7 WHEREAS, Ordinance No. 19,136 was passed on July 20, 2004. establishing a planned zorifrig:
8 district titled Malone Short -Form PD -R (Z -7632-A), located at 1100 Rock Street; and
9 WHEREAS, the owner of the property has indicated the proposed residential development as
10 approved for Malone Short -Form PD -R (Z -7632-A) will not occur and the owner is requesting a repeal
11 of the "PZD" ordinance and restoration of the zoning classification as previously existed; and
12 WHEREAS, the Little Rock Planning Commission reviewed the request for revocation for Malone
13 Short -Form PD -R (Z -7632-A), located at 1100 Rock Street at their December 18, 2014, public hearing
14 and voted 10 ayes, 0 nays and 1 absent to forward the revocation request to the Little Rock Board of
15 Directors for final action.
16 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
17 CITY OF LITTLE ROCK, ARKANSAS.
18 SECTION 1. That Ordinance No. 19,136 is hereby repealed, removing from the official zoning
19 map the classification PD -R, Planned Development - Residential.
20 SECTION 2. That the underlying R -4A, Low Density Residential District, zoning classification
21 is restored to the property described as: Lot 12 Block 46, Original City of Little Rock, Pulaski County,
22 Arkansas.
23 SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of
24 Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the
25 respects necessary to affect and designate the change provided for in Sections I and 2 hereof.
26 SECTION 4. Severability. In the event any title, section, paragraph, item, sentence, clause,
27 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
28 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain
29 in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not
30 originally a part of the ordinance.
31 SECTION 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
32 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
33 inconsistency.

The request is a revocation of the existing PD -R zoning and
the restoration of the previously held R -4A Zoning District.

Staff recommends approval of the requested PD -R zoning
revocation. The Planning Commission voted to
recommend approval of the PD -R zoning revocation by a
vote of 10 ayes, 0 noes and 1 absent.
The Planning Commission reviewed the proposed PD -R
zoning revocation request at its December 18, 2014,
meeting and there were no registered objectors present.
The Downtown Neighborhood Association was notified of
the Public Hearing.
Ordinance No. 19,136 adopted by the Little Rock Board of
Directors on July 20, 2004, rezoned the property from
R -4A, Low Density Residential District to PD -R to allow
the creation of a two -lot plat for the site. A four-story,
four -unit brick apartment building and an uninhabitable
frame house were located on the site. The intent was to

split the lot into two (2) separate lots to allow the frame
house and apartment building to exist on separate parcels.
The further intent was to renovate the single-family
dwelling to allow the unit to become a functional residence
once again. The applicant indicated this would not be
suitable if the two (2) structures continued to share a lot.
The lot was not split and the renovations to the single-
family home were not completed. Per Section 36-454(d)
the owner of an approved PD or PUD may, for cause,
request repeal of the ordinance establishing the
development when it has been determined that the
development will not occur.

Dear Ms. James,
The purpose of this letter is to ask the City to revoke a previous application related to the above
referenced property which changed the zoning from R -4A to PD -R.
In 2004 1 obtained approval to divide the lot in two separate lots and the zoning was changed to PD -R.
The approval was subject to, among other things, installing a new sewer main. I did not install the sewer
main and I'm now asking the City to revoke the application and change the zoning back to R -4A.
