Markham Little Rock, AR 72201 RE: Graham Smith Construction LLC request for zoning change in vicinity of Taylor Park Boulevard Dear Chairman Yates: I have been a homeowner in the Taylor Park Subdivision for nearly three years since July, 2007. 1 support the current zoning designation of R-2 for property located on the West side of Taylor Park Boulevard immediately South of Kanis Road. I oppose the request by Graham Smith Construction LLC for a zoning change to accommodate his construction of attached homes and commercial space in the vicinity of Taylor Park. Keeping the zoning "as is" will not prevent Mr. Smith from using his new property for residential building. No one is taking away his property rights. He will still be able to build successful residences within existing zoning requirements on his new property. And, he will still have opportunity to build a significant amount of commercial space previously approved in the Taylor Park Subdivision. As background for my reasons for opposition, I want to say that in the advertising materials and plat for Mr. Smith's Taylor Park Subdivision that were presented to me and many other buyers, the residential phases 1-4 did not include the narrow sliver of land that is the subject of today's discussion. Nor was it in phase 5, which is the commercial frontage on Kanis Road. Mr. Smith did not own the subject property when Taylor Park Subdivision was platted. Reference in the hearing notice of his plan to build "additional" attached residential buildings and two commercial buildings might give the impression that these proposed structures are part of the original Taylor Park plat and that proposed construction should be able to get "grandfathered in" since Mr. Smith, the developer of Taylor Park, already has attached homes in the residential phases of Taylor Park Subdivision and commercial designation on the east side of Taylor Park Boulevard along Kanis Road. I hope that any suggestion of grandfathering will be rejected if the subject is brought up. The following are my specific reasons to oppose Mr. Smith's request: The proposal by Mr. Smith puts too much construction and density onto too small a space. As a result, there will be too much traffic, too little parking, too little preservation of green space, and too much damage to the architectural attractiveness of nearby Taylor Park Subdivision and the new project itself. I realize the Commission hears about these issues at nearly every meeting, but that's because they are legitimate concerns as neighbors attempt to have a desirable, attractive, and stable community. Traffic and parking The density of attached homes and commercial property in this small space means more traffic into our "one entrance" subdivision. Increased parking from the commercial properties would cause spillover parking onto Taylor Park Boulevard. Although our Taylor Park Bill of Assurances does not permit on -street parking for Taylor Park residents, the density of homes/commercial structures in the new and separate development would likely mean increased on -street parking on Taylor Park Boulevard. Loss ofreen space and harm to architectural uni and integ!ily of Taylor Park area The new attached houses proposed by Mr. Smith are not consistent with the external design of the Taylor Park Subdivision just across the street from the proposed new project. Attached homes in Taylor Park have rear garages and alleys. Mr. Smith's new plans call for front garages on 11 attached residential homes. Since he has continually stressed the aesthetics and uniform architectural design of the Taylor Park Subdivision via the Bill of Assurances and the Architectural Control Committee, it would seem logical that any new homes he proposes for development directly across from Taylor Park Subdivision would have the same design, placement, and restrictions as Taylor Park homes. That means that any new attached homes would have rear garages and rear alleyways for access to garages. If Mr. Smith were allowed to build 11 attached homes with front garages and driveways along with the parking lot for 2 commercial properties, there would be almost a solid ribbon of gray concrete driveways one block long down Taylor Park Boulevard. It is true that in the Taylor Park Subdivision the detached patio homes have front garages, but the detached homes sit on much larger lots and the visual impact of front garages/driveways is not as great as those in more densely situated attached homes with front garages and driveways. Final Point: Improvement Districts; Homeowners Association I have questions about how Mr. Smith's new development along Taylor Park Boulevard will either pay for its property improvements or reimburse Taylor Park homeowners for the use of streets, sewers, etc. which Taylor Park homeowners are financing through Taylor Park Improvement Districts 26 and 27. These districts are established through City Ordinance Numbers 19530 and 19531 and provisions of the Arkansas Municipal Property Owners' Multipurpose Improvement District Law (Ark. Code Ann. 14- 2 94-101 et seq.) Since the proposed project is not in the Taylor Park Subdivision, I am sure Taylor Park property owners will not want to bear the cost of another property's infrastructure and related costs. How does Mr. Smith plan to handle this issue? Will he seek to form another improvement district for his new project? Will he seek to annex his new property to Taylor Park's Districts 26 and 27 or to Taylor Park Subdivision itself? What will be the effects on Taylor Park's homeowners if he seeks these or other changes? What input will subdivision property owners have in this possible process? Taylor Park homeowners do not sit on the Improvement District Boards (only builders or their representatives do) and have no input into the selection of Commissioners who control our assessments. It appears that new home sales in the subdivision have been completed, and I have understood that Mr. Smith no longer owns residential property in Taylor Park. This then leads to the question of when Mr. Smith's control of the residential portion of Taylor Park will be transferred to the homeowners as outlined in the Bill of Assurances. Also, are there plans to put homeowners on the Improvement District Boards? I realize that governance issues are not the main topic of discussion today, but raising these issues at this hearing is important because the Planning Commission receives bills of assurance from developers, and the City Board deals with appointment of Improvement District Commissioners. In a similar way, Arkansas Municipal Property Owners Improvement District Law deals with procedures relating to notices of assessments and reassessments, the need for hearings, and the appointment/removal of Commissioners. It is hard to imagine that Mr. Smith was not aware of the kind of city zoning restrictions in effect when he bought the new property, and to ask the City for a zoning change that negatively affects the entire neighborhood of 116 homes doesn't seem right. I ask the Planning Commission to retain the current R-2 classification for the property in question. Thank you for your consideration of my comments. We all bought our houses with the understanding that Taylor Park would be a wholly residential neighborhood and the quality of homes planned. With the decision by Graham Smith and Taylor Park LLC, our quiet neighbor will now be converted to a Commercial zoned subdivision with two (2) enormous office buildings situated at the very entrance to the subdivision. Already traffic in and out of Taylor Park has increased substantially due mainly to the connection of Woodlawn Subdivision to Kanis. Now they are considering increasing the traffic in and out by locating the parking area for these office complexes directly inside the main entrance. I realize we do not have much of a say, especially since the Taylor Park Subdivision POA DOES NOT have one single property owner on it's board, and is made up entirely by contractors and business owners whose only consideration is how to line their own pockets with total disregard to the very people that purchased their homes from them. It is our opinion that the proposed construction does not fit with the overall design and plan of the subdivision and will adversely effect our property values. Rezoning the area to Commercial, can also lead to someone deciding to open a business right next door to our home. If we wanted to live in an industrial park, we would have purchased a home in one. We also believe allowing the zoning change would be an open invitation for other businesses to move in. It will change the complexion of the entire subdivision. Graham Smith and the people of Taylor Park LLC do not, nor will they ever, live in this subdivision. They do not speak for us, the homeowners. Please, please, please, take into account the wants and opinions of the very people that actually live in this subdivision, over those that are in it only for own personal gain. We would like to add one more thing before closing. If in fact the revised POD is approved and construction begins it is our belief that the current plan for the eleven (11) units to be built will not fit into the overall design of the original subdivsion. Of course, we realize that some future development of the property will happen within the bounds of allowed construction. We have no serious concerns except for a desire that a reasonably quiet area be maintained similar to that quiet business on the north side of Kanis Road near us. We are concerned, however, that the density of the housing additions might exceed that of the Taylor Park area already developed. We do not wish to have this added density. We realize that some "fill work" might have to be done up to our boundary. We would hope that the volume of the fill materials and the addition of a wooden fence would not be oppressive. In doing the development along our back five acres we were greatly disturbed that the boundary was clear cut even on our side without any notification or apology. We will not allow that to happen along our boundary adjacent to the proposed development. We expect boundary trees to remain without damage and with no infringement on our property. We will be open to the placing of a privacy fence on the property line, but have no desire to pay for any of it since we have a buffer of vegetation on our side. These 88 out of 116 total homeowners signed the petition to oppose developer Graham Smith's original development plan filed April 12, 2010, and his May 24'' revision of the original. This letter concerns his 3rd plan of July 6. Before offering comments on behalf of the petition signers, I want you to know that as the neighbors began the petition campaign, they did so in the face of others who said that such efforts would make no difference, that the decision had already been made, and that we were wasting our time going from door to door during the hot days of June. Those comments did not discourage us. What we found was that neighbors came together and eagerly signed. We believe that the 76% of all Taylor Park homeowners who expressed their opposition through their petition and individual letters had something to do with the most recent modification that Mr. Smith has made to his plans. We are glad to see that Mr. Smith has made changes in this latest version because they are steps in the right direction as Taylor Park develops. The suggestion made most frequently during the petition campaign was that Mr. Smith should finish out the neighborhood as he had begun the project: With detached or stand alone houses lining the perimeter of Taylor Park all the way out to Kanis Road. Even though it has taken three tries to bring stand-alone houses to most of the perimeter of Taylor Park Boulevard, this latest revision is progress. Though there are differences of opinion among the 88 petition signers on the latest revision, some homeowners would likely accept the revision. However, other homeowners continue to oppose the revision with the following points: ***Use of Taylor Park Boulevard as the access to any office building areas of the development. Having two office building driveways come off a residential street which is our only way in and out of the neighborhood raises concerns for safety and parking, especially when 11 more residential driveways will also come off this street. ***The lack of any green space at all. Instead of adding an office building to an overbuilt office market, homeowners have suggested a green space in place of an office building and keep all office buildings in the site Mr. Smith originally envisioned on the east side of Taylor Park Boulevard. On this last point, there is so much unoccupied office space along Kanis Road that it seems the last thing the area needs is another office building that will sit vacant for the foreseeable future. I've lived in Taylor Park for 3 years, and lots and office buildings that were vacant when I moved into the area are still empty. Many lots along Kanis look like they were clear-cut, leveled, and left to be an unattractive barren. What kind of restrictions can the City place upon a builder so that he will not scrape the land clear and leave it empty and unlandscaped until he gets ready to build which could be years down the road? I expect that all 88 petition signers would oppose this latest revision if Mr. Smith's plans were to clear-cut and leave the land barren as it is on a lot at the corner of Kanis and Atkins. How does the Planning Commission handle this issue? Many homeowners still have questions about the revision, and would like answers and assurances in writing from Mr. Smith himself. There are still unanswered questions including those about the operation of the improvement districts, whether new owners will share in the cost of the development, and whether the new construction, including a possible office building, will be consistent architecturally and qualitywise with the rest of Taylor Park. These 88 out of 116 total homeowners signed the petition to oppose developer Graham Smith's original development plan filed April 12, 2010, and his May 20 revision of the original. This letter concerns his 3rd plan of July 6. Before offering comments on behalf of the petition signers, I want you to know that as the neighbors began the petition campaign, they did so in the face of others who said that such efforts would make no difference, that the decision had already been made, and that we were wasting our time going from door to door during the hot days of June. Those comments did not discourage us. What we found was that neighbors came together and eagerly signed. We believe that the 76% of all Taylor Park homeowners who expressed their opposition through their petition and individual letters had something to do with the most recent modification that Mr. Smith has made to his plans. We are glad to see that Mr. Smith has made changes in this latest version because they are steps in the right direction as Taylor Park develops. The suggestion made most frequently during the petition campaign was that Mr. Smith should finish out the neighborhood as he had begun the project: With detached or stand alone houses linin the perimeter of Ta for Park all the wa out to Kanis Road. Even though it has taken three tries to bring stand-alone houses to most of the perimeter of Taylor Park Boulevard, this latest revision is progress. Though there are differences of opinion among the 88 petition signers on the latest revision, some homeowners would likely accept the revision. However, other homeowners continue to oppose the revision with the following points: ***Use of Taylor Park Boulevard as the access to any office building areas of the development. Having two office building driveways come off a residential street which is our only way in and out of the neighborhood raises concerns for safety and parking, especially when 11 more residential driveways will also come off this street. * * * The lack of any green space at all. Instead of adding an office building to an overbuilt office market, homeowners have suggested a green space in place of an office building and keep all office buildings in the site Mr. Smith originally envisioned on the east side of Taylor Park Boulevard. On this last point, there is so much unoccupied office space along Kanis Road that it seems the last thing the area needs is another office building that will sit vacant for the foreseeable future. I've lived in Taylor Park for 3 years, and lots and office buildings that were vacant when I moved into the area are still empty. Many lots along Kanis look like they were clear-cut, leveled, and left to be an unattractive barren. What kind of restrictions can the City place upon a builder so that he will not scrape the land clear and leave it empty and unlandscaped until he gets ready to build which could be years down the road? I expect that all 88 petition signers would oppose this latest revision if Mr. Smith's plans were to clear-cut and leave the land barren as it is on a lot at the corner of Kanis and Atkins. How does the Planning Commission handle this issue? Many homeowners still have questions about the revision, and would like answers and assurances in writing from Mr. Smith himself. There are still unanswered questions including those about the operation of the improvement districts, whether new owners will share in the cost of the development, and whether the new construction, including a possible office building, will be consistent architecturally and qualitywise with the rest of Taylor Park. We encourage him to meet with homeowners or a representative group, even those who may not share all his positions. The petition signers, who represented 3 out of 4 all Taylor Park homeowners, quite literally bought into his project and we can be helpful partners along side him in the neighborhood if he will talk with us. C-12. OWNER RESPONSIBILITY. All property owners shall insure that any contractor performing services for the property owner shall comply with the provisions of this Bill of Assurance. C-13. CONTRACTOR RESPONSIBILITY. No contractor shall damage in any way the utilities or streets in any manor. C-14. OIL AND MINING OPERATIONS. No oil drilling, oil development operations, oil refining, quarrying or mining operations of any kind shall be permitted upon or in any lot, nor shall oil wells, tanks, tunnels, mineral excavations or shafts be permitted upon or in any lot. No derrick or structures designated for use in boring for oil or natural gas shall be erected, maintained or permitted upon any lot. C-15. LIVESTOCK AND POULTRY. No animals, livestock or poultry of any kind may be raised, bred or kept on any tract, except that dogs or cats may be kept, on any lot provided that they are not kept, bred or maintained for any commercial purpose and provided that facilities for maintenance of same are approved by the Architectural Control Committee and that the keeping of same does not constitute a nuisance. C-16. GARBAGE AND REFUSE DISPOSAL. No lot or easement shall be used or maintained as a dumping ground for rubbish. Trash, garbage and other waste shall not be kept except in sanitary containers. There shall be no burning of trash, rubbish, leaves or yard waste. C-17 SIGHT DISTANCE AT INTERSECTIONS. No fence, wall, hedge or shrub planting which obstructs sight lines at elevations between 2 and 6 feet above the roadways shall be placed or permitted to remain on any lot corner which the triangular area formed by the street property lines and the line connecting them at points 15 feet from the intersection of street right of way M lines, or in the case of a rounded property corner, from the intersection of the street property line extended. The same sight line limitations shall apply on any lot within 10 feet from the intersection of the street property line with the edge of a driveway pavement. No tree shall be permitted to remain within such distances or such intersections unless the foliage line is maintained at sufficient height to prevent obstruction of such sight lines. C-18. LOT, YARD AND HOME MAINTENANCE. Taylor Park Recreational Facilities Multipurpose Improvement District #27 is responsible for yard maintenance of mowing, edging, raking or power blowing, including the cleanup process needed to accomplish uniformity of all grounds in said subdivision, as set forth in the By -Laws of said Improvement District. All yards must be fully sodded and shall have sprinkler systems installed. All houses shall be painted and stained and must have landscaping beds in the front. No yard art, yard ornaments, sculptures pennitted without the approval of the ACC. No deviation from the original plans shall be permitted without approval of the Architectural Control Committee. C-19 COMMENCEMENT OF CONSTRUCTION. A property owner must start construction of an approved dwelling within a period of one (1) year from date of purchase. The developer reserves the option to repurchase any lot for the amount of the original purchase price if construction is not commenced within such period of time. This option shall be exercised in writing within a period of thirty (30) days after the one (1) year period. C-20 COMPLETION OF CONSTRUCTION. Any dwelling must be completed in its entirety within a period of one year from date such construction is commenced, C-21 MOTOR VEHICLE PARKING. Abandoned or unused motor vehicles shall not be parked or permitted to remain on any lot or within the dedicated street. Boats, recreational vehicles and trailers cannot be parked at the front or side of any dwelling or in the dedicated street and must be parked in back of the dwelling. Owners or permanent residents are prohibited from parking in the street. There shall be no non-functioning vehicles kept on the lot or in view of the public. There shall be no repair work done outside of the garage. C-22. MINIMUM FLOOR LEVEL ELEVATIONS. The Architectural Control Committee reserves the right to prescribe the minimum floor elevations for lots. All homes shall have a minimum floor elevation of one foot above the back of the curb unless waived in writing i y Lhe Architectural Control Committee. C-23. MAINTENANCE OF ROOF ON PARTY WALL TOWNHOUSES. The property owners of each Townhouse Unit shall be responsible for the cost of all roof maintenance and repairs over their particular unit. When replacement of the roof is needed, each property owner in the unit under consideration will be responsible for their pro -rata share of the cost of roof replacement. If owners fail to have a consensus on roof replacement, the Commissioners of the Little Rock Municipal Multipurpose Property Owner's Improvement District No. 27 may instruct owners to replace roof in order to maintain a harmonious atmosphere within the subdivision. In the event of any involuntary participation by the homeowners in unit under consideration (ie..nonpayment), the Taylor Park Recreational Improvement District shall pay the cost incurred 5 and has the authority to levy said cost onto the improvement assessment tax base. To simplify, final authority for roof replacement as to need, color selection and type of shingles shall remain with the Commissioners of the Little Rock Municipal Multipurpose Property Owner's Improvement District No. 27.Townhouse The commissioners shall act in a manner conducive to all of the residents of Taylor Park. Units are Lots 1-4, 5-7, 8-11, 12-15, 16-18, 19-22 in Block 4 and Lots 1-4, 5-7, 8-11, 12-15, 16- 18, 19-22 in Block 5. PART D. ARCHITECTURAL CONTROL COMMITTEE: D-1 MEMBERSHIP. The Architectural Control Committee shall be composed of the Commissioners of the Little Rock Municipal Multipurpose Property Owner's Improvement District No. 27. A majority of the committee may designate a representative to act for it, In the event of death or resignation of any member of the committee, the remaining members shall have full authority to designate a successor. Neither the members of the committee nor its designated representative shall be entitled to any compensation for there services performed pursuant to this covenant. D-2 PROCEDURE. The committee's approval or disapproval as required in these covenants shall be in writing and in the form hereto attached marked Exhibit "A" which, when executed, should be retained by the owner/builder as proof of the Committee's approval. In the event the committee or its designated representative fails to approve or disapprove within 30 days after plans and specification have been submitted to it or in the event no suit to enjoin the construction or compliance with these covenants has been commenced within 180 days after the completion thereof will not be required and the related covenants shall be deemed to have been fully complied with. PART E. RECREATIONAL FACILITIES MULTIPURPOSE IMPROVEMENT DISTRICT E E-1 MEMBERSHIP. Property owners shall become members of the Little Rock Municipal Multipurpose Property Owner's Improvement District No. 27 — Taylor Park Recreational 1-acilities Project, commonly known as Taylor Park Recreational Facilities Multipurpose Improvement District No. 27, as set forth in the records of the office of Pulaski County Circuit and County Court and shall be bound by all Declaration, By -Laws and Covenants currently established with said District and those amended and executed hereafter, Membership shall be appurtenant to and may not be separated from ownership of any tract which is subject to assessment, PART F. GENERAL PROVISIONS: F- 1. TERM. These covenants are to run with the land and shall be binding on all parties and all persons claiming under there for a period of twenty-five years from the date these covenants C8i are recorded after which time, said covenants shall be automatically extended for successive period of ten years, subject to the express provision that these covenants may be amended at any time after the date of execution hereby by an instrument signed by the members of the Architectural Control Committee and the owner or owners of a majority of the lots herein platted. F-2 ENFORCEMENT. Enforcement shall be by proceedings at law or in equity against any person or persons violating or attempting to violate any covenant either to restrain violations or to recover damages. F-3 SEVERABILITY Invalidation of any one of these covenants by judgment or court order shall in no way affect any of the other provisions which shall remain in full force and effect. PART G. SPECIAL IMPROVEMENT DISTRICTS G- 1. It is agreed and understood that all lots in this subdivision are part of the Little Rock Municipal Property Owners Multipurpose Improvement District No. 26- Taylor Park Project and the Little Rock Municipal Property Owners Multipurpose Improvement District No. 27- Taylor Park Recreational Facilities Project and SUBJECT TO A SPECIAL TAX ASSESSMENT TO REPAY THE DISTRICT DEBT.
