MOORE, CITY MANAGER SUBJECT: CHATEAUS ON STAGECOACH SHORT -FORM PCD (Z -7607-A) DATE: SEPTEMBER 4, 2014 The request was made at the August 26, 2014 Board of Directors Agenda meeting for staff to provide information regarding the fencing and screening requirements for the proposed Chateaus on Stagecoach Short -Form PCD. The site plan for the development indicates the placement of a screening fence along the western perimeter of proposed Lot B, the Family Dollar site. The fence is proposed as a 6 -foot wood privacy fence placed adjacent to the existing wood privacy fence located within the rear yards of the homes fronting on Chateaus Lane. There are four (4) homes located along the proposed Family Dollar's western perimeter. Of the four (4) homes, three (3) have installed a wooden privacy fence. The fourth (the southernmost house) does not have a fence in place. Buffering and screening requirements are the responsibility of the more intense use. In this case, the commercial development is required to provide the screening and buffering regardless of the existing fencing. At the June 26, 2104 Planning Commission public hearing staff presented a recommendation that in addition to the screening fence, the applicant provide the placement of trees and shrubs along the western perimeter of the site at one and one-half (1 '/2) times the typical ordinance requirement and a minimum of fifty (50) percent of the tree and shrub planted were to be evergreen type plants. At the public hearing the applicant stated they were in agreement with staff's recommendation concerning the plantings. I None. Staff recommends approval of the requested PCD zoning. The Planning Commission voted to recommend approval of the PCD zoning by a vote of 8 ayes, 1 noes and 2 absent. The Planning Commission reviewed the proposed PCD request at its June 26, 2014, meeting. There were registered objectors present. All property owners located within 200 -feet of the site along with Southwest Little Rock United for Progress, the Bentley Court Property Owners Association, the Otter Creek Homeowners Association and the Wedgewood Creek Property Owners Association were notified of the Public Hearing. BACKGROUND Ordinance No. 19,106 adopted by the Little Rock Board of Directors on May 18, 2004, rezoned the site from R-2, Single-family to PCD to create two (2) lots and allow for a mixed use development containing a bank and a fast food restaurant. The lots were approved containing 1.2 -acres each. Lot A was proposed with a banking facility with 2,500 square feet of floor area and 22 -parking spaces. The maximum building height approved was 25 -feet and the hours of operation were from 8:00 am to 7:00 pm six (6) days per week. Lot B was approved with a restaurant with drive-through service containing 4,150 square feet of floor area and 38 parking spaces. The restaurant hours were approved from 6:00 am to 12:00 am seven (7) days per week. The development has not occurred and the PCD zoning has expired. The applicant is now proposing to reestablish the PCD zoning and revised the site plan for Lot B. The site plan includes retaining the bank on Lot A continuing to contain 2,500 square feet of floor area and 22 -parking spaces. The hours of operation for the bank are proposed from 7 am to 7 pm Monday through Saturday. Lot B is changing from a fast food restaurant to a retail/commercial use. The retail facility is proposed containing 8,320 square feet and 29 -parking spaces. The hours of the retail business are from 7 am to 10 pm seven (7) days per week. The height of both buildings will be less than 25 -feet. Please see the attached Planning record and site plan for the development proposal and the recommendation. When Pat McGetrick and I met with the subdivision committee earlier this month, we were unaware that the staff would recommend a restriction on alcohol be placed on the property. According to the proposed buyer, Family Dollar, they have said this may be a "deal breaker" and thus the sale be lost. I have not be able to get in touch with them because my main contact is on vacation. Accordingly, we want to have time to consult further with Family Dollar and have them engage separate counsel. This store will be constructed using materials such as brick and mortar, stucco, canopies, and moldings to highlight the details of the store's enhanced impression and visual attractive appearance. TRAFFIC The Department of Transportation reviewed the plans to conclude this site is permissible and has no adverse effects on the 4 -lane highway that manages 18,000 +/- cars of traffic per day. DRAINAGE Our drainage plans have been calculated and designed so that the post -development run-off equals the pre -development run-off creating an absolute zero increase or impact to any existing or future drainage issues. CRIME Most opposition will allege that a newly constructed Dollar Store will increase crime in the area. However, Family Dollar implements special precautions to prevent crime. The store will be equipped with a sophisticated security system, including video monitoring, a routinely, maintained illuminated interior and exterior site, and well-trained associates. Fortunately, the most serious crimes committed within the store are misdemeanor shoplifting or in-house theft. It's rare that the store is victimized by the more serious crime (robbery). According to the FBI most robberies occur on the street, directly against a person, followed by home invasions, miscellaneous robberies (drug relations), then by commercial housing (universities, etc.). PROPERTY VALUES Most opposition will allege that the newly construct store will decrease property values. Property values are determined by many factors, first and foremost.... location, location, location, then comparable sales, and then appearance of the actual structure. Family Dollar is a friendly neighbor and has amicably addressed all the neighboring concerns.... building design, landscaping, traffic, drainage, and crime. By addressing all these concerns there is no distinct evidence that the newly developed store will decrease the neighboring property values. The building elevations for the future Family Dollar located at 10055 Stagecoach Road have been revised to show upgrades to all four sides of the building as requested. We have provided a variation of materials and height changes along all four elevations to help break up the mass of the building in addition to providing added visual interest. Below is a brief description of all the finish material upgrades as shown on the attached construction documents. The intent is to provide your team with a better understanding of the final look of the Family Dollar building for approval/comment. The main entrance to the Family Dollar is identified with a scored, EIFS clad tower with an arched metal cap. The scored EIFS is carried the full height of the entry Tower. All of these components are in the Camelback" color, see clip below. Directly above the storefront doors there is a red fabric awning to further demarcate the entrance to the store. This red color is consistent with the Family Dollar brand red color. qP The main base of the building along all four sides includes a 7'-4" high brick veneer. The Acme Brick color indicated is Copper Sand, see clip below of this brick color. Figure 1 Acme Brick - Copper Sand ID There is an 8" gray concrete sill that sits at the top of the brick base. This horizontal feature/edge is carried throughout all the building elevations. An EIFS finish is shown directly above the horizontal sill to further break up the visual mass of the building. The EIFS is painted two separate colors, "Camelback" and "Wool Skein", see clips below of these color choices for your reference. The following are my noted concerns to be shared with the Planning Commission Board. My family and I have been a resident of Chateaus on Stagecoach since March 2007 and we love our community. The recent growth in our area with the opening of Bass Pro Shop and the development of the Outlet Stores to open in 2015 are great for Little Rock and Otter Creek. However, the potential of a Family Dollar directly in our neighborhood is a major concern. The following is a list of the concerns: 1. Safety - the school bus stop is located at the stop sign of Chateaus Lane and Stagecoach and based on the plans this will be near the entrance of patrons for Family Dollar. Also, the city bus stop is located at the opposite side of Chateaus Lane and Stagecoach and the increase in traffic to the Family Dollar from those patrons and children at the bus stop is a huge safety concern. 2. Crime - when/if the store is robbed and an individual not familiar with our neighborhood is unaware we are not a through street puts our children, family and our homes at risk if the individual flees in our direction. 3. Traffic - the 2010 traffic count for Stagecoach was 18,000 per day. Currently, trying to exit our neighborhood between approximately 3:30PM and 6:OOPM is nearly impossible. The additional traffic from patrons to the Family Dollar is going to increase the frustration of entering and exiting our neighborhood. An email was sent to Bill Henry on 06/13/14 to request a "Warranted Signal Light" review for our street - no response as of today. 4. Aesthetics - Family Dollar does not have a shopping cart return carousel and the carts may be left outside. Also, some patrons without vehicles may use the shopping carts to transport their goods and the carts may be left on our street or in other neighborhoods. 5. Property Value - I spoke to a real estate agent for Coldwell Banker and he stated it may take a year to two years before we know the effect of our property value. However, if there are a lot of homes that come on the market in our neighborhood due to the planned development of the Family Dollar this will have a major change in the values of our homes, but those with the biggest impact may be the four homes that border the lot. My family and I are asking the Planning Commission Board to say "NO" to the development of a Family Dollar in our neighborhood. Edwards Food Giant, Walgreens, Dollar General, and multiple mini -marts are located within a mile of each other on Stagecoach Road. Each offers comparable products at competitive prices. Adding a discount general merchandise store would oversaturate this area. 4. Crime would increase with the addition of a bank and a retail store that is located in front of the neighborhood. Even if a double privacy fence and other attempts at security were provided, additional incidents of crime would still impact the quality, safety, and sense of community in this neighborhood. 5. Reports indicate that Family Dollar Store, Inc. has reversed its ambition expansion goals and has closed many of its existing stores around the country. Once this happens at the proposed location, the neighborhood would be flanked by an abandoned building and eye sore. An unoccupied discount storefront would further contribute to lower property values of our homes in the neighborhood. If the application is approved, we also request that the applicant provide a motion -sensor (or other appropriate) gated entrance to our neighborhood at its own expense, subject to our approval of the design, function, and placement of the gate. A gated entrance would discourage and hopefully deter inadvertent traffic from entering into our neighborhood. These are only a few of our concerns and reasons for opposing the construction and operation of a bank and a retail store in front of our neighborhood. The retailer also said it plans to cut prices on many items in its stores in hopes of attracting more shoppers. "Our second quarter results did not meet our expectations," said Howard R. Levine, chairman and CEO, who cited higher than expected promotional costs and more financially constrained consumers during the 2013 holiday season along with severe winter weather for its disappointing results. "While this business review is ongoing, we are taking immediate, strategic actions to improve our performance," Levine said. "First, we have made a significant investment to lower prices on about 1,000 basic items. Second, we are reducing our cost structure through the optimization of our workforce. Third, we will close approximately 370 underperforming stores." The company did not release a list of stores it plans to close, but said they were generally older and had sales that were about half of the average annual sales amount per store of $650,000. The company expected most of the store closures to occur in the second half of its 2014 fiscal year. Once complete, its workforce reduction efforts and store closures are expected to result in $40 million to $45 million of annualized operating improvements beginning in the third quarter of fiscal 2014. As part of the review, the company also said it will be slowing new store growth beginning in fiscal 2015. It now plans to open 350 to 400 new stores in fiscal 2015, down from 525 originally. "New stores have always delivered the highest return on investment for Family Dollar, but as our operating margin has contracted and our capital investment has increased, our return on investment trends have been pressured," Levine said in the company's earnings conference call. "To improve these trends, we have re-evaluated our site selection criteria and refined our real estate models to reflect the current sales environment and sales insights from store openings over the last three years." "We have substantial data on returns by location, competitive dynamics and cost structure and we will use this data to eliminate higher risk situations," he added. The dispute arose in 2014 when MGC, which is owned by Tim and Carla Spainhour, sought to rezone an expired PCD to allow for the construction of a Family Dollar Store adjacent to the Chateaus subdivision. The file provided by Mr. Cumming included the Planning Commission documents which reflected a favorable vote in favor of the applicant. Finally, I also watched the Board of Directors meeting of September 16, 2014, when the rezoning request was approved. The discussion that occurred before the Board when the PCD was approved included a presentation by both of the Spainhours. In discussing the gate issue, Mr. Spainhour stated that early on in the process he had extended an offer to the residents of the neighborhood to have the gate installed in exchange for the residents agreeing not to oppose the rezoning application. That offer was not accepted according to Mr. Spainhour. Later, in response to questions from Director Wyrick, Carla Spainhour stated that she would agree to place $20,000 in escrow to go toward the installation of the gate, but wanted a time restriction in place on how long the funds would remain in escrow. She also stated that if that was what was needed in order to secure a favorable vote from the Board she would do it. Tom immediately intervened to point out that the Board was simply asked to make a land use decision and could not contract with an applicant in exchange for a favorable vote. The Board ultimately passed Ordinance No. 20,935 which approved the PCD request. Since the approval of the PCD, the Chateaus POA and Ms. Spainhour have engaged in numerous discussions about the gate installation. Ms. Pat Oliver, President of the Chateaus POA, retained Mr. Cumming to contact Ms. Spainhour and determine if an agreement could be reached. He was unable to do so. He was then asked to determine if litigation against MGC would be viable. He advised that he could not recommend pursuing litigation. Director Wyrick asked our office to review the situation to determine if the City could be of any assistance to the POA. The City really has no standing to become involved in the dispute between the Spainhours and the POA. The gate could not be, and was not, a condition of approving the rezoning request. Therefore, the City has no claim and cannot represent a private party in seeking to enforce an oral promise. If you all want me to advise Ms. Oliver of my conclusion, I will be happy to do so. This is when I contacted you and informed you what Carla said, You then contacted Bruce Moore. I received a call from you asking about meeting with the City and zoning at the island. Brian Winstead, Bill Fencing ( Carla sent out ) some of the Residents and I met at the Island. The city agreed to remove the island. You asked Brian Winstead to contact Carla to confirm the amount of money she was given for the gate as well as a time frame. We received the email from Brian Winstead confirming the amount and time frame ($20.000 and one year after closing). I was then told by Carla Spainhour to get some bids for a gate. Now... the Problems the Residents of Chateaus subdivision have is (1) We had to legally established a POA to show proof that we could maintain the upkeep and be able to pay the monthly electric bill of the gate (Carla Spainhour request). (2) This required the residents of Chateaus to hire an Attorney. The Residents voted and Retain Attorney Chad Cumming. (3) A CHATEAUS POA BOARD was established and voted for the POA Dues to be $240.00 annually or $20.00 monthly starting January 2015, and $5.00 late fee after the 5th of each month starting with February. Attorney Chad Cumming register the Bylaws, November 17th 2014. (4) I have met with several Fencing Companies getting bids for a gate. A Fencing Company was agreed upon by the Residents and Attorney Chad Cumming. (5) A Franchise Permit application had to be submitted to the City of Little Rock. This was done. After several meetings with Fencing Companies and Vince Floriani,and other City Officials Chateaus POA was granted a Franchise Permit by the City of Little Rock to have a gate install. (6) The Residents of Chateaus Has spent to much money on Attorney Fees, Other Expensive, as well as too much of the City and Chateaus Resident Time. (7) THE BOTTOM LINE ... The Residents or the City of Little Rock didn't have a need to do any of this if Carla Spainhour (1) Didn't agree to install a gate. (2) Then agreed to give $20.000 for a gate. The Residents of Chateaus Subdivision CAN NOT understand why Carla Spainhour can't be held to keep her agreement.
