DISTRICT TITLED WHISPERING HILLS LONG -
FORM PD -R (Z-7773) IN THE CITY OF LITTLE
ROCK, ARKANSAS, AMENDING THE OFFICIAL
ZONING MAP OF THE CITY OF LITTLE ROCK;
AND FOR OTHER PURPOSES.
WHEREAS, on February 1, 2005, Ordinance No. 19,271 was passed by the Board
of Directors of the City of Little Rock, Arkansas which established a Planned Residential
District titled Whispering Hills Long -form PD -R (Z-7773), Little Rock, Arkansas; and
WHEREAS, on January 9, 2006, the applicant submitted a request that the
Planned Residential District be revoked and the previous zoning of R-2, Single-family
District be restored.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. That Ordinance No. 19,271 is hereby repealed.
SECTION 2. That the preliminary site development plan/plat approved by
Ordinance No. 19,271 is hereby revoked.
SECTION 3. That the PD -R classification of the property described as
Whispering Hills Long -form PD -R (Z-7773) to the City of Little Rock, Arkansas and
further described as follows is revoked and the former R-2, Single-family zoning
classification is restored on the official zoning map.
Part of the NE '/4 NW `/4 Section 17, T -1-S, R -13-W, Pulaski County,
Arkansas, more particularly described as: Commencing at a found axle
marking the Southeast corner of said NE `/4 NW '/4 thence S89149'55"W
along the South line of said NE'/4 NW '/4 150.0' to the Point of Beginning;
thence continue S89°49'55"W along said South line 659.65' to a found ``/z"
rebar marking the Southeast corner of Lot 10, Whispering Hills
Subdivision as recorded in Plat Book 13 on Page 42; thence
N00°08'02"W along the East line of said Lot 10 200.0' to a found %2"

Section 3 hereof.
SECTION 5. That this Ordinance shall take effect and be in full force 30 days
after the date of its passage and approval.
SECTION 6. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same,
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.

SYNOPSIS
The applicant submitted a request dated January 9, 2006,
requesting the current PD -R zoning classification be
revoked and the previously held R-2 zoning be restored.
FISCAL IMPACT
None.
RECOMMENDATION
Staff recommends approval of the requested revocation.
The Planning Commission voted to recommend approval
of the requested revocation, as recommended by Staff, by a
vote of 8 ayes, 0 noes, 1 absent and 2 recusals (Troy Laha,
Mizan Rahman).
CITIZEN
The Planning Commission reviewed the proposed
PARTICIPATION
revocation request at its March 3, 2006, meeting. There
were two registered objectors present. All property owners
located within 200 -feet of the site, all residents who could
be identified, located within 300 -feet of the site, Southwest
Little Rock United for Progress and the Alexander Road
Neighborhood Association were notified of the public
hearing.
BACKGROUND
Ordinance No. 19,271 adopted by the Little Rock Board of
Directors on February 1, 2005, established Whispering
Hills Short -form PD -R. The rezoning was from R-2 to
PD -R to allow the development of a residential
subdivision. There were several variances requested with
the development of the site, therefore the planned
development process was utilized. The developer
intended to develop the subdivision with 15 single-family
homes.
The applicant submitted a request dated January 9, 2006,
requesting the current PD -R zoning be revoked and the
previous R-2, Single-family District zoning classification
be restored. The applicant has indicated the proposed
residential development will not be constructed on the site
as proposed. Per Section 36-454(d) the Owner may for
cause request repeal of the ordinance establishing the
development.

Dear Ms. James:
I would like to suggest several things that might be important on the Evans subdivision south of Alexander
Road and east of Whispering Drive. I am retired, but have a Civil Engineering degree with about 24 graduate
hours. If I were not housebound I would be at the meeting, but I don't think I can make it.
The current proposed subdivision consists of an extension to the east of Whispering Drive, terminating in a cul-
de-sac on the property owned by Mr. Evans, with several lots for single family housing. My main objection is as
follows: during the time the construction is underway I fear the trucks hauling gravel or stone, building
materials, concrete for curbs and gutters, heavy equipment for earth moving and other such trucks and
equipment will break through the existing surface and base of Whispering Drive. All of the aforesaid
equipment could very easily ruin Whispering Drive, especially if it comes in frequently.
We have lived on Whispering Drive since April 1964, when the street was only a gravel road. About 1966 it
was upgraded to a single coat of asphaltic -treated chip seal. Sometime in the 1980's the road received another
single coat of asphaltic seal and chips. These improvements were made by Pulaski County. My observations at
the time were that the two coats together would not equal a double bituminous surface treatment (DBST), which
my workers have applied several times. I have also observed it being applied in Arkansas and Arizona. I was
working for a highway contractor in Arkansas and also the Arkansas Highway Department when I observed the
DBST being applied in Arkansas. I was working for the Arizona Highway Department when I observed it
being applied there.
In the process of pavement design DBST would be accorded a structural value considerably more than just
gravel and one coat of asphalt. Pavement breaks down due to repeated applications of heavy wheel loads. It is
difficult to calculate values for DBST and a single seal of asphalt, because there is not a direct linear
comparison between the two. Considering the amount of asphalt chips in each, the rough ratio between DBST
and single bituminous surface treatment is about 5 to 1 in Pavement Design Value, conservatively speaking.
I suggest that the City of Little Rock require a performance bond in the amount of the contract to ensure the
pavement holds up. Or, if third -party oversight is required by the City with quality control on the base and
surfacing, which I recommend, the quality control need be only the base and surfacing and a performance bond
on the contract amount remaining. I know the City of Little Rock does not have money to replace the project
base and surfacing, so the contractor must be watched and controlled. Due to the difference in the strength of
single bituminous treatment, which now exists on Whispering Drive, and the DBST which I assume will be put
in on the new portion of Whispering Drive, quality control will be critical.

Also, money included in the contract to control the asphalt plant is money very well spent with the price of oil
being what it is. This is something that I feel is very important and can save the City quite a bit of money. Also
controlling the amount of liquid asphalt applied in the DBST is important or the City will not get enough
asphalt on the road. The highest priced materials are the ones the contractor might short, therefore we must
watch asphalt, crushed stone, and sand.
I appreciate the opportunity you have given me to comment on Mr. Evan's subdivision. I have seen many
problems on Alexander Road and Whispering Drive since we have lived here. Since there is a cul-de-sac, I
think the treatment of Whispering Drive and its extension to the east is important. If you have any questions
