We are one of the landowners to the west of the subject area and very frequently drive on this part of Lawson Road. David is also a professional in the transportation industry and is usually supportive of continued development in the Little Rock area. The quarry operation likely got started this section of Lawson Road since the terrain & McHenry Creek don't make residential development a viable option. But these same factors also affect public travel on this section, including a sharp turn at the bottom of a hill and winding road alignment with very minimal room for shoulders or recovery zones from opposing vehicles that stray from their travel lane. I believe the accident records would support this fact since it seems that frequent severe vehicular accidents close down the road and/or knock down power poles, cutting off power to areas to the west. Our biggest concern about the rezoning of property from R2 to PID is the increase in large trucks traveling on the route to and from an asphalt plant and aggregate mining & storage operation, adding more potential of severe accidents to an already dangerous situation. The ADT count of vehicles from west Pulaski County and Saline County traveling to and from Little Rock is probably fairly high. So this rezoning would affect a large number of people with added safety risk in their lives. Without any mitigation like significantly improving route conditions mentioned above, we believe that the rezoning would not be a prudent action to take for the city of Little Rock or for those who travel this section of Lawson Road. Our original long term goal was to develop the quarry as well as build an asphalt plant within the original foot print (and zoning) of the quarry area. The existing zoning on the existing quarry property allows for both quarrying and has a portion of the property zoned 13 which would allow for the operation of an asphalt plant. Our original plan provided for the future asphalt plant to be located within the 13 East of Hugh Taylor and North of Lawson Road within the 13 zoning. Within the last year we purchased the adjacent 25 acres to allow for material storage and to build a pond downstream of the existing quarry site for a water supply. We originally asked for Industrial Zoning of this property for material storage and to build a pond for usable water source as its immediate short term usage. We were directed by City of Little Rock Zoning staff that we had to zone the property for mining even though mining was not the intent of the property we agreed and the property was approved for mining to allow for material storage. We now seek to develop the property with a PID to accommodate the future Rahling road extension. Subsequently one of the conditions of the zoning approval was we were to deed over to the City of Little Rock the easement for the future Rahling Road extension. When we submitted the original property for zoning we had not been given the City of Little Rocks location of the road until "after" the zoning was approved. Once the future road was plotted onto the survey we realized the impact the road would have. The future road will cause us to lose approximately 2.5-3 acres (10%) of our property once the road is built. We will be able to utilize this property via a franchise agreement but eventually the property will be unusable to us. This was discovered "after" zoning was approved and has caused us to re-evaluate the entire property and its uses. We have no problem deeding the property to the City of Little Rock. We now intend to install the future Asphalt Plant within the 25 acres purchased to the West and will lye East of the future Rahling road. The previous owner of the 25 acres will not vacate the property until the end of this year. The short term uses of the property are as previously submitted to use as a storage area. The longer term use of the property would be to build a structure for maintenance and storage of equipment as well as the asphalt plant we would expect this with 3-5 years. I am concerned about these because: 1.) I feel it will likely harm property values. I don't think anyone could argue, convincingly, this rezoning will help area property values. My home is the biggest investment I have and I want to do all I can to protect it. I think of the homeowners in McHenry Estates. This re -zoning will literally be in their backyards. 2.) I would like this part of the county to continue to be residential. The gravel quarry, its expansion and adding an ashpalt plant will definitely make that part of Lawson more industrial. As far as I am concerned it is industrial enough as it is. What becomes of those properties once the site is mined out? There are too many instances where owners of such projects/properties abandon them once they are finished and leave taxpayers with the bill to reclaim the land and try to correct a wrong. The quarry is destroying the natural beauty of the land and there is no way to return it to its natural state. 3.) Since the existing rock quarry has re -opened dump trucks are part of the daily traffic flow. The pounding to which the roads are subjected will take its toll on the local infrastructure. The debris dump trucks inevitably drop will leave family vehicles with cracked windshields and other damages. 4.) I am concerned about the pollution an ashphalt plant will cause and the odor it will likely create. If you've ever been on a roadway that is being paved and you're sitting behind the hopper as the dump trucks dump their load into the hopper you know about the odor to which I am speaking. 5.) The exising quarry creates a lot of noise pollution already. When I sit on my front porch I can hear the beeping of the equipment as it backs up on the site. I hear equipment operating in other ways. Almost daily as I was to go to work I can hear work already ongoing. Expanding the mining territory is only going to make that worse. How many acres is enough for this mine? In short, I AM OPPOSED TO THE RE-ZOING AND OTHER CHANGES BEING REQUESTED. I would like to see the property remain zoned residential. Regards, Wayne Vickery 80 Plantation Acres Drive July 9, 2013 Dear Planning Commissioners: 1 strongly opposed the rezoning along Lawson Road to allow the addition of an asphalt plant and the expansion of the cement plant. I am out of town and cannot make the meeting, but would like my voice heard. The changes will increase the truck traffic on a narrow road that already has heavy car and truck traffic. It will increase the number of accidents on the road and maybe result in a fatal accident. There is a curve a few hundred yards from the cement plant that is nicknamed "Dead Man's Curve," because it is a 75 -degree curve on a hill. Accidents happen frequently here. As you proceed down the hill from Crystal Valley Road, there is a blind entrance to the right where trucks enter from the gravel quarry. After rain, the trucks track mud on the road making it slick. After you pass "Dead Man's Curve," there is a blind entrance from the left that intersects Lawson at an angle that makes it difficult for entering vehicles to see other vehicles coming down the hill. Trucks from the asphalt plant and the gravel expansion would use this road to get onto Lawson Road and increase danger. Lawson Road does not have shoulders and passing lanes to get by trucks. Trucks back up the traffic and increase frustration in drivers. Furthermore, when there is an accident on Lawson Road at "Dead Man's Curve" or near the cement plant, there is no way to detour around the accident, because there are no connecting roads. One has to turn around and drive three miles back to Cornell Glenn and find some other route or to be stuck in traffic for a long time. Asphalt plants are a source of air pollution. Asphalt plants produce many toxic or hazardous chemicals. Although the technology exists to control these toxic chemicals, we have no assurance that a new plant would incorporate the technology, maintain it in good working order, and would be monitored frequently enough. However, the critical problem with asphalt plants is out -gassing from the trucks. The technology to control emissions from loading and using asphalt trucks is poor. If you think about what it is like to drive behind an asphalt truck or drive by an asphalt truck and roadwork, those are the smells and emissions that we will be exposed to daily. Lastly, property values will suffer from having an asphalt plant nearby and emissions and odor from the trucks. In addition, the asphalt truck traffic on Lawson, Crystal Valley, Plantation Acres Drive, and other roads will affect the quality of life and property values. 1 urge you to reject the application for rezoning, establishment of an asphalt plant, and expansion of the gravel operations. Sincerely, Kathleen Whaley, Homeowner 48 Plantation Acres Drive Little Rock AR 72210 Open meeting to discuss the proposed mine expansion and asphalt plant on Lawson Road Thanks to Elaine Burks, we know that Little Rock Quarries has applied for rezoning permits in areas adjoining the current gravel mine on Lawson Road. One request is to rezone 25.8 acres of land that is currently zoned R-2, Single Family to Planned Industrial Development. This land would be used for the siting of an asphalt plant and for materials storage for the associated gravel mine. The second request is to re -zone 18.82 acres from R-2, Single Family to Mining in order to expand the current gravel mine. These properties are less than a mile (as the crow flies) from the intersection of Plantation Acres Drive and Royal Oak Drive. The Little Rock Planning Commission will consider these applications on July 11 at 5 pm at City Hall (500 W. Markham St., 2"d FIoor Board Room). We should ask ourselves if these changes affect us, either positively or negatively. We should also discuss whether we should respond as an association or simply as individuals. We will have an open meeting to discuss the proposed changes at 7 pm on Tuesday, July 2 at Jennifer and Joel Schmidt's house (71 Plantation Acres Dr.). We will be outside please bring your lawn chair. There are several opinions about the asphalt plant. At least one member of our neighborhood thinks it will cause no problems. Other neighbors are opposed to the asphalt plant. Reasons for opposition that I have heard include the following: (1) increased traffic, especially of large, heavy trucks, both on Lawson and on Plantation Acres Dr.; (2) increased risk of accidents, especially on the dangerous curve of Lawson Road, just west of Hugh Taylor Road; (3) increased air or water pollution; (4) decreased property values.
