On behalf of AXPM, I am requesting a variance for the sign at 610 President Clinton
Avenue. The sign is for a new coffee shop in the River Market District. Because of the
shape of the sign, we had to increase the size to the point that it exceeds the 3'-0"
maximum projection. We are requesting a 4'-0" projection total of which the sign is
only 3'-6" with a 6" wall bracket. We believe it adheres to the goals of the River
Market District and will be a good addition to the District.
As you know, we have worked with the River Market Design Review Committee to
get their approval. The committee passed it with unanimous support of the design.

PROPOSAL/REQUEST:
The proposal is for Projecting Sign and Storefront Windows and Doors.
The ordinance states:
Sec. 36-353.
Signs.
(a) Signs
in general.
(1) Location.
a.
Signs shall not hide significant architectural detail or features of a building.
b.
Signs shall not visually clutter nor interfere with views of the building.
c.
Wall signs shall be confined to the flat surface of the building and shall not
project more than five (5) inches from the building facade.
d.
Signs shall not be painted directly on the face of a building.
e.
Awning valences are appropriate locations for signage.
f.
Freestanding signage is prohibited.
g.
Signs shall be adequately spaced from other signs.
h.
All signs must face public street right-of-way except those permitted on
facades facing the Arkansas River.
(2) Appearance.
a. Signs shall be compatible with the architecture of the building on which it is
located.
b. Design of signs shall capitalize on the special character of the District.
c. Window signs shall not cover more than twenty-five (25) percent of each
glass panel.
d. Awning signs shall not exceed twelve (12) square feet per awning.
e. Neon illumination is permitted.
f. Internally illuminated signs are prohibited.
g. In accordance with federal law, businesses with registered trademarks are
allowed to display the mark in signage which otherwise complies with City
sign regulations.
h. Advertising copy on signs is prohibited.
i. Materials used in signs shall be sensitive to signs and architecture on
adjacent sites.
(e) Projecting signs.
(1) Location.

a. Projecting signs shall maintain a nine -foot clearance in all pedestrian
walkways and a thirteen -foot clearance over vehicular use areas, i.e. alleys
and driveways.
b. Height of projecting signs shall not extend past the sill of the second story
windows.
c. Projecting signs shall extend a maximum of three (3) feet from the face of
the building.
d. The number of projecting signs shall be limited to one sign per one hundred
(100) feet of street frontage per building.
e. Projecting signs shall be placed at a ninety -degree angle to the building.
f. Signs shall be spaced so not to conflict or obscure other signage.
(2) Appearance.
a. Projecting signs shall have a maximum of twenty five (25) square feet of sign
face per sign.
b. Thickness of projecting signs shall be limited to twelve (12) inches.
c. Signage colors, typeface, and style shall be compatible with the district.
(3) Sign illumination.
a. Internally lit signs are prohibited. When projecting signs are externally lit,
they shall be illuminated from a concealed source of light or a decorative
source that is integral to the design of the sign.
b. Neon is permitted on projecting signs. No movement, flashing, or change of
illumination level shall be permitted on signs. Each neon sign shall have a
one-year maintenance review, by city staff, for functionality.

The proposed sign is custom fabricated aluminum sign with exterior mounting brackets and is
approximately 9.62 square feet in area. The outer edge projects 4 feet from edge of building
with six inches of clearance between it and the building. It will feature white neon trim with an
internally illuminated face of white Plexiglas. The surface graphics will be applied to the white
Plexiglas. The sign is double faced. The thickness of the sign is eleven inches. There is
proposed to be two tubes of white neon on the exterior of the sign around the perimeter. Inside
the can of the fixture are LED lights for internal illumination. The distance between this
proposed projecting sign and the last item on the agenda is approximately 100 feet.
There are two variances on this sign. The sign does extend four feet from the face of the
building, a 33% increase over the maximum allowed by ordinance. The sign is also internally lit.

The proposed change to the building is to remove the
wood storefront windows that were installed in 2004
and replace with an aluminum storefront system.
Historically, the storefront would have three parts; the
bottom would be the bulkhead, then the display window
and on top, the transom. In the sketch to the right, the
bulkheads are depicted in wood panels. Over the door,
there are typically transom windows.
The pictures below taken in 1991 and 2004 show that 1 1
the bottom of the windows are not historic. The
bulkheads were replaced with brick at some time and
were not painted to match the rest of the building. The
2004 photo shows aluminum storefront windows in the Graphic of typical 19th century
display window area. When the building was renovated commercial building
for the Presidential Library gift shop, all of the windows on the front of the building were
replaced with new ones. The first floor windows were rebuilt with four pane transoms on the top
to duplicate what was there. The display window was divided into two vertical panes. So,
nothing you see in the storefront today is historic.

Sec. 36-356. Building form.
(a) Materials.
(1) Historic materials or distinctive architectural features shall not be removed or
hidden.
(2) The type of materials and their color, texture, scale and detailing shall be
compatible with those of buildings on adjacent sites.
(3) Surface cleaning of historic structures shall be done with the gentlest possible
method. Physical or chemical treatments, such as sandblasting or high
pressure water cleaning, that cause damage to historic material shall be
prohibited.
(b) Roof types. Building roofs shall relate to the overall size, shape, slope, color and
texture of roofs of buildings within the district.
(c) Openings.
(1) Historical upper facade windows shall retain original dimensions and details.
(2) Historical storefront configuration shall not be altered.

(3) New construction shall have a pattern of windows and doors that resemble
similar patterns on facades of adjacent buildings.
(4) Primary entrances shall be parallel with the street.
(d) Style and form.
(1) Height Regulations. No building hereafter erected or structurally altered shall
exceed a height of sixty (60) feet. Building height shall be defined, for the
purpose of the River Market Design Overlay District, as the vertical distance
from the highest point of the centerline of abutting private and public street
frontages to the highest point of the roof or parapet wall. All structural
embellishments as defined by Sec. 36-2 Definitions shall be reviewed by the
River Market Design Review Committee for compliance.
(2) Buildings shall maintain the distinction between upper and street levels.
(3) Historical context of buildings shall be restored to original designs.
(e) Mass.
(1) New construction wider than the typical building width shall be visually massed
to appear similar to buildings on adjacent sites.
(2) The primary facade of a building shall be oriented parallel with the street.
(f) Projections.
(1) Objects shall not project from the building facade over the public right of way
except for awnings, signs, and balconies.
(2) Awnings shall not project more than five (5) feet from the building facade and
have a minimum clearance of nine (9) feet above the sidewalk.
(3) Balconies over the public right of way shall have a minimum clearance of nine
(9) feet above the sidewalk. One (1) inch of projection is permitted for each
additional inch of clearance above eight (8) feet, provided that no such
projection shall exceed a distance of four (4) feet. Balconies shall not be
supported with posts extending to the sidewalk. Mounting heights for balcony
brackets shall conform to minimum clearance standards.
(g) Setbacks.
(1) Buildings shall have a zero (0) foot build to line along the public street right-of-
ways.

The proposed changes to the storefronts are in compliance with the ordinance with the
exception of Sec. 36-356 (d) (3) Historical context of buildings shall be restored to original
designs. The proposal does include the four paned transoms over the display windows. To
accomplish that further, at the minimum, there needs to be a horizontal break in the display
windows to signify where the bulkhead would have been. The doors that are proposed are also
lacking the panel at the bottom that would have matched the height of the bulkhead. Currently,
they are proposed to have one large pane of full view glass.
In summary, the two variances sought are the sign projecting farther away from the building
than is permitted and the sign is internally illuminated.
Applicant will be responsible for obtaining a sign permit for each sign and a franchise for the
projecting sign.
STAFF RECOMMENDATION
Staff recommends approval as submitted.
COMMISSION ACTION: February 14. 2017
Tim Yelvington, Architect, representing the owners, made a brief presentation about the item.
He stated he was trying to match the storefront in the older photo. He asked for clarification on
the Staff recommendation. He did state that the owners would be coming back in the future to
paint the building and replace the windows in the top floor.
Mr. Yelvington stated that the storefront would be bronze in color. Committee member Adam
Bearden commented on the aluminum storefront windows in historic buildings. Committee
member Michael McCallum said that he was concerned with that color. Committee member
Bearden asked for a description of the storefront window system. Mr. Yelvington stated that it
was a 2" x 5" frame, middle seated windows and was not planning on a special profile.
Committee member McCallum said that his concern was that the storefront is the most
important part of the building, it is the pedestrian view. He continued that the thicker section
between the transoms and the display window is lost. Mr. Yelvington said that the ticker section
was discussed prior to the final submittal. Committee member McCallum asked if they
discussed the bulkhead.
Committee member Bearden agreed that a new storefront could stick out in an historic building.
Committee member McCallum said that an ogee shaped snap on is an option on the store front
system. He suggested that the display window could broken into smaller panes. He continued
that the Clinton Museum did a more historically sympathetic restoration of the building with
accurate materials. Committee member Bearden agreed.
There was a discussion on what the staff discussion was in coming up with the
recommendation.
Mr. Yelvington said that he was willing to go to a larger profile on the storefront stock.
It was decided that the sign would be discussed later and have a separate vote.
There was more discussion on the makeup of the storefront system. It was decided that there
would be, starting from the ground, a 6-8" base plate, a 2" horizontal member where the top of
the bulkhead would have been, a 6-8" plate between the display windows and the transoms,
and a 2" member at the top. From side to side, there will be a vertical 2" member at the edge,

two 2" members for a total of 4" in the center between the two display windows and another 2"
member at the other edge. The transoms will be separated with one 2" vertical member. Mr.
Yelvington drew a sketch and Mr. Minyard took a photo of it.
A motion was made by Committee member McCallum to approve as sketched and photo'd to
be installed in dark bronze and Committee Member Jim Rice seconded. The motion passed
with a vote of 3 ayes, 0 noes, 1 absent (East) and 1 open position.
Sign discussion:
Tim Yelvington made a brief statement on the signage. It is to be internally lighted and projects
too far into the right of way. There was talk of the ordinance requirements and of alternative
designs.
Committee member McCallum said it was a tasteful sign but prefers that it not be internally lit.
Committee member Bearden agreed that it should not be internally lit.
Mr. Yelvington said that they would resubmit a design for the sign. He will also submit a
drawing of the storefront as a follow up.
There was a motion to defer only the signage portion of the application made by Committee
member McCallum and seconded by Committee member Bearden. The motion passed with a
vote of 3 ayes, 0 noes, 1 absent (East) and 1 open position.
UPDATE:
March 14, 2017
The applicant submitted a new design on March 3, 2017. The sign is the same size as before
with the following changes. The new design is shown below.
The new version has a black background with white vinyl letters applied to both sides. There
will be white neon tubing spelling out the individual letters on both sides as well as two white
neon tubes around the exterior of the sign. A sketch follows at the end of the staff report.
There will still be one variance for this sign. The sign does extend four feet from the face of the
building, a 33% increase over the maximum allowed by ordinance.

On behalf of my client, Merritt Dake, AXPM, we are requesting approval of the new coffee shop
sign and removal/replacement of the first level. (street level) storefront as shown. We are wanting
to replace the storefront because it is existingwood framing that has some rotting and has
non -insulated glazing.. Since we are creating a new coffee shop within that space,, it is important to
upgrade the glazing and add additional signage. We are going back with dark bronze -thermally
broken•prefinished.aluminum framing versus Wood because of the efficiency and low maintenance
of the aluminum framing, We will use clear 1" insulated high efficiency glazing. We will be using
clear glazing that will allow viewing of the coffee shop for pedestrian traffic along President
Clinton -Avenue. This will greatly enhance the overall look and increase the viewable area from
within the coffee shop to the outside. It will. be consistent with most of the other building storefronts
that have been upgraded all along President Clinton -Avenue. We believe the new storefront is in
keeping:with the overall appeal of the River Market District.
