As per our discussion this morning I am following up with photos and description of what it looks like moving forward.
Thanks for letting me know you are preparing for some time off.
1. We are removing the minisplits from the building. We might use 1 on the rear of building by parking lot if necessary.
Other than that we are removing all other units. We will repair siding to cover any holes.
2. We will be installing 2 central systems with all equipment to be internal to building. The outside condensing units will
be on small roof above parking lot on rear of house not seen from road. As per requirements. See photo attached.
3. There is small section of fence that has been knocked down due to a fallen branch. See attached photo. As you can
see the remainder of the fence is leaning against the other fence.
We want to put it back in it’s original location, closing off entry to the front of the property.

4. The next modification is to put a fence in front of the chain fence to conceal all the belonging from the other adjoining
property.

5. The last item is the parking lot in the above photos. There is currently gravel, concrete, partial asphalt, dirt and other
rocks. Wanting to have one consistence product all asphault which would tie into ally making all surfaces the same.
This is everything I’m wanting to accomplish. When I return to office later today or in the morning I will complete form
you sent over to finalize application.

From our last phone call, I’m aware that you are preparing your COA application to resolve this
enforcement issue and for other projects. I will be out of town all of next week for the holidays and will
be back in office on January 2nd. This is a reminder that the violation concerning the mini split units
requires correction by either removing the unpermitted alterations and restoring the original materials
to the structure and site or by obtaining a COA from the Little Rock Historic District Commission by filing
an application and fulfilling all requirements thereof. The next filing deadline is January 2nd, 2024 to be
scheduled for the February 1st, 2024 public hearing. You are welcome to submit a COA application
before the deadline either in person or via email while I am out of office. The deadline to take action on

this violation is January 2nd regardless of whether the scope of work submitted for the mini splits can be
reviewed by staff or would require a public hearing.

Good morning Sam,
Concerning the AC units attached to the sides of the exterior, ideally they would be relocated on the
ground at the rear of the property or along the back half of the side of the property and screened from
view by fencing or landscaping. If the ground location along the sides of the property may present future
issues, a ground location at the rear within fencing may be a solution. I haven’t seen any steal cages
being used on the property before. If the units were installed to the roof, they would need to be nearly
invisible from the street and avoid damages to the historic sections of the structure. If the roof is where
you would like to relocate them, you’ll just need to show how the proposed design meets the objectives
of the Design Guidelines through a site plan. If the AC units were installed at the rear and not visible
from they street, they can be reviewed administratively. Supply lines should also not be visible from the
street where possible.

Mechanical systems and service areas should be as

unobtrusive to the historic neighborhood as possible.
1. Heating, Air Conditioning units, and Ceiling
Fans:
HVAC units should be located where not readily visible
from the street and should be screened with shrubbery or
fencing. Window air-conditioners should be located in
windows on the rear or side façades and should not result in
the removal or replacement of the original window sash or
surround. Ceiling fans on porches should be mounted high
enough so that they cannot be seen from the street.
May the condensing units be placed on the roof? we have a couple flat roofs on existing structure and the units would be
hidden from street view.
Everything close to the ground has been stolen even with bolted down in steel cages.
Would be willing to build wood fence structure on roofs to hide from view.
Item 1: Which level for approval? staff or commission

My preference is I will be moving to get all things at one time accomplished, this is why I am recapping to make sure I
completely understand what level approval needed.
As I started the project I have been asking multiple people around the area the best and most effective way to do the
property. due to high interest rates and high material cost, I will be doing basic repairs as needed and keeping the structure
in current design.

I've attached an updated copy of the Certificate of Appropriateness application for your
convenience. As previously stated in our past emails and correspondence, any exterior
renovation of structures, additions, fencing, or other site features need to be either
administratively approved by staff or reviewed by the Little Rock Historic District
Commission at their regularly monthly public meetings. Our records show that
construction activity at 414 E 9th Street was carried out in violation of Sec. 23-115 of the
Little Rock City Code and state law requiring that a Certificate of Appropriateness
(“COA”) be obtained prior to making alterations to a structure located in a local
ordinance historic district. Our records indicate that mini splits were installed, paving
was repaired, and several windows in the gables were permanently boarded in violation
of this COA requirement and without necessary building permits. To bring your property
into compliance with state law, you must either remove the unpermitted alterations
and restore the original materials to the structure and site or obtain a COA from the
Little Rock Historic District Commission by filing an application and fulfilling all
requirements thereof. Please read the application instructions thoroughly regarding
submission documents and required public notice before applying.
All of these project items you've listed below require a COA but some can be reviewed
administratively by staff and typically take a day or two to review while others will need
to be docketed for a public hearing before the Historic District Commission. You can

include each of these in one application if you'd like for convenience. The construction
activity that has taken place without a COA will need to be resolved as soon as possible
while your future projects--such as the window replacements or repairs--can be pursued
at a later date if you wish.
I have made additional comments below related to each of the items you listed. I've
referenced specific sections of the guidelines for convenience and called out specific
submission materials; however, applications will be reviewed according to all relevant
standards throughout the Design Guidelines and full list of requiremed submission
materials can be found in the application packet.
1. Minisplits and boarding of windows were installed in violation. You must either
remove the unpermitted alterations and restore the original materials to the structure
and site or obtain a COA from the Little Rock Historic District Commission by filing an
application and fulfilling all requirements thereof. Standards concerning mechanical
units can be found in Section VII. D.1. of the Guidelines. The next filing deadline is
January 2nd, 2024 to be scheduled for the February 1st, 2024 public hearing.
2. Fencing repair can be reviewed administratively. Please provide colored photographs
of existing fence and indicate where the fence will be replaced on a site plan or recent
survey. I'm aware of a 6-foot fence on the property, but not an 8-foot fence. Standards
concerning fencing can be found in Section VII.A.3. of the Guidelines.
3. The installation or resurfacing of parking areas will require Commission level review.
Please provide colored photographs of existing parking area, a recent survey of the
property, and a site plan of the proposed parking and any other site improvements.
Standards concerning residential parking areas can be found in Section VII.C.1.
4. Paint color is not regulated in this local ordinance district. Saying this, I think the paint
colors you've chosen look great! Window replacement will require Commission level
review. Window repair can be reviewed administratively be staff. Standards regarding
windows can be found in Section III.B.2. Please provide colored photographs of all
windows and their conditions requiring repair (or proposed for replacement). Outline
repair methodology. If replacement, provide a link to the replacement window
product(s) proposed as well as photos detailing the condition of the windows proposed
for replacement.
5. Repair to the stone retaining wall can be administratively reviewed. Please provide
colored photographs of existing conditions and outline repair methology including
mortar composition.
6. The repair of sidewalks and pathways can be administratively reviewed. Please
provide colored photographs of the work you have done and, if you have it, photos of
the sidewalk before work was done.
7. I'm sorry to hear about the break ins. If you have plans to install additional lighting, a
security system, rear fencing, or other security measures, I would recommend including
those in your application so your projects can be reviewed all at once rather than filing
multiple times. However, this is up to you and your timeline preferences.

Hanna,
I am going through all the emails reviewing. I wanted to get with you and try to figure
out what would need an application and what would not have to have an application.
Areas of concerns:
1. Minisplits vs window units, possible locations for minisplits
2. A branch fell from the 420 E 9th house and broke the front of the fence (facing 9th)
on 414 E 9th property. Just the 8’ front section. What needs to be done to replace or
repair that section of fence.
3. I would like to consider asphault over the gravel in the rear of the house.
4. I have currently repainted the house a color similar to others in the district. I am
considering but not sure on replacing the windows. Process if I decide to replace. If to
much trouble I will repair the one in place.
5. That is all of the repairs I plan on the exterior, other than cleaning yard and sodding
the grass in the spring and flowerbeds. I do have a few rocks that were kicked out by the
perimeter walls I plan on having repaired.
6. There were a couple pieces of existing concrete sidewalks destroyed by trash trucks, I
replaced them to eliminate hazard situations.
7. We have suffered a total of 16 break ins since the beginning of this venture, but
luckily that is starting to slow down.
8. I do have the application downloaded and ready to complete once I have a full
understanding of items needing application.
