is hereby amended to the
extent and in the respects necessary to affect and designate the change provided for in
Sections 1 and 2 hereof.
SECTION 4. That the Ordinance shall take effect and be in full force 30 days
after the date of its passage and approval.
SECTION 5. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 6. Repealer. All laws, ordinances, resolutions, or parts of the same,
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.

There were o objectors present,
July 21, 2005 meeting.
All owners of property located within 200 feet of the site,
all residents within 300 feet who could be identified, and
the Hermitage Property Owners Association were notified
of the public hearing.
The Commission voted, as part of the Consent Agenda, to
recommend approval of the rezoning. The vote was
11 ayes and 0 nays.
BACKGROUND
The City of Little Rock/Little Rock Port Authority, owner
of the 3.89 Acre property located on the north side of
Lindsey Road, approximately 500 feet east of Fourche
Dam Pike, is requesting to rezone the property from
"1-2" Light Industrial District to "I-3" Industrial District.
The rezoning is proposed in order to develop an enclosed
facility for recycling used restaurant grease (Brooks
Grease Service, Inc.). As a condition of the rezoning, the
applicant is proposing to eliminate certain uses from the
list of I-3 permitted uses. The uses which are to be
eliminated from the I-3 permitted use list are as follows:
• Bulk storage of highly flammable and/or hazardous
materials
Junk or salvage yard
• Sand, gravel or earth sales and storage
• Recycling facility, outside
• Sanitary landfill
The property is currently undeveloped and grass -covered.
There is railroad right-of-way along the north and east
property lines.
The general area contains a mixture of industrial and
commercial uses. There is undeveloped I-2 zoned
property to north along Interstate 440. There is a mixture
of industrial uses and undeveloped I-3 zoned property to
the south across Lindsey Road. There is also a mixture of
industrial uses to the east along Lindsey Road. There are
two (2) convenience stores to the west, at the intersection
of Lindsey Road and Fourche Dam Pike, with industrial
uses further west.
The City's Future Land Use Plan designates this property
as Industrial. The requested zoning change to I-3 does not
require a change to the Land Use Plan.
Staff is supportive of the requested I-3 zoning, with
condition. Staff's only initial concern with the proposed
rezoning was the possibility of having very intense
industrial uses within this area of transition from the heavy
industrial uses to the south and the I-440/Fourche Dam
Pike interchange. Staff feels the applicant has addressed
this concern by eliminating the most intense industrial uses
from the I-3 permitted use list, as noted above. Staff
believes the requested I-3 zoning, with condition, and the
proposed enclosed grease recycling facility will have no
adverse impact on the general area.

Agricultural Products Processing Facility
We will have a steel metal building constructed that will
be 140 foot long by 45 foot wide. It will be
approximately 20 foot tall. This structure will have an
office and a warehouse in it. We will have portable
upright and lay down storage tanks to store material on
site. They vary in size and range from 8-12 feet in
diameter and approximately 12-27 feet in length.
Building, driveways, and parking area will follow all city
codes and ordinances.

Sec. 36-321. I-3 industrial district.
(a) Purpose and intent. The I-3 heavy indus-
trial district is designed to accommodate indus-
trial uses which involve potentially objectionable
uses and hazards, and which, therefor, cannot be
reasonably expected to conform to a high level of
performance standards, but which are essential
to the economic viability of the city. This section
(b) Development criteria. Unless otherwise spe-
cifically provided for in this section, the following
development criteria shall apply to this district:

(1) Every use that is devoted to the collection
storage, salvage, or scrapping of automo-
biles, trucks, buses, or other self-pro-
pelled vehicles shall provide on all sides of
such operations an eight (8) foot opaque
wall or fence. The fence or wall shall be
constructed of wood or metal so as to
preclude the passage of light or air.
(2) In addition to the screening requirements
of (bXl) of this section, all uses that stack
or pile the chassis or bodies of vehicles
shall be limited to a maximum stacking
height of fifteen (15) feet at any point on
the property. This measurement shall be
from the uppermost point of the stack to
ground elevation on any side.
(c) Use regulations.
(1) Permitted uses. The permitted uses in the
I-3 heavy industrial district include (ex-
cept for hotel or motel) those permitted
uses found in the I-1 industrial park dis-
trict or the I-2 light industrial district
together with the following:
a. Agricultural products processing.
Bulk storage of highly flammable
and/or hazardous materials. This use
shall be permitted to be located by
right on tracts of land larger than
five (5) acres in area separated from
residential zoned or used property
by at least one thousand (1,000) feet,
property line to property line, and
providing a minimum of two hun-
dred (200) feet of setback for storage
facilities from all property lines.
C. Foundry and metalwork.
d. Grain elevator or feed mill.

e. Racetrack.
f. Rendering plant.
g. Slaughterhouse, open facility.
h. Stone, sand or gravel extraction.
i. Tannery.
j. Water or sewage treatment plant.
k. Other industrial uses not expressly
provided for in the I-1 or I-2 districts

city ordinance.

area of not less than one (1) acre. In
addition, there shall be a lot width of not
less than one hundred fifty (150) feet and
a lot depth of not less than two hundred
fifty (250) feet.

of the city. This district is intended to include
those public and private park and recreation and
conservation areas which are designated as parks,
or for park uses, in the adopted Little Rock Parks
and Recreation Master Plan.
(b) Development criteria. The following devel-
opment criteria should apply to the PR park and
recreation district:

surveyed by Garver and Garver, Inc., registered professional engineers, and a plat thereof made, certified to on July
3, 1971, which plat is identified as Little Rock Port Industrial Park and consisting of the lands hereinabove
described, and by the signature of the said engineers and by the signatures of the proper officials of the Grantor and
bears the Certificate of Approval executed by the Little Rock Planning Commission and is of record in the office of
the Circuit Clerk and Ex -officio records of Pulaski County, Arkansas in Plat Book 27 , page, 86 , and the Grantors
do hereby made this Bill of Assurance.
The Grantor hereby certifies that it has platted said real estate in accordance with said plat. The lands
embraced in said plat shall be forever known as designated on said plat and description of said tracts or plots or areas
with reference to said plat shall be a valid and complete description thereof for all purposes.
The filing of this I3ill of Assurance and plat is recorded in the office of the Circuit Clerk and Ex -officio
Recorder of Pulaski County, Arkansas shall be a valid and complete delivery and dedication of streets and easements
shown on said plat except such prior easement held by others than the Grantor and except that casement designated
on the plat as the Little Rock Port Railroad spur Easement.
The tracts, plots and areas designated in this subdivision shall be sold by the grantor and shall be purchased
by the buyers thereof subject to the following covenants and restrictions, to -wit:

industrial, manufacturing, warehousing or distribution purposes. It shall not be used for residential purposes, nor for
the retail sale of any merchandise or services, except that any occupant of the property, either owner or tenant, may
sell at retail those products which are manufactured or ]handled at wholesale by the occupant. The financing of the
sale of such merchandise is expressly pernhitted, as is the retail sale of food, beverage and other such convenience
items to occupant's employees so long as these items are not offered for sale to the general public. The purpose of
this restriction is to prohibit the operation on this property of airy business devoted primarily to the retail sale of
merchandise or to the furnishing of services to the general public.
The property in Areas 201, 202, 203, and 204 is zoned "I" - Light Industrial and may be used for any
purpose that qualifies under this zoning classification.

trailers, or any combination thereof may not, while being either loaded, unloaded or maneuvering, project on to the
rigl-d-of-way of any street, alley, or open space bordering the property.
(6) SIGNS
Billboard posters and other advertising signs are prohibited except, however, signs which advertise the
property owner's business or products may be erected with prior approval of the Grantor. Prior to the erection of
such a sign as herein permitted, Grantor may erect a sign on the conveyed property identifying the purchased
property as belonging to the Grantee.
(7) OUTSIDE STORAGE

of any abutting streets, including any such property which may be in a street or utility right-of-way, and to remove

running with the land and shall remain in full force and effect as herein expressed until December 31, 1996 (the
"initial term").
