AN ORDINANCE APPROVING A PLANNED ZONING
DEVELOPMENT AND ESTABLISHING A PLANNED
COMMERCIAL DISTRICT TITLED TREADWAY'S SHORT -FORM
PCD (Z-7723) LOCATED AT 1115 JEFFERSON STREET, IN THE
CITY OF LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL
ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK,ARKANSAS.
SECTION 1. That the zoning classification of the following described property be changed
from C-3 to PCD:
Lots 1 and 2 Block 30, Cunningham's Addition to the City of Little Rock,
Pulaski County, AR.
SECTION 2. That the preliminary site development plan/plat be approved as recommended
by the Little Rock Planning Commission.
SECTION 3. That the change in zoning classification contemplated for Treadway's Short -
form PCD is conditioned upon obtaining a final plan approval within the time specified by Chapter
36, Article VII, Section 36-454 (e) of the Code of Ordinances.
SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City
of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in
the respects necessary to affect and designate the change provided for in Section 1 hereof.
SECTION 5. That this Ordinance shall not take effect and be in full force until the final
approval of the plan.
SECTION 6. Severability. In the event any title, section, paragraph, item, sentence, clause,
phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
declaration or adjudication shall not affect the remaining portions of the ordinance which shall
remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional
was not originally a part of the ordinance.
SECTION 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
inconsistency.

SYNOPSIS
The applicant proposes the rezoning of this site from C-3
to PCD to allow a replat of two existing lots and establish
the proposed building setbacks.
FISCAL IMPACT
None.
RECOMMENDATION
Staff recommends approval of the requested PCD zoning.
The Planning Commission voted to recommend approval
of the requested zoning, as recommended by Staff, by a
vote of 9 ayes, 0 noes and 2 absent.
CITIZEN
The Planning Commission reviewed the proposed PCD
PARTICIPATION
request at its August 26, 2004 meeting. There were no
registered objectors present. All abutting property owners,
the Oak Forest Neighborhood Association, the Forest Hills
Neighborhood Association, the War Memorial
Neighborhood Association, the Hope Neighborhood
Association and the Movers and Shakers Crime Watch
Association were notified of the Public Hearing.
BACKGROUND
The applicant filed a request for a replat which was heard
by the Little Rock Planning Commission at their July 15,
2004 Public Hearing. At the hearing it was determined the
applicant would be better suited to amend the application
to a planned development to allow for the establishment of
building setbacks and to allow for a cross access parking
arrangement between the two lots.
The proposal includes a replat of Lots 1 and 3 Block 30 of
Cunningham' addition to the City of Little Rock. The lots
currently contain individual buildings, which were
constructed over lot lines several years ago. The indicated
lots are currently zoned C-3, General Commercial District
which typically requires a 100 -foot lot width, 14,000
square feet of lot area, building setbacks of 25 -feet from
the front and rear yards and a side yard setback of 15 -feet.
The proposed replat includes lot widths of 85 -feet and 55 -
feet, a lot area of 8,500 square feet and 5,500 square feet
and reduced front, side and rear yard setbacks. The church
located at 1115 Jefferson Street wishes to expand its
current building, which is necessitating the replat. No
changes are proposed for the second existing building
which has of several years been occupied by a carpet
company
The applicant is requesting the rejuired improvements to
Jefferson Street and West 12 Street be tied to
redevelopment of each individual lot. In addition the
applicant is requesting -a deferral of street improvements.
This request is a separate item on this agenda.
As previously mentioned the applicant revised their request
at the July 15, 2004 Planning Commission Public Hearing
to a Planned Commercial Development (PCD) request.
With the amendment to a PCD, this limits the number of
variances being requested as a part of the site plan and the
site plan also includes the placement of a cross access
parking agreement between the two proposed lots. Staff is
supportive of this arrangement. Once the church expands
the existing structure, the available parking on the site
would be limited. Staff feels with the cross access parking
arrangement this should limit staff s original concerns of
the lack of on-site parking.
