RESOLUTION: A resolution expresses Board policy or directs certain types of administrative action. It requires only one reading and may be changed by subsequent resolution. MOTION: A proposal for action, or used to indicate majority approval of procedural action, such as the filing of a report. REFERRAL: The Board may postpone action or ask for a further study by referring the matter to the City Manager, the City Attorney, or to an advisory committee for further study. EMERGENCY CLAUSE: When attached to an ordinance, the legislation is effective immediately upon passage. CITIZEN COMMUNICATION: A limit of three (3) minutes per subject is allotted for any person to express a written or oral viewpoint, grievance or other message to the Board of Directors, with a maximum of thirty (30) minutes allotted for citizen communications. No advance permission is required, but persons wishing to address the Board are requested to fill out a yellow card listing the subject to be addressed and hand it to the City Clerk or Assistant City Clerk upon arrival. Citizen communications will be immediately following the Consent Agenda items on the first Tuesday and at the end of the Agenda on the third Tuesday. MOTION G-24-021 — To set the date of public hearing for December 16, 2008, on a petition to abandon two (2) sanitary sewer easements located within Shackleford Crossing, in the 2800 Block of Shackleford Road. Staff recommends approval. Synopsis: Shackleford Crossing, LLC, owner of the PCD zoned Shackleford Crossing development, is requesting the abandonment of two (2) sanitary sewer easements. 2. MOTION G-24-022 - To set the date of public hearing for December 16, 2008, on a petition to abandon certain drainage and utility easements located within Lot 1, Interstate easements located within Lot 1, Interstate 430 Office Park Addition located at 2714 South Shackleford Road. Staff recommends approval. Synopsis: Shackleford Crossing, LLC, owner of the PCD zoned Shackleford Crossing development, is requesting the abandonment of certain drainage and utility easements. 3. RESOLUTION To authorize the City Manager to enter into a contract with Fraley Roofing Inc., to supply materials and labor to reroof the Willie Hinton Neighborhood Resource Center (WHNRC). Staff recommends approval. 4. RESOLUTION To authorize the City Manager to enter into an annual contract with Mid -South Sales Incorporated, to provide oils and lubricants for use in all City equipment; and for other purposes. Staff recommends approval. Synopsis: To authorize the City Manager to enter into a contract with Mid -South Sales, Incorporated, to provide oils and lubricants for use in all City equipment. This is an annual purchase order for one (1) -year with an option to renew each year for up to four (4) additional years. 1 5. RESOLUTION To authorize the City Manager to enter into a contract with ThyssenKrupp Elevator, to supply materials and labor to renovate the City Hall elevator. Staffrecommends approval. Synopsis: ThyssenKrupp Elevator submitted a bid of $160,098 and was the only bid received to renovate the elevator at City Hall. The funding will come from 2008 Short Term Financing. 6. RESOLUTION To renew taxicab operator permits for Greater Little Rock Transportation Service, LLC (GLRTS); and for other purposes. Staff recommends approval. Synopsis: A resolution authorizing the approval of 123 operator permits for Greater Little Rock Transportation for 2009. 7. RESOLUTION To authorize the City Manager, Mayor, and City Clerk to execute any documents necessary and take other actions needed to accept the donation of a 3,075 square foot lot located at the northeast comer of Appianway and West 19t" Streets; and an adjacent 2,000 square foot interior lot facing Appianway Street; and for other purposes. staff recommends approval. Synopsis: A resolution to authorize the acceptance of a land donation from The Triangle Group, LLC for the purpose of expanding Fletcher Park. 8. RESOLUTION To authorize the City Manager to enter into a contract with Arkoma Playgrounds and Supply in the amount of $76,152.37 for supply and installation of a new playground component system for Dunbar Community Center. Staff recommends approval. MOTION To approve minutes of the October 21, 2008, and the November 3, 2008, Little Rock Board of Directors Meetings. 2. MOTION Z-8385 -To set the date of public hearing for January 6, 2008, on an appeal of the Planning Commission's recommendation of denial of a rezoning of this site, located at 2105 South Taylor Street from R-3, Single -Family, to PD -R to allow three residential units on the site. Planning Commission: 0 ayes, 9 nays, 0 absent, 1 recusal, and 1 open position. Staff recommends denial. Synopsis: The request is an appeal of the Planning Commissions recommendation of denial of a rezoning of this site from R-3 to Single -Family to PD -R to allow three residential units on the site. 3. RESOLUTION To authorize the City Manager to enter into a contract with Tri-State Truck Center for the purchase of seven (7) 30 - cubic yard side -load refuse trucks for a total amount of $675,429. Staff recommends approval. Synopsis: Three competitive bids were obtained. The bid award was made to the lowest responsible bidder meeting minimum specifications. 6. RESOLUTION Authorizing an increase to the construction contract for Joyner -Ford -Burke Construction Company, Inc., for University Avenue (190h Street to Park Plaza Drive); Arkansas Highway and Transportation Department Job Number 060917. Staff recommends approval. Synopsis: Authorizes the City Manager to approve an amendment to the engineering contract agreement for engineering inspection services during construction of University Avenue (191h Street to Park Plaza Drive). 7. RESOLUTION To amend the engineering contract with PBS&J, Inc. for engineering inspection services for construction of University Avenue (13th Street to Park Plaza Drive). ORDINANCE Condemning certain Structures in the City of Little Rock, Arkansas, as structural, Fire and Health Hazards; directing the City Attorney to take such action as is necessary to raze and remove said structures; declaring an emergency; and for other purposes. Synopsis: Fifty (50) residential structures in dilapidated and/or burned condition causing a negative environmental impact on the residential neighborhoods in which they are located. The proposed McDonald's location at Cantrell/Chenonceau will utilize a new store layout designed to move more drive-thru traffic than older layouts like the Rodney Parham location. The proposed site layout also has more parking and is designed to allow traffic to circulate better than the confined Rodney Parham location. The existing store at Rodney Parham/Breckenridge is an older store layout that has been retrofitted with dual ordering stations, a pay window and a pick-up window. These improvements increased the capacity of the drive-thru, but are not as efficient as the new store layouts. To determine the impact of the proposed location, traffic counts were conducted at the following locations during the AM: 1. Conway (Salem Road) 2. Benton (I-30 WB Service Road) 3. Hot Springs (HWY 70 West) These stores have the same building layout as the proposed store. The counts included driveway volumes, parking volumes and drive-thru volumes. To calculate the capacity of the drive-thru, the pick-up window is the controlling factor for the capacity. The Rodney Parham pick-up window time was approximately 33 seconds, therefore over one hour (3600 seconds) 109 vehicles can be passed through the drive-thru. Using the worst case (Benton location) for the new layout, the pick-up window time was approximately 24 seconds, therefore over one hour 150 vehicles can be passed through the drive-thru. Using the Rodney Parham location as a baseline, the new layout locations function on average with greater than 36% more capacity. Traffic will not be a problem at this location. The new store layout operates with greater than 36% more capacity than the Rodney Parham location. Background. Jacobs Engineering was hired by McDonald's USA, LLC to conduct a traffic impact study for a proposed store location at the southeast corner of the intersection of Cantrell/Chenonceau. The proposed store would be approximately 4,000 square feet with indirect access to Cantrell and Chenonceau. Figure 1 shows the proposed site plan for the development. Concerns were raised about the traffic generated by the site during the AM peak hour of operation. The existing site at Rodney Parham/Breckenridge was cited as an example for the peak hour AM traffic spilling off site. Figure 2 shows several photos of the drive- thru queuing at the Rodney Parham/Breckenridge location. Rodney ParhamlBreckenridge Location. The existing store at Rodney Parham/Breckenridge is an older store that has been retrofitted with dual ordering stations, a pay window and a pick-up window. These improvements increased the capacity of the drive-thru, but are not as efficient as the new store layouts. Circulation on the site is limited due to the close proximity to the signalized intersection. The driveways on Rodney Parham and the northern most driveway on Breckenridge are frequently blocked by traffic queuing for the light. Vehicles exiting the drive-thru are forced to exit immediately onto Breckenridge near the front of the intersection queue, circle the building to exit onto Rodney Parham or continue all the way around the building to exit at the southern most driveway onto Breckenridge. The maximum queuing distance at the site is 180 feet. Proposed Location — Cantrell/Chenonceau. The proposed store will use the new layout which further increases the capacity of the drive-thru window. The proposed site is accessed via internal roads to the development from both Cantrell and Chenonceau. The drive-thru will utilize dual order stations, a pay window and a pick-up window. The drive-thru exit is separate from the dine -in exits. The queue length for the drive-thru is 220 feet. Data Collection. To determine the impact of the proposed location, traffic counts were conducted at the following locations during the AM: 4. Conway (Salem Road) 5. Benton (I-30 WB Service Road) 6. Hot Springs (HWY 70 West) These stores have the same building layout as the proposed store. The counts included driveway volumes, parking volumes and drive-thru volumes. Additionally, traffic counts were also conducted at locations with the old configuration during the AM. These locations were at: 1. Little Rock (Markham) 2. Little Rock (Rodney Parham) The traffic counts were conducted without notifying the store to help ensure data accuracy. Times were also collected during the counts to determine what the average times were to order, pay and pick-up. The traffic volumes were collected from 6:45 to 8:30. From the collected data, the peak hour was used to analyze the site to determine the operation. The data collected exceeds the Institute of Transportation Engineers (ITE) Trip Generation Rates (shown in Appendix A), and corresponds with the data collected by the City. El The longest observed queue length for the new layout (Conway, Hot Springs, Benton) is 15 vehicles. Figure 3 shows how a 16 vehicle queue looks on the Conway site. Table 1 shows the AM peak traffic volumes for the locations. Table 2 shows the average times to order, pay and pick-up. The City provided a current turning movement count for the intersection of Rodney Parham/Breckenridge. Analysis. After the data was collected, microsimulation models were prepared for the AM peak hour at the Rodney Parham location and an additional model was prepared for the proposed Cantrell/Chenonceau location using VISSIM. The models were calibrated using standard Federal Highway Administration (FHWA) guidelines. AVI files were created for the models and have been submitted with this report. The Rodney Parham model was developed using the times collected above along with the driveway and drive through counts collected for Rodney Parham. The proposed Cantrell/Chenonceau location model was developed using the Benton location service times listed in Table 2 (this location had the slowest service rates of the new layouts analyzed). The model used a drive thru volume of 115 (to match the drive thru volume counted by the City at Rodney Parham). To calculate the capacity of the drive-thru, the pick-up window is the controlling factor for the capacity. I was a member of the audience Tuesday night, March 31St, 2009, at the meeting of the Board of Directors, City of Little Rock, and as I live in the Bayonne subdivision, it was my hope — but not my expectation — you would decline the zoning reclassification for a fast-food franchise at the Little Rock City Officials April 2, 2009 Page Two Southeast Corner of the Highway 10 and Chenonceaux Drive intersection. First, although I have lived in Little Rock for well over thirty years, I have attended very few city board meetings. I want to applaud each of you, no matter how you voted, for your sometimes heavily -taxed patience, for your respectful demeanor toward all participants, for the selfless donations of time each of you routinely contribute, and I also note Mayor Stodola's even- handed superintendence. In this matter at earlier stages with the Little Rock Planning Commission, an elderly male member of that commission seemed drawn to insult and demean the opponents of the development, particularly the women who spoke, and it was reassuring to experience an absence of such behavior with the City Board of Directors. Frankly, as I have already stated, I expected the zoning variance to be approved, and I expected that because I have seen in other matters how the wheels get greased. I believe the virtual certainty with which prior variances to "the Highway 10 Overlay," as well as numerous other variances requested by developers, have been approved by the Little Rock Planning Commission demonstrates a systemic bias toward any development requested. I would strongly recommend that the staff and members of the Little Rock Planning Commission be required to document all contact any employee has with any and all representatives seeking any zoning change and that such contact be generally discouraged. Further, the concluding comments of Mayor Stodola cause some concern (and I only point this out because he is no longer our Prosecuting Attorney and, consequently, cannot charge me with anything).* People such as those who spoke Tuesday night, and thousands more, buy their homes and plan their retirements in these west Little Rock neighborhoods with a firm expectation the permitted development will not degrade their investments or their expected security. The protection of these lawful expectations is central to zoning laws in the first place. Mayor Stodola seemed to suggest in his concluding comments that the Highway 10 Overlay will certainly be reviewed in coming days — and it will almost surely be modified to permit greater development in light of the many variances which have already been granted. I hope I misunderstood this (which is increasingly possible) or that this sentiment is reconsidered. I don't believe mistakes of the past should control decisions of the future. And finally, Mrs. Flake said the opponents of the variance had gotten "emotional" about the issue, and that comment missed the mark. In a courtroom, Mrs. Flake would have been asked about her own financial interest in the zoning variance, and she would also be asked how many fast-food restaurants were within 400 yards of her front door. Director Hendrix noted the traffic difficulties with the McDonald's in downtown Little Rock at 7`h and Broadway — but it is alright with everybody downtown, she said, because they like McDonald's. I also frequent the McDonald's at 7th and Broadway, and I fight through the traffic — but it is coming at twenty or thirty miles per hour, not fifty or sixty. I also recognize Ms. Hendrix has a Masters Degree in Little Rock City Officials April 2, 2009 Page Three Urban Planning and Development, and I don't. If, on the other hand, the issue is perceived as involving race, ethnic backgrounds, living patterns by geography, or anything of that sort, I doubt if we are past those kinds of issues, but the desire to secure attractive and safe neighborhoods open to all should not be minimized by the fact others are less attractive and, or more dangerous. Again, even though a couple of you were absent, and even though several of you voted differently than I would have preferred, you demonstrated the best of grass-roots politics in this country — and I was proud of the Little Rock Board of Directors generally. First of all, there is not room for said restaurant at that location. Secondly, we already have too much traffic with people turning left at that comer. We do not need to make that comer even more hazardous. With all the places down Cantrell, why can't they locate it at a different site, that would be safer for the people. We can tolerate a business there from 8 to 5 during the day, but not a business there for 22 hours around the clock. We put our life savings into our home, and to have this restaurant so close to Chevaux Court, would lower the value of our home. You, by now, know that there is quite a lot of opposition. The opposition is not about commercial, as we all know something commercial would be built there, and it is not even about a restaurant. It is the fact that it is a DRIVE-THRU restaurant with very long hours of operation. One of our very main concerns is the high potential for even more traffic accidents, with possible loss of additional lives, with this type of commercial development at that corner. So many cutouts have been allowed within a very short span of highway east from the light, that the stacking and jockeying for left or right turn in the center lane is very alarming for those of us who live it, use it and see it every day now, before we have anything built on that corner and with the upcoming new elementary school being built not far away. There are so many concerns with the McDonald's being approved for that corner that you already know about: so many that do not fall into the guidelines of the DOD for the scenic byway of Hwy 10. We urge you to please listen to the people who know what it is like now to try to drive safely in and out of our neighborhoods and please vote NO to the proposed McDonald's on Cantrell and Chenonceau on Tues, Mar 3rd. The lot under consideration for McDonalds is too small for any drive-thru. While I understand the city wants the tax revenue and Mr. and Mrs. Flake want to sell the property, 1.25 acres is too small for aaR drive-thru ... especially on the corner of Hwy 10 (Cantrell) and Chenonceau Blvd. The speed limit is 50 MPH on Cantrell and most drivers exceed that. There have been at least 2 fatalities and more than 50 wrecks at that intersection. Why does the city have a design plan when it grants 75% of the variances it receives? Why bother having a plan? We built here with an understanding of exactly what would be surrounding our property, so as not to have our property devalued and we respectively request you adhere to the city plan. 1.25 acres is a far cry from the city requirement of 2 acres of land for a business. No traffic study is necessary when common sense screams backed up traffic, more wrecks and more fatalities. ...not to mention litter and loud music all hours of the day and night. McDonald's will apply for longer hours if established. It makes no sense to cram a drive thru on that lot, when 2 acre parcels are available elsewhere. It's already a dangerous intersection. The hours of operation are not conducive with our neighborhood or the other subdivisions in the area, neither is a drive thru restaurant of any kind. At that time, there were lots of green spaces, and traffic was not a serious problem. There was not even a traffic light until the Walton Heights entrance. Obviously, I anticipated commercial development in the area, but I trusted that city officials would protect citizens from intrusive building that would damage the quality of life in the area. Now, we are facing the prospect of a fast food restaurant with drive-through capabilities at the intersection of Cantrell and Chenonceau. The proposed restaurant would be located on land that is not large enough for such a facility, and the terrain is not appropriate for a drive-through. It would be located at an intersection that has had multiple automobile accidents in the past. The increased traffic in this area of Cantrell would seriously affect the residents in Chevaux Court. It is already difficult to enter and exit Chevaux Court during certain times of the day. Additional traffic would only add to the safety concerns of our residents. There is a traffic light at Hwy. 10 and Chenonceau, and I assume this is the reason we do not have a traffic light on Hwy. 10 at Chevaux Court and the Ranch Subdivisions. I am an older resident now and find that turning left onto Hwy. 10 at Chevaux is almost impossible at certain times of the day. Coming in and out of Chevaux is presently a traffic accident about to happen. The proposed drive-through restaurant at Chenonceau will only escalate traffic, and it will be even more dangerous for us in Chevaux. There are several reasons we oppose this construction. According to the DOD of the city of Little Rock, the site is not large enough to accommodate a business of this type. The DOD specifies a two acre plot and the sign advertising the land states that it is only 1.25 acres. The developers are asking for a variance from the rules and we ask that you not allow this to happen. The DOD has set rules and standards for a reason. Also, due to the rapid growth of businesses, schools, and churches along Highway 10, the traffic has increased tremendously. The addition of a fast food restaurant would certainly add to the congestion that is already a problem. Entering and exiting a fast food venue at this site would be extremely difficult and would most likely cause back ups on the highway. Lastly, we have strong concerns about the safety of both our residents and those who live near us. Many people enjoy the area for walking, jogging, and bicycling. In addition, there is a neighborhood swimming pool on Chenonceau Boulevard that attracts many families and young children. The increased traffic will surely have an adverse impact on the residents. Please be assured that we are not against growth in west Little Rock. The Planning Commission stated at their August 7 868-8969 jpbartos@sbcglobal.net meeting, that they felt a drive-thru at this particular corner met the "spirit" of the DOD. If the DOD were adhered to as originally intended, there wouldn't have to be an interpretation of the "spirit" which is a very subjective thing. Is there a minimum lot size, less than 2 acres, that has been established as the least that can be granted a variance? A half or three-quarters of an acre less than 2 acres is too big a variance in my opinion. If variances must be granted, a business more in character with what is already in our neighborhood would not be so vigorously opposed. A drive-thru at this location would be totally inappropriate as it would bring additional traffic to an intersection that has already had since the year 2000; 55 traffic accidents, many with injuries and one fatality. The other businesses at this corner close at 9 or 10 p.m. A drive-thru has asked to have their hours of operation as 5 a.m. to 2 a.m. and I am certain they would apply to have their hours extended to 24 hours once they become established. This, too, is totally wrong for our quiet neighborhood. I would be happy to meet with you and look over the property in question if you feel so inclined. With traffic flowing at 45-50 mph it is extremely dangerous even now. 2. If we keep changing the development rule's, what does this mean for the rest of the undeveloped property around us. I bought my home with the understanding that the undeveloped property behind me would be single level quiet office. Now I'm concerned it may be a Sonic or Wendy's. 3. The Planning Commissions states the the variance meets with the "spirit" of the DOD. Can I build a building and just conform to the "spirit" of the Electrical Code and Plumbing Code. The speed limit in this area is 50 mph, but I can assure you that this is a minimum speed. On this particular stretch of the road, it is already dangerous to use the center turn lane (otherwise known to residents in the area as the "suicide lane") because of the traffic backing up to make left turns. We live in a quiet neighborhood with mostly older residents and we have concerns about the highway safety of our residents and those that live nearby. A drive-thru fast food restaurant with its high volume of traffic entering and exiting on this particular section of Hwy. 10 would create an extremely hazardous situation. We realize that this property is zoned for commercial development and we are not anti business. If a variance must be granted, we would like to think that a business more in keeping with the area and the traffic problems would be more appropriate. The plot of land is simply too small. Secondly, traffic is already a concern for patrons of First Security Bank, the residents of Chevaux Court, The Ranch neighborhood, and for all the: neighborhoods off Chenonceau Blvd. We have seen the number of traffic accidents escalate year after year, including one with a fatality (as confirmed by accident reports from City of Little Rock Police Department). l am convinced that the addition of a business ort this corner, with a drive thru restaurant, open from 5:00 am until 2:00 am each day, will only exacerbate this problem and result in even more accidents and possible fat�liti2s; =- _rj_,Ijy during rnornin, rush hour. I am a resident of Bayonne Place and an immediate past -president of the Bayonne Place Property Owners Association. Our Property Owners Association is totally against having a McDonald's restaurant with a drive-through window at the corner of Highway 10 and Chenonceau and asks the Planning Commission to refuse the variance requested by Orion and McDonalds. This is not a good location for a high volume McDonalds for the following reasons: 1. This is yet another variance to the Highway 10 Design Overlay District that requires a minimum of 2 acres per building. 2. The high traffic level at this corner would cause a safety issue as vehicles exit onto Highway 10 which has a 50 mph speed limit... and we all know no one drives 50 on that stretch of highway! 3. The proposed hours of operation from 5 a.m. to I a.m, seven days per week would serve as a magnet to attract late-night undesirables to the area and cause an increase in the crime rate in our neighborhood — Bayonne - as well as surrounding neighborhoods — Aberdeen and Chevaux. 4. Property values will be negatively impacted with this McDonalds restaurant at the entrance to the Chenal Valley neighborhoods. 5. The neighborhood concept of livability will be violated with trash, noise and odor as well as air pollution from vehicles idling at the drive- through window. 6. We have been advised by many of our residents that they bought homes in Bayonne Place because of the peaceful atmosphere and neat appearance. A restaurant with a drive-through window will certainly compromise our peaceful atmosphere. 7. We do not understand why we need a second McDonalds in our neighborhood when there is already one located in the Wal-Mart Super Center one mile away. There are many other locations in the Highway 10 corridor that are not adjacent to residential neighborhoods and available for sale. We were very surprised to learn, as one Commissioner stated several times, the large tract of undeveloped land across from the Bayonne Place entrance and extending then on its eastern border north down Chenonceau Boulevard to Highway 10 is now, and as Mr. Spivey stated, has been since 1993, zoned Multi -Family 12 [referred to below as "MF 12" or "MF 6"]. Our problem with this is that such a zoning classification is dramatically different from the direct, written and widely distributed representations which came directly from Deltic Timber Corporation' and on which we have all relied in the substantial investments we have made in our homes. Whether we, or our builders, bought lots directly from Deltic Timber Corporation, or whether we bought our homes from prior owners, we were all provided with the "Chenal Valley Land Development Plan," and, because of this, we believed — as was expressly and explicitly 'No attempt is made here to define at this point the exact corporate identity of the exact entity which is responsible for these (mis)-representations. There are the usual reasons why we don't want a drive-through restaurant at this particular location to include excessive lights and noise almost around the clock, and trash along the roadway. However, our biggest concern is the safety issue due to increased drive-through traffic. We attended the Planning Commission's meeting on August 7th where the Commissioners voted to allow a variance requested because the development is too big for the lot size. The Commissioners' decision was based at least in part on their staff's traffic analysis. However, it was not at all clear to us that an adequate traffic analysis had been conducted. There was no document introduced or specifics offered by the staff representative at the meeting to support the existence of an analysis. There was, however, research offered up by concerned citizens in attendance that clearly pointed to serious problems in this area. We are convinced that we already have an unacceptable traffic safety problem. The addition of this drive-through traffic will turn an already scary situation for us, and our neighbors in Chevaux Court, into a nightmare. The DOD, prepared for the specific purpose of providing minimum guidelines for the ongoing growth and development along the Highway 10 corridor, should be followed. Serious consideration should be given to a proposed business's adverse impact on traffic in the area. Clearly, a drive-through type restaurant is not appropriate for this particular lot.
