Subject: variance issue
In looking at the staff write-up at the Planning Commission, the Public Works
conditions for approval of the development at issue include a grading permit prior to any
clearing of the land and a variance in order to grade the lots without imminent construction.
Since we know we have a separate application process for a variance, in trying to think this
through logically, it would seem that the way the process should work ,under our current
ordinances, is the applicant should pursue the PCD request and, if ultimately approved by the
Commission and Board, come back to the Commission and separately apply for the variance
from the land alteration requirements. Depending on the action of the Commission, the
applicant either proceeds with his project or appeals the variance decision to circuit court.
In the appeal going before the Board tomorrow night, the Commission only acted on
the PCD request. There was no separate action on the variance. Therefore, it seems to me that
if the Board reverses the decision of the Commission, and allows the project, the applicant will
need to request a variance from the Commission in a separate application. The bottom line is
that the Board would be able to consider the PCD tomorrow night, but would not be
considering a variance.
In the future, if a different process is desired, there will need to be an amendment to the
variance application code section. We can discuss that if desired. I left a message for Steve
Beck to discuss this further but understand that he said he had already spoken with Cindy.
However, I believe that was earlier this morning before this possible solution came to mind.
Please note that these are just my comments for discussion and in no way represent the
final opinion of the City Attorney's Office. Tom will provide that. I am available if anyone
wants to discuss this further.

RE: Cantrell Falls Development combination and revision of POD & PCD at 14910 Cantrell
Road
Dear Planning Commissioners,
As 19 year residents of the Westchester Subdivision my family and I continue to be opposed to
revisions in the POD and PCD for 14910 Cantrell Road. We are most concerned about the
continued resubmission for a drive thru window on Lot 1 of this proposal. Each time Mr.
Hockersmith has brought this to the Planning Commission and the Board of Directors the drive
thru window with menu boards and outside speakers for ordering has been revised to a lesser
use —a pick-up window/ door such as Carino's or Chili's have so that the application would be
approved. From the beginning of this saga in 2004 the "word on the street " in our area of town
was that Wendy's was to locate on this property and that is now stated in the letter
accompanying the amended proposal. This drives home the very point reported in Item L page
11, next to last paragraph of the January 18th Commission hearing minutes: "The Commission
questioned staff as to their opposition of the request. Staff stated the development was
expanding the commercial node to the west. Staff stated residents in the area feared a stripping
of Highway 10. Staff stated with the expansion of the node to the west this opened the door for
additional properties to become commercial. Staff stated the developer had indicated he would
not come back and amend the proverty to the west and the only assurance to the Commission
was his word. Staff stated he could sell the property and a new owner could request
commercial uses. Staff stated they felt it important to maintain the future land use plan and
support the area residents and their desire for maintenance of the plan."
By asking for this proposed amendment Mr. Hockersmith is changing the type of restaurant in
Lot 1 to something different than he discussed in the Board of Directors hearing on December
19, 2006. Although the Board was ruling on the plan for lots 3 & 4, Mr. Hockersmith talked
about how he planned to develop both properties as one and there were many questions and
comments on "quality" restaurants as opposed to fast food restaurants. . After a lengthy
discussion he assured the Board that he would be developing nice "quality" sit down
restaurants. At the Board's request, in a letter received by staff on December 20, the applicant
states "..... Most commonly, sit down restaurant refers to a casual dining restaurant with
table service rather than a fastfood service where one orders food at a counter. ........"
In addition to asking for an amendment to the property to the west, the plans for the current
revision no longer show the 2 "sit down dining facilities" that had a maximum total of 13,000
sq. ft. approved on January 18, 2007 on lots 3 & 4. The current plan shows 2 restaurants (6560 &
4000 sq. ft.), a branch bank with drive-thru (2000 sq. ft.), and 11, 617 sq. ft. of retail space. That's
a total of 24,177 sq. ft. of development on lots 3 & 4 or 11,177 sq. ft. more than was approved not
quite 12 months ago. It's just this kind of change that keeps neighborhoods distrustful of
developers and their reassurances.
As for the proposed Wendy's on lot 1— we are greatly concerned about the impact it will have
on our neighborhood, especially those of us living on Canterbury Court which will be nearest to
that location. Wendy's, as most fast food stores do, has to have a great volume of traffic. We
have no desire to sit on our deck and listen to orders being read back over the speaker —
remember that Wendy's advertises their drive thru windows staying open until 1 am. Nor do
we relish feeling the throbbing bass of some of the customers' sound systems vibrating our
windows as they wait for their orders—we frequently had that experience when Harvest Foods
was in business. We're extremely concerned about the amount of additional traffic a fast food
restaurant adds to an already congested traffic node.
If you're not convinced that the quality of enjoyment of our home and yard would be altered,
we invite you to come by and sit on our deck some time. We think you'll be surprised at the
level of today's traffic and other ambient noise.
When we've written to and appeared before the Commission in the past, we tried to express
that we've always understood there would be change along Highway 10 but, at the same time,
we were expecting the Planning Commission and the Board of Directors to adhere to the Future
Land Use Plan and the Highway 10 plan. Those plans had specified commercial nodes with
less intense uses spreading out from the nodes that were to protect not only the existing
neighborhoods along Highway 10 but were to keep Highway 10 from becoming another
stripped out street like Rodney Parham became. We realize that you cannot reverse the actions
already in place, but we do hope you'll make every effort to see that developers adhere to the
less intense plans they present for approval when they come back for more intensive revisions.
That's the case here. We respectfully implore you to look at the impact this proposal will add to
the overall Highway 10 -Taylor Loop commercial node and deny this application.

Road
Dear Planning Commissioners,
As a resident of the Westchester neighborhood, I am opposed to the proposal for 14910 Cantrell
Road. This proposal not only adds a drive-thru restaurant on this site but the new changes
increase the density of the project over 24% from the currently approved plan. This is the 4th
time the applicant has proposed a drive-thru for this location and this application specifically
names Wendy's as the drive-thru restaurant. Wendy's advertises that its drive-thru windows
stay open until 1 am which isn't conducive to late night quietness for the abutting
neighborhoods. In addition, all prior concerns for this location still exist— lack of transition from
the commercial node, high density of buildings, traffic, ingress and egress into the
development, noise, etc. This proposal meets neither the letter nor the spirit of the Highway 10
Overlay Plan or the Land Use Plan. It even more heavily impacts the commercial node at
Taylor Loop and Highway 10 than the plan this Commission approved in January, 2007, shortly
after the applicant had assured the City Board of Directors he would not come back and amend
the application for lots 1 and 2—refer to minutes for January 18, 2007, meeting: item L, page 11.
I ask that you carefully consider the impact a project of this density will have on the overall area
and, especially, the president it would set for allowing a drive-thru restaurant outside the
designated commercial node areas in the Highway 10 Plan. Please deny this application.
Thank you for your consideration of this matter that is important to my neighbors and me.

We completely concur with Celia Martens most eloquent voice of our concerns. It is becoming
very congested in this area and last Sunday, a normally light traffic day in the past, there were
wrecks, police, wreckers, fire trucks, media, etc. in this area all day for at least 2 or 3 accidents.
During the winter months especially, without tree foliage, you can hear speeding cars, delivery
diesel trucks, and pre -dawn trash pick-up at the new commercial properties on Cantrell.
Enough please—would you like to live with these challenges we're facing regularly.
People are speeding through red and yellow lights at Cantrell and Taylor Loop regularly. It is
fast becoming a high speed Rodney Parham or Cantrell / Tanglewood (wait and see what
Walgreens does to that area!) I was led to believe the Planning Commission had thought out a
plan and was going to stick to it. I'm in the construction business and enjoy economic
"controlled" growth where it benefits ALL the public not just the developers and their clients.

I would like to convey my opposition to the Cantrell Falls Development combination and revision of POD & PCD at
149170 Cantrell Road. I have appeared before the Planning Commission on several occasions to discuss the
storm water drainage problem in the Westchester neighborhood. I came away from the meetings with lip service
and a promise to repair the system by including the project in future city bond issues.
Now let's be real. You know, I know and the city director's know the limited possibility of a near term solution to
the flooding problems. When developers meet the intent of City ordinances they should be given approval of
their site plans. However, if the ordinances have overlooked a condition that presents potential harm to the
residents of Little Rock, then the Planning Commission and the Board of Directors should consider the
extenuating circumstances and try to do the "right thing" to prevent damage or loss to resident's property. A
common sense approach to certain issues will, in most cases, lessen the impact of events that the authors failed
to consider when the ordinances were written.
Ladies and Gentleman; this is not a NIMBY reaction to a minor concern. We are trying to protect our homes from
potential serious damage. You the planning commission as representatives to city government have been made
aware of the infrastructure issues. You the planning commission, as a representative governing body are bound
by law to decide this issue in the best interests of the residents of Little Rock.
Should you approve this POD and PCD, please require the developer to test his site drainage plan for accuracy in
order to minimize the impact on the Westchester neighborhood, i.e. attach an amendment to the site plan that will
require the developer to prove that no storm water from this site is channeled to the Westchester neighborhood.
I would also ask that you carefully consider the impact a project of this density will have on the overall area and,
