Hamilton, IV Address: 5025 Stonewall Road Description: Lot 7, Block 27, Newton's Addition Zoned: R-2 Variance Requested: Variances are requested from the area provisions of Section 36-254 to allow a building addition with reduced setbacks. Justification: The applicant's justification is presented in an attached letter. Present Use of Property: Proposed Use of Property: STAFF REPORT A. Public Works Issues: Single Family Residential Single Family Residential 1. Remove the private fence from the public right-of-way or obtain a franchise agreement from Public Works (John Barr, 371-4646) for those improvements located in the right-of-way. B. Staff Analysis The R-2 zoned property at 5025 Stonewall Road is occupied by a one- story brick and frame single family residence. A two -car wide drive from Van Buren Street is located near the southwest corner of the property. Some site work has taken place in the rear yard for a proposed building addition. The applicant proposes to construct a two-story addition on the rear (south side) of the existing residence, as noted on the attached sketch. The addition will increase the size of the existing kitchen and master bedroom. It will also include a den, laundry room, half -bath and garage downstairs, and two bedrooms, game room, home office and 1 Y2 baths upstairs. The addition will be located 3.5 feet from the west side SEPTEMBER 27, 2004 ITEM NO.: 5 CON'T. property line, 11.6 feet from the east side property line and 16.5 feet from the rear (south) property line. Section 36-254(d)(2) of the City's Zoning Ordinance requires minimum side yard setbacks of five (5) feet for this R-2 zoned lot. Section 36- 254(d)(3) requires a minimum rear yard setback of 25 feet. Therefore the applicant is requesting a variance to allow the reduced side (west side) and rear yard setbacks. Staff is supportive of the requested variances. Staff feels that the variances are reasonable, and will not be out of character with other new single family homes and additions which have been constructed in the Heights neighborhood over the past several years. The reduced side yard (west) should have no negative impact on the area, as Van Buren Street has an excessively wide right-of-way at this location. The west property line is located 25 feet back from the street curb, so there will be adequate back out space for the proposed garage. Staff feels that the proposed building addition will have no negative impact on the surrounding properties or the general area. C. Staff Recommendations: Staff recommends approval of the requested setback variances, subject to compliance with the Public Works requirement as noted in paragraph A. of this report. BOARD OF ADJUSTMENT: (SEPTEMBER 27, 2004) The applicant was present. There were no objectors present. Staff presented the item and a recommendation of approval. The applicant offered not additional comments. The item was placed on the Consent Agenda and approved as recommended by staff by a vote of 5 ayes and 0 nays. 2
