HomeMy WebLinkAbout16190 RESOLUTION NO. 16,190 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO AN AMENDED AND SUBSTITUTED LEASE AGREEMENT WITH 5 THE ARKANSAS DEPARTMENT OF PARKS, HERITAGE, AND 6 TOURISM FOR PARKING WITHIN WAR MEMORIAL PARK; AND 7 FOR OTHER PURPOSES. 8 9 WHEREAS,the Board of Directors adopted Little Rock, Ark., Resolution No. 10,473 (February 16, 10 1999) authorized the City Manager to enter into a lease agreement with the War Memorial Stadium 11 Commission for parking within War Memorial Park("Lease Agreement");and, 12 WHEREAS, the Board of Directors amended Resolution No. 10,476 with the adoption of Little 13 Rock, Ark., Resolution No. 13,009 (August 3, 2009) authorizing the amendment of the Lease Agreement 14 which was necessary due to further negotiations between the City and the War Memorial Stadium IS Commission; and, 16 WHEREAS,the Lease Agreement will expire on December 31,2023;and, 17 WHEREAS, Act 269 of 2017, Regular Session, placed the War Memorial Stadium Commission 18 under the authority of the Arkansas Department of Parks, Heritage and Tourism;and, 19 WHEREAS, there is need for the City to enter into a one (1)-year Amended and Substituted Lease 20 Agreement with the Arkansas Department of Parks, Heritage and Tourism for parking within War 21 Memorial Park. 22 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 23 THE CITY OF LITTLE ROCK,ARKANSAS: 24 Section 1. The City Manager is authorized to enter into a one (1)-year Amended and Substituted 25 Lease Agreement with Arkansas Department of Parks, Heritage and Tourism, for the purpose of parking 26 within War Memorial Park. 27 Section 2. The amended and substituted lease agreement shall commence on January 1, 2024, and 28 shall terminate on December 31,2025. 29 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 30 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 31 adjudication shall not affect the remaining portions of this resolution,which shall remain in full force and 32 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 33 resolution.
