Conditional Use Permit
LOCATION: 6803 Shaner Circle
OWNER/APPLICANT: David Strong
PROPOSAL: A conditional use permit is requested to allow for
placement of a multisectional manufactured home on
this R-2 zoned 1.18 acre lot.
SITE LOCATION:
The property is located at the southern end of Shaner Circle, north of
Raines Road. The property is not located in the city limits but is within the
City's extraterritorial jurisdiction.
2. COMPATIBILITY WITH NEIGHBORHOOD:
The property is located in a rural residential area. Uses include site built
homes, multisectional manufactured homes, single -wide manufactured
homes and mobile homes. The property to the north was rezoned to AF
several years ago to allow that property owner to operate a greenhouse.
The proposed multisectional manufactured home is compatible with uses
in the area.
All owners of properties located within 200 feet of the site; all residents
within 300 feet who could be identified and SWLR United for Progress
were notified of this request.
3. ON SITE DRIVES AND PARKING:
The home is required to have one on-site parking space. The applicant
proposes to construct a single driveway with a parking and that will
accommodate two or more vehicles.

SUBDIVISION COMMITTEE COMMENT: (APRIL 17, 2005)
The applicant was present. Staff presented the item and noted there were few
outstanding issues. Staff asked that the applicant provide more information on
the proposed home; including size, year model and external finish. Staff also
asked that the applicant provide approval from the local volunteer fire
department.
There were no other comments. The Committee forwarded the item to the full
Commission after directing the applicant to respond to staff issues by April 13,
2005.
STAFF ANALYSIS:
The applicant is requesting approval of a conditional use permit to allow for
placement of a multisectional manufactured home on this R-2 zoned, 1.18 acre
lot. The property is located outside of the city limits but within the City's
extraterritorial jurisdiction. The site is located in an area that is characterized by
a variety of housing types; including site built homes, single wide and
multisectional manufactured homes and mobile homes.
The proposed home is to be a 2000 model or newer. The home contains
approximately 1,100 square feet and has two bedrooms. Health Department
approval for the septic system has been provided as has approval from the

Crystal Fire Department. A new driveway will be installed off of the west side of
Shaner Circle. The proposed new home has setbacks of 56 feet on the north, 70
feet on the west, 100 feet on the east and 120 feet on the south. Placement of
the home must comply with the siting criteria of Section 36-254.(d)(5) of the
code. The home is to have a masonite exterior.
To staff's knowledge, there are no outstanding issues.
STAFF RECOMMENDATION:
Staff recommends approval of the requested conditional use permit subject to
compliance with the following siting criteria of Section 36-254.(d)(5) of the Code:
a. A pitched roof of three (3) in twelve (12) or fourteen (14) degrees or
greater.
b. Removal of all transport elements.
c. Permanent foundation.
d. Exterior wall finished so as to be compatible with the neighborhood.
e. Orientation compatible with placement of adjacent structures.
f. Underpinning with permanent materials.
g. All homes shall be multisectional.
h. Off-street parking per single-family dwelling standard.
PLANNING COMMISSION ACTION: (APRIL 28, 2005)
The applicant was present. There were no objectors present. Staff presented
the item and a recommendation of approval subject to compliance with the
conditions outlined in the "Staff Recommendation" above. There was no further
discussion.
The item was placed on the Consent Agenda and approved as recommended by
staff by a vote of 10 ayes, 0 noes and 1 absent.
