Submitted by: Department of Planning and Development SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION Action Required 4Ordinance Resolution Approval Information Report Approved By Bruce Moore The request is to amend the previously approved PCD to add eating -place inside with bar service as an allowable uses. I None. Staff recommends approval of the requested PCD zoning. The Planning Commission voted to recommend approval of the requested zoning by a vote of 9 ayes, 0 noes and 2 absent. The Planning Commission reviewed the proposed PCD request at its October 6, 2011, meeting. There were no registered objectors present. All owners of property located within 200 -feet of the site, the Southwest Little Rock United for Progress and the Otter Creek Property Owners Association were notified of the Public Hearing. BACKGROUND On April 5, 2005, the Little Rock Board of Directors adopted Ordinance No. 19,293 establishing Dennis Short - form PCD. The applicant proposed the rezoning of the site located at 11421 Stagecoach Road from R-2, Single-family to PCD to allow the development of an office/warehouse development on the site. The site plan included the development of two buildings in two phases with 29,688 square feet of office/warehouse in the first phase and 39,688 square feet in Phase 2. The buildings were proposed as metal buildings with a glass office entry door and warehouse entry of overhead door in the front and in the rear of the buildings for each unit. All units would face Stagecoach Road and would have large parking areas and large areas for business vehicles to access the front and back of the building for material pick up or delivery. The sizes of the rental units would vary depending on the tenant's need. Office, showroom, warehousing with retail sales was approved as an allowable use. The applicant indicated the site would be marketed to end-users with a need for warehouse and office space from individuals to corporations. The applicant indicated the primary use of the site would be for storage, warehouse, distribution, manufacturing of goods or those that need more office and operating space with a storage area. The perspective tenants proposed (but not limited to) were general contractors, construction companies of different trades, material supply companies and those who have products to sell to the public such as an electrical supply business both wholesale and retail, plumbing supply both wholesale and retail or paint and wallpaper store both wholesale and retail. The approval also included tool and equipment rental with no outdoor display. On April 3, 2007, the Little Rock Board of Directors adopted Ordinance No. 19,737 revising the previously approved PCD for this site. The amendment added additional uses as allowable uses to the site. The listing of uses added is as follows: Ambulance post, Animal clinic, enclosed, Appliance repair, Auto glass muffler shop, Auto parts and accessories, Eating place without drive in or dine in service, enclosed, Storage company, moving company, Job printing, Light fabrication and assembly, Office general 2 BACKGROUND CONTINUED and professional, Plumbing, electrical, heat and air shop, Studio, broadcasting, recording, Studio, art, music and dance, Cabinet shop, Furniture repair, Fire station, Machine or welding shop, Machine sales and service, Photo studio, Swimming pool sales and supply, Taxidermist, Hardware, sporting goods, Glass shop, installation and repair, Antique shop, Medical appliance and fitting sales, Tire sales and installation, Paint and wail paper store, Flooring sales, Material suppliers. The applicant is now proposing to amend the previously approved PCD to add eating -place inside with bar service as an allowable uses. The site is fully developed with 63,495 square feet of retail/office/warehouse space. The eating -place inside is proposed to occupy 7,187 square feet of the total square footage of the site. The applicant has indicated on the site plan additional striping within the paved areas to add sufficient parking to serve the proposed use. With the additional striping there will be 186 parking spaces to serve the development. The days and hours of operation for the development will be from 6:00 am to 2:00 am daily. Below are the questions and comments from the POA. Have we recieved the revised hours of operation from Tommie Hodges? Please address the questions comments below, I am not able to explain the "bar" use and I do not know what the staff is looking for or concerned about in regards to bars in a restaurant. My objections to hours and the applicant agreeing to change the hours was a way to prevent the location from turning into a bar only -since we cannot always count on the ABC to help with that. As I have worked on ABC permits in the past the abc/restaurant approval says they only have to serve 1 meal a day in order to get a restaurant bar approval. This application will come before the board on tuesday night -so I request that we address these concerns quickly. bjwyrick From: Karen King To: BJ Wyrick Sent: Thu Oct 27 17:45:04 2011 Subject: RE: Emailing: Write-Up%20for%20Z-7786-B My calculations showed a requirement of about 241 spaces. Upon re -reading I see that planning is accepting 186 on the "idea" that some of the uses won't be operating at the same time as the restaurant. The original app is for 6am to 2am. So here is an Interesting question, when do the other businesses operate then??? In any case it seems planning is somehow justifying in order allowing less than the standard parking requirement. In regard to the ABC license I was required in the past on a PID to state the type of license being applied for so that the public could be informed as to what exactly would be allowed in the "bar". Meaning would there be beer and wine, or this plus mixed drink and if there would be a Sunday permit allowed in that space. You cannot control the ABC permit but it will never be applied for if it isn't an allowed use. Planning has the ability to require the app to be as specific as they like before approving, so why not this one? I think it is material what will be sold and if Sundays are allowed and these are all separate permits. Planning and the Board has the ability to require these details before deciding if they want another "bar" in our area depending on what exactly will be available and when, do they not? Some may think that beer and wine only with no hard liquor during regular "restaurant hours" is no problem. Some will think anything goes. Some won't want more Sunday sales. But how does the public in the area question or raise concerns if they don't have all the facts. Does this make sense? I don't see 7 days a week as an issue. I think we'd all like to see another restaurant in the area but I don't know if this community wants another bar. I think most restaurants in LR even with bars stay open until 10 during the week and some till 11 on the weekends. For instance Outback's hours are Mon: 4:00 PM -10:00 PM Tue: 4:00 PM -10:00 PM Wed: 4:00 PM -10:00 PM Thu: 4:00 PM -10:00 PM 10/28/2011 Page 2 of 3 Fri: 4:00 PM -11:00 PM Sat: 3:00 PM -11:00 PM Sun: 11:30 AM- 9:30 PM This makes hours look even more material in my mind. It is thought among many that liquor brings crime. I don't know what the statistics would show but the fact that the previous pizza place went out of business because that had been robbed at gunpoint I believe 3 different times might raise some more red flags about a bar in this area. I'd say they were having some problems... I realize the development was approved but this is an amendment to that approval so it is open season as to the detail that planning and / or the Board requires before approving any change or addition. After it's approved it's too late to go back. I'd very much like to provide our Board with more detail regarding hours, the type of liquor permits to be allowed, if there will be entertainment allowed and if so would it be family appropriate only. Details I know have been required in past applications. Thank you for looking into this for us. We always appreciate your time and work to keep our area growing in a positive direction. What are you seeing or not seeing in regards to the parking that needs to be addressed.? The liquor license will go through the ABC..hours they can sell etc are under their rules. Hours of operation in my mind were the most critical thing that we could limit ... since we cannot control the ABC permit..we can object but we are not always successful with that effort. If we limit the hours we (the city can hold them to those hours). That is why I went to Tommy and told him I had a problem with the hours. Tommy said that was not a problem..lt sounded like originally he had someone to lease to but now he does not have one. What hours would be reasonable.. The other issue that I noted was 7 days a week -you might state your position on 7 day a week restaurant..6:00am til? Another flag to me. This is an existing PCD and this app is requesting an additional use of "eating place inside with Bar use." The original PCD was approved with" eating place without drive in or dine in service -enclosed". This would be like the Paxton Pizza place that you order a pick up pizza's. The Pizza place that went out of business had a bar -were there issues with that location that you know about? What hours of operation did they have? Since the development was already approved this app is a typical app. What else do you thing we should see in this application? I will forward this to the planning group..l welcome the POA's appearance at the board meeting. Thanks Bjwyrick PS..Event Center is a classification of zoning on its own merit. The app would have to state events center. Also club would need to be stated. So if he wanted these uses he would have to revise the PCD. Will the Board require remedy to the parking issue by revised site plan prior to approving? I have run an app for restaurant with bar myself in a less populated industrial area and was required by planning to submit much more specific details and stringent guidelines for which the business was to operate. I am shocked that planning recommended approval of this app with little to no explanation of the bar services. What type of liquor license? Hours liquor is actually served within the business hours (this will depend on the license as well)? 7,200 square feet in this area and no real questioning of the event center use? I heard the question asked verbally but I would think they would require the app to specifically state that it would not be used as an event center or for special events of any kind. I also think it is important that it specifically state that there is to be no entertainment or what kind and when and that it is for all ages or if not, why. If the original app was until 2am was it going to over 21 at a certain time and why? Stated verbally or not, you and I know that if these items aren't in the app that's approved then we don't have any guarantee of enforcement against other uses that are slipped in along the way. With all due respect to Mr. Hodges, he may or may not own this property forever so there is more to consider than his word. Also, his and others opinions may vary as to what is acceptable under this app. This is why there is a PCD, so the city can control the use not the person. I'll charge with you delivering our concerns to planning. Please let me know if they are requiring further explanation in the formal app and if so if we could see those additions. If we do not get some assurances in writing the BOD can expect to see us next week with our questions and concerns. Upon re -reading I see that planning is accepting 186 on the "idea" that some of the uses won't be operating at the same time as the restaurant. The original app is for 6am to 2am. So here is an Interesting question, when do the other businesses operate then??? In any case it seems planning is somehow justifying in order allowing less than the standard parking requirement. In regard to the ABC license I was required in the past on a PID to state the type of license being applied for so that the public could be informed as to what exactly would be allowed in the "bar". Meaning would there be beer and wine, or this plus mixed drink and if there would be a Sunday permit allowed in that space. You cannot control the ABC permit but it will never be applied for if it isn't an allowed use. Planning has the ability to require the app to be as specific as they like before approving, so why not this one? I think it is material what will be sold and if Sundays are allowed and these are all separate permits. Planning and the Board has the ability to require these details before deciding if they want another "bar" in our area depending on what exactly will be available and when, do they not? Some may think that beer and wine only with no hard liquor during regular "restaurant hours" is no problem. Some will think anything goes. Some won't want more Sunday sales. But how does the 10/28/2011 Page 2 of 3 public in the area question or raise concerns if they don't have all the facts. Does this make sense? I don't see 7 days a week as an issue. I think we'd all like to see another restaurant in the area but I don't know if this community wants another bar. I think most restaurants in LR even with bars stay open until 10 during the week and some till 11 on the weekends. For instance Outback's hours are Mon: 4:00 PM -10:00 PM Tue: 4:00 PM -10:00 PM Wed: 4:00 PM -10:00 PM Thu: 4:00 PM -10:00 PM Fri: 4:00 PM -11:00 PM Sat: 3:00 PM -11:00 PM Sun: 11:30 AM- 9:30 PM This makes hours look even more material in my mind. It is thought among many that liquor brings crime. I don't know what the statistics would show but the fact that the previous pizza place went out of business because that had been robbed at gunpoint I believe 3 different times might raise some more red flags about a bar in this area. I'd say they were having some problems... I realize the development was approved but this is an amendment to that approval so it is open season as to the detail that planning and / or the Board requires before approving any change or addition. After it's approved it's too late to go back. I'd very much like to provide our Board with more detail regarding hours, the type of liquor permits to be allowed, if there will be entertainment allowed and if so would it be family appropriate only. Hours liquor is actually served within the business hours (this will depend on the license as well)? 7,200 square feet in this area and no real questioning of the event center use? I heard the question asked verbally but I would think they would require the app to specifically state that it would not be used as an event center or for special events of any kind. I also think it is important that it specifically state that there is to be no entertainment or what kind and when and that it is for all ages or if not, why. If the original app was until 2am was it going to over 21 at a certain time and why? Stated verbally or not, you and I know that if these items aren't in the app that's approved then we don't have any guarantee of enforcement against other uses that are slipped in along the way. With all due respect to Mr. Hodges, he may or may not own this property forever so there is more to consider than his word.
